The new Boathouse will be located in approximately the same footprint as the existing Boathouse. The existing Boathouse has not be demolished yet. The original fill associated with the existing Boathouse is about 35 CY. The fill associated with the new Boathouse is approximately 40 Cy. I am proposing a change to the PCN Form to NWP 3 authorization. I have attached a copy of the revised PCN Form changing to a NWP 3. Please let me know if this is acceptable. Rosman, NC 28772 Terry Allen, The Corps has received (April 26) and reviewed the submitted Pre -Construction Notification (PCN) application and supporting documents for the new boathouse foundation at the McCarter residence, 282 Windward Point, Lake Toxaway, Transylvania County, NC. The PCN request utilization of Nationwide Permit (NWP) 18 for 0.08 acres of temporary open water impacts and 0.02 acres of permanent open water impacts to Lake Toxaway for construction the new boathouse foundation. NWP 18 authorizes minor discharges of dredged or fill material into all waters of the U.S. (WoUS). Under this NWP the quantity of discharged material cannot exceed 25 cubic yards below the plane of the ordinary high water mark (OHWM). After review of the submitted PCN and supporting documents the Corps has the following comments and request for additional information. 1) Review of the submitted documents indicate 38-40 cubic yards of fill are to be placed below the OHWM. This amount exceeds the allowable fill volume under NWP 18. Please confirm the amount of fill to be placed in WoUS for this project. 2) Is the new foundation replacing an existing foundation at the same location on the property? If so, what is the amount of fill in WoUS of the existing foundation? 3) As proposed the project does not meet the conditions of NWP 18. You may need to redesign the project to meet the conditions of NWP 18 or withdraw this request and resubmit the project under another NWP or resubmit the project under an individual permit. Please copy Kevin Mitchell with NC Department of Environment Quality, Division of Water Resources and Andrea Leslie with NC Wildlife Resources Commission (NCWRC) on your response to this request. At this time, the request to utilize NWP 18 for authorization of impacts to WoUS for this project is on hold until the above noted information is submitted. Once the Corps receives the information listed above and comments from NCWRC we will be able to continue to process your application. If you have any questions please contact me.
