4a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:*
The site is located in southern Durham County along Angier Avenue. The site consists of seven parcels, including a portion of Bethesda Community Park to be utilized for a proposed
sanitary sewer extension. The site is bound to the north by Angier Avenue and residential, single family homes, to the east by residential single family homes, to the west by a railroad
and forested areas, and to the south by a Bethesda Community park and forested areas. The site is currently forested with elevations ranging from 400 feet above mean sea level
(MSL) in the northern portion of the project to 340 feet MSL in the southern portion. An unnamed tributary to Northeast Creek flows across the southern portion of the site. Three
wetland areas were also identified on the site.

The purpose of the proposed project is to construct a 70 -lot residential subdivision with associated storm oter control measures, access roads and utilities, including a proposed
sanitary sewer extension to serve the subdivision.

1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:
The applicant requested a detailed delineation of streams and wetlands within the proposed project boundaries prior to finalizing
the plan to ensure
the limitation of impacts to the natural environment. Following the delineation, the proposed grading and sewer alignment was shifted in places to
minimize impacts to wetlands, streams and buffers. In addition, the proposed sewer alignment was designed to cross ata 90 -degree angle
perpendicular to the streams in order to mimimize the length and effect of the crossing. Finally, all stormwater was designed to discharge outside of
the riparian buffers, streams and wetlands located on the property.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques:
Standard sediment and erosion control practices will be installed prior to construction and maintained throughout the construction of the project. The
excavation of the streams will be completed in dry conditions (i.e no flow). H necessary, a temporary check dam with
apump-around setup will be
implemented to handle stream flow. Following construction of the sewer line, the areas will be restored to pre -construction contours and promptly re-
seeded with native plants.

Based on a reviewof the U.S. Fish and Wildlife IPaC database as well as the N.C. Natural Heritage Program on-line mapper, no critical habitats or

of-ways were observed to be densely vegetated, primarily with invasive species.

1. CONTRACTOR TO ATTEMPT TO SCHEDULE WORK DURING FORECASTED / EXTENDED DRY PERIODS.
2. PRIOR TO CONSTRUCTION, CONTRACTOR TO IDENTIFY PERMIT CONDITIONS AND IMPACT AREA LIMITS. CONTRACTOR TO INSTALL
WATERSHED FENCING TO DELINIATE APPROVED WORKING LIMITS AND ISOLATE THE WORK AREA FROM THE JURISDICTIONAL AREAS
(WETLAND, RIPARIAN BUFFERS) AS REQUIRED.
3. INSTALL TEMPORARY SILT FENCE / WATTLES AND DEWATERING DEVICES TO TREAT RUNOFF FROM THE WORK AREA AS NEEDED.
EXCAVATED MATERIAL FROM TRENCHES SHALL BE PLACED ON THE UPGRADE SIDE OF THE TRENCH TO ALLOW MATERIAL TO ERODE INTO
THE TRENCH. INSTALL TEMPORARY SILT FENCE AROUND EXCAVATED TRENCH SPOIL AREA(S) REMAINING IN PLACE AT THE END OF THE
WORK PERIOD.
4. INSTALL TEMPORARY STREAM CROSSINGS AS NEEDED. (NCDOT STD 1645.01).
5. TO KEEP THE WORK AREA DRY, INSTALL DEWATERING DEVICES SUCH AS SILT BAGS TO MANAGE WATER FROM THE WORK AREA PRIOR TO
DISCHARGE BACK INTO STREAM; ALL WATER COLLECTED WITHIN THE WORK AREA MUST BE PUMPED TO DEWATERING DEVICES.
CONTRACTOR TO MINIMIZE THE EXTENT OF THE AREA TO BE DEWATERED.
6. CONTRACTOR MUST INSTALL GEOTEXTILE FABRIC BENEATH ALL TEMPORARY IN-STREAM STRUCTURES (CROSSINGS, ETC.), AND REMOVED
IN THEIR ENTIRETY IMMEDIATELY UPON COMPLETION OF IN-STREAM WORK.
7. EXCAVATE UTILITY TRENCH(S) AS WORK PROGRESSES. MATERIAL FROM UTILITY TRENCH TO BE TEMPORARILY STOCKPILED OUTSIDE OF
BUFFER LIMITS WITH PERIMETER EROSION CONTROL MEASURES.
8. INSTALL UTILITY(S) PER THE PLANS, UTILITY OWNER STANDARDS AND SPECIFICATIONS, AND ANY SPECIFIED PERMIT CONDITIONS.
CONTRACTOR TO ENSURE THAT ALL WORK FALLS WITHIN THE THRESHOLD OF THE RIPARIAN BUFFER RULE OR OTHER RULE. NO LIVE OR
FRESH CONCRETE SHALL COME INTO CONTACT WITH JURISDICTIONAL WATERS UNTIL THE CONCRETE HAS CURED.
9. RESTORE THE AFFECTED AREAS TO THE PRE-PROJECT CONDITIONS. CARE SHOULD BE TAKEN TO NOT DISTURB OR DESTABILIZE THE
UNDISTURBED STREAMBED DURING REMOVAL OF TEMPORARY DEVICES.
10. UPON COMPLETION OF BACKFILL OPERATIONS, CONTRACTOR TO PREPARE SLOPES AND STABILIZE OTHER DISTURBED AREAS.
CONTRACTOR TO MAINTAIN EROSION AND SEDIMENTATION CONTROL MEASURES UNTIL GROUNDCOVER OR VEGETATION IS WELL
ESTABLISHED.
11. UPON ESTABLISHMENT OF VEGETATION, REMOVE ANY REMAINING EROSION AND SEDIMENTATION CONTROL DEVICES AND STABILIZE
DISTURBED AREAS. WITHIN JURISDICTIONAL WATERS AND WETLANDS, ALL TEMPORARILY DISTURBED AREAS SHALL BE RESTORED TO THE

