It was observed that a small amount of seepage was discharging from a plugged pipe in the lagoon adjacent to the buildings. This needs to be addressed by the technician developing your farm plan. The trees and shrubs on the sides of the lagoons also need to be cut. You should expect another operation review within the next month or two to be performed by the Division of Soil and Water. The shrubs and overgrowth should be cut prior to this review so that a proper inspection can be performed. Any further correspondence related to the subject inspection will be sent under separate cover. Also, please be advised that North Carolina General Statutes provide for penalties of up to $10,000 per day per violation as well as criminal penalties for violations of state environmental laws and regulations. Porter County: Union Dear Mr. Porter: NCDENR Senate Bill 1217, enacted by the North Carolina General Assembly in 1996, states "a certificate holder who fails to renew their certificate and pay the renewal fee within 30 days of its expiration shall be required to take and pass the examination for certification in order to renew the certificate". You were mailed an invoice in October 2000 notifying you that your certificate would expire December 31, 2000, and that a $10.00 annual renewal payment was due by that date. The 30-day grace period ended January 30, 2001. Since your payment was not received, your certificate expired effective December 31, 2000. Therefore, you do not possess a valid animal waste management certificate. Please note that without a valid certificate, law prohibits you from performing the duties of an Operator in Charge of an animal waste management system. The next available opportunity to retake the Animal Waste Management System Operators certification examination will be June 14, 2001. An examination application is enclosed for your use. Please note that a completed examination application must be postmarked 30 days prior to the examination that you wish to take. Monroe, NC 28110 Subject: Site Inspection Shadow Lane Farm, Facility #: 90-32 Union County, NC Dear Mr. Porter: Mr. Alan Johnson of this office has been asked on several occasions about the appropriate time and proper method to take soil and waste samples. Also, during his inspections, he has noticed that while the storage capacity may be adequate in the storage pond/lagoon, in some cases it was not at the level set forth in the waste utilization plan. Mr. Johnson has also noted that some animal operations using hay/pasture systems do not appear to be properly managing the hay crop in the waste application fields. This letter is to highlight some concerns and provide some general guidance for the animal facilities regarding the management of the storage pond/lagoon and waste application fields. For more specific/detailed information, please contact your technical specialist or your local agricultural extension service. Be advised that should a farm be found violating its farm plan and/or have an unpermitted discharge, besides facing civil penalties, the facility could be required to apply for an individual permit. Currently, most farms are operating under a general permit. t•• mAe applicati2ns Just as you manage the animals at your facility, proper management of the waste (lagoon/storage pond level) is important. The waste must be pumped from the ponds at the correct time and provide for maximum utilization of the nutrients by the crop. Remember, waste application rates in your farm plan are based on agronomic principles, and assumes the waste will be applied when the nutrients are required (e.g., applying waste to corn at tasseling or bermuda grass in November is of little use for the uptake of nitrogen). Also, the established application rate assumes that the previous crop has been removed from the field. To maximize nutrient uptake, as indicated in the waste utilization plan, and for highest quality, the crop should be harvested at early boot stage (generally every 4 to 5 weeks). Small gain for silage can be harvested in the soft dough stage when direct cut. Contact your agricultural extension agent or technical specialist for proper guidance. eneral Recommendations f r Nitrogen A lication for Common Crops: • Small Grains: One-third (1/3) N at planting and remainder in late February or early March. • Corn/Sorghum: For facilities that pump and haul, N should be applied prior to planting. For those facilities that irrigate, a split application with half at planting and the remainder when the corn is 18 inches high. • Fescue/Orchardgrass: Apply one-half (1/2) of the N in mid -February to March and one- half (1/2) in mid -August to September. • Bermuda grass: Establishing: 30 to 40 lbs N/ac at planting and 30 to 601bs N/ac when runners appear (6 -8 wk. after planting). Maintaining: 50 to 60 lbs N/ac in April and the remainder of the recommended amount in equal increments in June and July or after each cutting. Finally, there have been instances where the amount of waste pumped (as shown in the waste application records) from the lagoon/storage pond does not appear to agree with the amount of waste produced by the animals. One would expect on an annual basis that the amount pumped would be approximately equal to the amount being produced. For example, if a dairy is generating 453,000 gaE/yr in waste, then approximately 453,000 gallons of waste should be accounted for in the waste application records over a year. However, there may be some difference due to how low the storage pond was pumped, the number of cows being held in the facility, or the amount of rainfall. Soil analysis (FREE) Fifteen to twenty (15 to 20) soil samples per field (20 acres or less) is desirable. The samples should be thoroughly mixed and sent in as one sample. Each sample should be pulled 4 inches deep for pastures and no -till systems and 8 inches deep for conventional tillage systems. Taking samples during the fall is advisable_ The state lab is not as busy at that time and can provide a more timely twin around with the results. This is also a good time to apply lime if recommended by the soil test. When liming is necessary, it is important that it be applied as suggested. Maintaining proper soil pH is