Good Afternoon Sue,
I completely understand about doing too many things at the same time as I was doing the same on my end. I will work
up the area of the blue and include that in our chart on the first sheet.
I have attached a copy of the plan and profile drawing for the improvements under 1-40 and to the south to provide a
larger area of what is going on. You will note that all sewer alignment to the south is more than 50 -ft away from top of
bank south of 1-40. 1 have also attached a potential alignment for a perpendicular entry crossing. I would not
recommend revising the plan to provide a perpendicular entry crossing as shown for the following reasons:
1. 2 additional manholes would be required (total of 4) within a 106 -ft section of sewer line.
2. 2 90° bends would increase turbulence of the flow and increase the likelihood of an overflow.
3. Town has obtained easements (in processes of being recorded) from Hinton property and may be in
condemnation with Linville Family, LLC (not responding to offers from Town).
4. Total length of sewer alignment would be longer, increasing installation, maintenance and land acquisition costs.
I will revise the sheets we previously submitted to reflect the revisions comments below and forward to you upon
completion.
Let me know if you have any other suggestions for the south side.

Hi Mark,
Sorry, I left the office early yesterday and had a site visit this morning.
It appears that I was trying to do too many things at once yesterday and completely missed that the areas you have as
existing use is fill for the pond. That makes complete sense now. So, you have it correct as is, the only impact that is
new would be the blue area.
So now we have to figure out what to do with the impacts on the eastern side of 140. It looks like these would be "other
than perpendicular crossings" impacts but since I only have a small snapshot image, is there anything I'm missing on this
side?

The green area that I have shown is the fill slope of the pond. The contours shown represent a slope of 3:1, thus all this
area was originally filled. If the only area that I can count is the rip rap, then that's what I will count, but obviously the fill
slope of the dam impacted the buffer zone if the buffer zone existed at time pond was constructed. Let me know if I can
only count the area shown to be rip rap or the area of the fill slope is included (as shown).

Hi Mark,
I know how confusing this is, so bear with me please. I've attached your drawing with some notes. From manhole 9 to
mh 10, we'll call that a perpendicular impact and from mh 10 to mh 11 that would be a "other than perpendicular
crossing" impact.
See my notes for what should be existing versus what you need approval to impact. Or at least, what I think based on
not having seen the site.

As a follow-up to your email to Phil regarding the Brookford project, I have attempted to update the map as to how I
interpret your comments for the project. Italicized text is your original comment.
1. You can deduct the area that's part of the detention pond outlet from your impact amounts in both Zone land
Zone 2. On the attached drawing, I have shown 2 areas in green. The area in green at MH 9 is the existing rip rap
area installed by NCDOT during construction of 1-40. This area can be deducted from the calculations. The
second green area includes the fill slope of the detention pond and the area of the rip rap channel outlet. Is this
a correct interpretation?
2. It's a perpendicular entry into the bufferso we treat it like a crossing. The blue area within zone 1 is considered a
perpendicular entry. Is this area considered an impacted area and will be part of the mitigation area or do we
need to list area as a perpendicular impact or allowable impact?
3. The existing use areas will be identified in the chart shown on sheet 1.
Please advise if my interpretations are correct and if so, I will update the chart on sheet 1. Josh is out of the office this
afternoon, or I would have asked him for his opinion prior to sending to you.

Well, now that I've reviewed it, there are some questions, sorry:
Based on what I can tell, these impacts fall under "Non -electric utility lines, Impacts other than perpendicular
crossings". That means that impacts to Zone 1 will require mitigation. However, on Sheet 2, the western side of 140, you
can treat the tie in as a perpendicular crossing, even though it doesn't cross the stream, it's a perpendicular entry into
the buffer so we treat it like a crossing. Also, you can deduct the area that's part of the detention pond outlet from your
impact amounts in both Zone 1 and Zone 2. So if you can send me an updated Zone 2 that shows these areas using
different colors, and calls out the riprap area as an "existing use" then you'll need to get a mitigation acceptance letter
from DMS and send all that to me. Does that make sense?

