This sample results revealed that the dissolved oxygen level downstream of the runoff from your dairy was below the water quality standard for Class "C Swamp" waters. According to Administrative Code Section: 15 NCAC 2B.0100, the Standard for dissolved oxygen levels in designated "C swamp" waters such as.,Brown Marsh Swamp is an average of 5.0 mg/1 and an instantaneous low of 4.0 mg/l. Our sampling revealed the dissolved oxygen level to be 0.25 mg/1 downstream of the dairy and 'the upstream (collected above your dairy) was 4.6 mg/l. These results indicate that the wastewater discharge from your dairy operation did result in a violation of water quality standards. This represents a direct violation of NCGS 143-215.1 (a)(6) for which a civil penalty may be.assessed in accordance with NCGS 143-215.6. Noland, Regional ^fic Fayetteville Regional SUBJECT: Concentrated Animal Operation Danford Dairy Farm Bladen County On February 26, 1990, Mr. Grady Dobson, Environmental Engineer, and Mr. Ricky McLamb, Monitoring Technician, conducted an investigation in response to a,local resident's complaint. Our investigation revealed that the Danford Dairy. Farm had - a discharge of wastewater from a man-made drainage ditch into Brown Marsh Swamp, Class "C" Swamp, Lumbee River Basin. The flow in the ditch, consists of surface runoff from the dairy barn complex and surrounding pasture land during rainfall events.. The farm is a 429-milk cow dairy farm operation consisting of feeding barns, containment barns, and milk barns. All cow manure is scraped from these containment barns and milk barns into a concrete pit and mixed with water and pumped into a 1.0-MG capacity holding tank. The wastewater from this tank is applied via honey wagons to farm land during planting season and after summer and fall harvest seasons. During this inspection, waste was being removed from the tank and land applied to farm fields. The manure which spilled on the ground will be imbedded in tractor tires and deposited onto farm haul roads and eventually diverted into the man-made drainage ditches. The sample analysis for samples collected on this date indicates that wastewater from the dairy farm does enter state surface waters via the drainage ditches. It is our opinion that the ditch collects surface water runoff from the barn area and adjacent pasture and would receive wastewater from farm haul roads during rainfall events. There were no point sources of discharge except that of the drainage ditch outlet(s) to surface waters. Mr. Chuck Wakild Page 2 March 19, 1990 During the course- of the inspection, determinations were made in accordance with NC Administrative Code 2H .0123(a)(3). The investigation did reveal the following: 1. It was determined that a pollutant discharge had occurred from the Danford Dairy Farm resulting in a violation of water quality standards, as a result of any rainfall event less severe than a 25-year, 24-hour event. This stream impact occurs as the result of improper waste management practices --more specifically --the runoff of waste from the barn, wastewater holding tank, and adjacent pasture. This problem is not the result of a 25-year, 24-hour rainfall event. In accordance with field evaluation and the "Concentrated Animal Feeding Operation Regulation," the owner should be given notice in accordance with Subchapter 2H, Section .0123(b).