X There are wetlands on the above described property, that may be subject to Section 404 of the Clean Water Act
(CWA)(33 USC § 1344) and/or Section 10 of the Rivers and Harbors Act (RHA) (33 USC § 403). The wetlands have
been delineated, and the delineation has been verified by the Corps to be sufficiently accurate and reliable. Therefore this
preliminary jurisdiction determination may be used in the permit evaluation process, including determining compensatory
mitigation. For purposes of computation of impacts, compensatory mitigation requirements, and other resource protection
measures, a permit decision made on the basis of a preliminary JD will treat all waters and wetlands that would be affected
in any way by the permitted activity on the site as if they are jurisdictional waters of the U.S. This preliminary
determination is not an appealable action under the Regulatory Program Administrative Appeal Process (Reference 33
CFR Part 331). However, you may request an approved JD, which is an appealable action, by contacting the Corps district
for further instruction.
There are wetlands on the above described property, that may be subject to Section 404 of the Clean Water Act
(CWA)(33 USC § 1344) and/or Section 10 of the Rivers and Harbors Act (RHA) (33 USC § 403). However, since the
wetlands have not been properly delineated, this preliminary jurisdiction determination may not be used in the permit
evaluation process. Without a verified wetland delineation, this preliminary determination is merely an effective
presumption of CWA/RHA jurisdiction over all of the wetlands at the project area, which is not sufficiently accurate and
reliable to support an enforceable permit decision. We recommend that you have the wetlands on your property
delineated. As the Corps may not be able to accomplish this wetland delineation in a timely manner, you may wish to
obtain a consultant to conduct a delineation that can be verified by the Corps.
B. Approved Determination
There are Navigable Waters of the United States within the above described property subject to the permit requirements of
Section 10 of the Rivers and Harbors Act (RHA) (33 USC § 403) and Section 404 of the Clean Water Act (CWA)(33 USC
§ 1344). Unless there is a change in law or our published regulations, this determination may be relied upon for a period
not to exceed five years from the date of this notification.

C. Basis For Determination: The property contains jurisdictional waters of the US, wetlands adjacent to tributaries of
Little Lick Creek. Little Lick Creek is a tributary of Falls Lake, a Traditional Navigable Water.
D. Remarks: This JD was confirmed by field inspection on 10/28/2016. The drawing on the attached figure,
“PRELIMINARY WATERS OF THE US ASSESSMENT RESULTS, ANGIER AVENUE SITE”, dated SEPTEMBER 2016,
generally depicts the approximate location of the potential jurisdictional waters of the US (wetlands) within the property.
E. Attention USDA Program Participants
This delineation/determination has been conducted to identify the limits of Corps’ Clean Water Act jurisdiction for the
particular site identified in this request. The delineation/determination may not be valid for the wetland conservation
provisions of the Food Security Act of 1985. If you or your tenant are USDA Program participants, or anticipate participation
in USDA programs, you should request a certified wetland determination from the local office of the Natural Resources
Conservation Service, prior to starting work.

date of this notice, means that you accept the approved JD in its entirety, and waive all rights to appeal the approved JD.

must be received by the division engineer within 60 days of the date of this notice.
E: PRELIMINARY JURISDICTIONAL DETERMINATION: You do not need to respond to the Corps regarding the
preliminary JD. The Preliminary JD is not appealable. If you wish, you may request an approved JD (which may be appealed),
by contacting the Corps district for further instruction. Also you may provide new information for further consideration by the
Corps to reevaluate the JD.
