Dear Permit Holder:
The Division of Energy, Mineral and Land Resources has reviewed your submittal of the No
Exposure Certification for Exclusion from NPDES Stormwater Permitting form. Based on your submittal
and signed certification of no exposure for the facility at 1032 Unifi Industrial Road, Yadkinville, North
Carolina, as well as observations made by Brandon Wise with the Winston-Salem Regional Office on
May 13, 2019, the division is grating your conditional exclusion from permitting as provided for under 40
CFR 122.26(g), which is incorporated by reference in North Carolina regulations.
Please note that by our acceptance of your No Exposure Certification, you are obligated to
maintain no exposure conditions at your facility. If conditions change such that your facility can no
longer qualify for the No Exposure Certification, you are obligated to immediately obtain NPDES permit
coverage for your stormwater discharge. Otherwise, the discharge becomes subject to enforcement as an
un-permitted discharge. You must self -re -certify annually using the enclosed form or obtain NPDES
permit coverage for any stormwater discharges from your facility. The annual self -re -certification does
not need to be submitted unless requested, this form should however remain on file and be available for
review should an inspector request it. The permit holder should also understand that should issues arise
that the department deems to be a problem, then this permit can be suspended and the site can be required
to obtain other NPDES permits. The permit holder must also understand that compliance inspections can
be performed at any time by North Carolina Department of Environmental Quality personnel, to ensure
no exposure conditions are being maintained. Please note that during the inspection NCDEQ identified
some storage of materials in an area at the southwest corner of the facility. It did not appear that this
materials storage was a long term storage, however, any storage of materials should be done undercover
to prevent potential pollutants from reaching the stormwater.
Your conditional exclusion from permitting does not affect your facility's legal requirements to
obtain environmental permits that may be required under other federal, state, or local regulations or
