This letter is to notify you that your hog farm was investigated on
July 2, 1985 by members of the staff of the Fayetteville Regional Office
and determined to be a concentrated animal feeding operation. This being
the case, you should submit applications for an NPDES Discharge Permit in
accordance with Title 15, N. C. Administrative Code 2H.0223 and adopted
Federal Regulations 40 CFR "Appendix B to Part 122 - Criteria for Determining
a Concentrated Animal Feeding Operation (122.54)."
This designation was made based on the following consideration: There
was a direct discharge of animal waste from a two (2) stage waste stabiliza-
tion lagoon by a manmade conveyance into the Big Swamp drainage area,
classified C Swamp, Cape Fear River Basin.
If you can permanently eliminate the discharge of wastewater to the
surface waters within sixty (60) days from receipt of this notice to
submit permit applications, a permit application will not be required. If
modifications are necessary to permanently eliminate the discharge of
wastewater to the surface waters of the State and they cannot, or are not
completed within sixty (60) days of receipt of this notice, a Permit applica-
tion must be submitted. For your information, the following items are enclosed.

2. Three copies of NPDES Permit Application - Short Form B
If you cannot permanently eliminate the discharge within sixty (60)
days, the Permit applications will be processed. Said Permit will contain
a time schedule leading to the completion of construction of an animal
waste management system not discharging to the State's surface waters. We
know from past experience that excellent advice with regards to managing
animal waste may be obtained from the N. C. State University's Department
of Biological and Agricultural Engineering at 919/737-2675.
Permit applications should be submitted in duplicate to the Director,
Division of Environmental. Management, P. 0. Box 27687, Raleigh, North
Carolina 27611. Assistance, if desired, can be obtained by contacting
Mr.Grady Dobson in our Fayetteville Regional Office at 919/486-1541.