Thanks Sue, Yes we will move forward with the jd , even though we do not think there are any wetlands ( Josh thinks it
will be a good idea to have it done). I will call Bryan and give him an update. Mark thought we had one done, but the
project started in 2012 and ECS cannot find any wetland studies.

Thanks Phil. If there are any low/questionable areas then having a jd done for the line would be prudent, however if you
don't need coverage under a Nationwide permit from the USACE then you don't technically NEED a jd. You could
respond to Bryan that an error was made on the submittal form and that this application is solely for buffer impacts,
that there are no stream or wetland impacts along the project.

Hi Sue,
Mark Reich was trying to find out from ECS if a wetland study had ever been done on it, he thought it had, so the last I
heard they finally got back with him and it had not had one. He was going to get Pilot Environmental to do one. I do not
think it has been done yet.
Since this was my first permit submittal, not sure if it was right, but most of the pipeline is outside the buffer except
where it was required to go under the Highway in the existing encasement.
Any guidance you can give will be much appreciated!!!!

On April 17, 2019, we received the Pre -Construction Notification you submitted on behalf of the Town of Kernersville on
a property located in Forsyth County, North Carolina. I have completed my initial review of the application and I have
determined that it is incomplete and deficient. The following information is necessary for the revised Pre -Construction
Notification (PCN):
a. The Corps does not regulate county/state stream buffer areas. The Corps regulates waters of the United States
(WoUS) pursuant to Section 404 of the Clean Water Action and Section 10 of the Rivers and Harbors Act. WoUS are
defined in 33 Code of Federal Regulations, Part 328. These waters include more than navigable WoUS and are the
waters where permits are required for the discharge of dredged or fill material pursuant to section 404 of the Clean
Water Act. Please be aware that any discharge of excavated or fill material in WoUS and/or any adjacent wetlands will
require Corps permit authorization. The type of Corps authorization required (i.e., general or individual permit) will be
determined by the location, type, and extent of jurisdictional area impacted by the proposed project and by the project
design and construction limits. Therefore, based on the information provided in PCN this proposed project would not
qualify for a standard permit and would be eligible to be permitted under a general permit (Nationwide Permit 12,
Utility Line Activities).
b. In Part C(5)(a) you stated "wetlands or streams have not been delineation on the property or proposed impact areas."
As specified in General Condition 32(b)(5) of Nationwide Permit 12, "The PCN must include a delineation of wetlands,
other special aquatic sites, and other waters, such as lakes and ponds, and perennial, intermittent, and ephemeral
streams, on the project sites." Therefore, a delineation of the proposed project area is a required piece of a complete
PCN. In addition to the delineation of the entire proposed project area, the associated delineation report (which may
include figures, maps, wetland datasheets, stream forms, etc.) must be submitted along with the revised PCN. Also,
during the review process of the revised PCN, the Corps may determine if a site visit is needed prior to issuing a
Nationwide Permit for the proposed project.
c. Part D(1) needs to be revised to include all impacts to streams and /or wetlands within the proposed project area.
PLEASE NOTE:
- If there is any confusion on the Section 404/401 permitting requirements, then please reach out to Sue Homewood
(with the State) and/or myself prior to submitting an incorrect application. These deficiencies discussed above could
have been addressed during a phone call or pre -application meeting prior to submitting the PCN to the Corps. In the
future, if you think a proposed project qualifies for a Standard Permit (WoUS impacts of greater than 0.5 acre of
wetlands or 300 linear feet of stream) then I would recommend scheduling a meeting with the Corps and the State
Water Quality Section to discuss purpose and need, avoidance and minimization and alternatives analysis for the
proposed project.
- A Department of Army determination does not relieve the permittee of the responsibility to obtain any other Federal,
state (401 Water Quality Certification), or local approvals/permits. The permittee should contact the appropriate state
agency to ensure a 401 Water Quality Certification is not required for the proposed project.
Please provide the information requested above in ONE consolidated response within 30 -days of the date of this
correspondence. If you do not respond within 30 -days, the request will be administratively canceled. Please contact me
via telephone or e-mail if you have any questions.