as important (if not more so) than fertilizing to maximize crop production. Page 3 Waste sam s anal sis ($4/sample) The state lab now has the capability to conduct analyses and provide the results within two working days via the internet. Through the US Postal service allow seven days. Take samples in a timely manner such that waste application rates can be based on the most recent sample results. Six to eight (6 to 8) samples should be taken around the edge of the Iagoon/storage pond, approximately 6 feet from the edge and 12 inches below the surface. These can be mixed to make one sample. The sample should be refrigerated if it is not going to be shipped the same day. Always mail waste samples in plastic containers. For farmers who do not have to agitate the lagoon/storage pond prior to application, it is strongly suggested that waste samples be taken prior to waste application. This will'prevent the producer from having to go back and complete the waste application record at a later date. For farmers who apply waste to hay fields and pastures, it is strongly suggested that waste samples be taken quarterly if the waste is applied anytime during the growing season. We have been out of town a lot lately as we have had close family members in the hospital out of town. We are fencing the lagoon areas and preparing to have total removal of shrubs and briars from the lagoon dams so as to only have grass covering them. I am also preparing to empty or substantially lower the levels in the lagoons this fall. Based on the observations made during the inspection, this report is being issued as a Notice of Violation (NOV) due to failing to maintain your lagoons. Specifically, Mr. Johnson observed various shrubs, briars, and tree saplings on the lagoon embankments. The excessive growth on the lagoons prevent the proper inspection of the structure. Also, the liquid level in the main lagoon was less than the 18 inches required by your farm plan for structural freeboard and a 25-yr/24-hr storm event. In light of your deemed permitted status, the noted problems are a violation of North Carolina General Statute 143-215.1 (a) and Administrative Code Section 15A NCAC 2H .0217. It is requested that a written response be submitted to this office by September 5, 1998, indicating the action taken to address the noted violations. In responding, please address your comments to the attention of Mr. Johnson. Be advised, a follow up inspection may be performed. For technical assistance please contact your local Soil and Water District representative. It was observed that a small amount of seepage was discharging from a plugged pipe in the lagoon adjacent to the buildings. This needs to be addressed by the technician developing your farm plan. The trees and shrubs on the sides of the lagoons also need to be cut. You should expect another operation review within the next month or two to be performed by the Division of Soil and Water. The shrubs and overgrowth should be cut prior to this review so that a proper inspection can be performed. Any further correspondence related to the subject inspection will be sent under separate cover. Also, please be advised that North Carolina General Statutes provide for penalties of up to $10,000 per day per violation as well as criminal penalties for violations of state environmental laws and regulations. The volume of wastewater which entered a nearby stream could not be determined; however, no environmental damage was noted. Mr. Porter's employee was advised to maintain a lower water level in the first lagoon to avoid overflows. Porter, swine operation, is hereby designated a concentrated animal feeding operation in accordance with Title 15A, North Carolina Administrative Code 2H .0123, and adopted Federal Regulations 40 CFR 122.23. The designation of your swine operation was based on inspections conducted on December 9, 1992 and March 19, 1993 by members of the staff of the Mooresville Regional Office. These inspections showed that you had established a concentrated animal feeding operation requiring such designation based upon the following facts: 1. Swine waste and wastewater is discharged into an unnamed tributary to Crooked Creek which is Class C waters of the State of North Carolina. 2. Porter Page Two 3. A discharge occurs through a waste storage lagoon which is not permitted or designed for such purposes. A National Pollutant Discharge Elimination System (NPDES) Permit is required for discharges of waste to the surface waters of the state. However, if you can permanently eliminate the discharge by implementing changes within sixty (60) days of your receipt of this notice, including, but not limited to, modifications to lagoons and the implementation of a final waste disposal plan, a permit application will not be required. If compliance has been achieved, you must notify us in writing within sixty (60)• days describing, in detail, the changes or modifications you made. If the discharge of waste to the surface waters of the State is not permanently eliminated within sixty '(60) days of receipt of this notice, an�"PDES permit application must be submitted within that time. Permit applications should be submitted, in triplicate, to the Director, Division of Environmental Management, P.O. Box 29535, Raleigh, NC 27626-0535. Approximately 7 poultry producers and 3 swine operations are within a 1 mile radius. Proximity of Facility to Neighboring Houses, Wells, etc.: None within 1,000 feet. Owners residence approximately 1,200 feet. Approximate Depth of Groundwater Table in the Area of the Facility or Discharge: Estimated at 25 to 30 feet. Proximity of Facility to Surface Waters (provide name and class of surface waters): Waste storage lagoons are located 100 to 150 feet from an unnamed tributary to Crooked Creek, Class C. waters. Are Pollutants Discharged into the Waters of the State? if so, How? (directly or by man-made ditch, flushing system, or other similar man-made device): Wastewater was observed overflowing the earthen berm of the Number one wastewater storage lagoon. The overflow entered an unnamed tributary which was approximately 100 feet downhill. Do or Have Discharges Occurred in Response to Storm Event of Less than 25-Year, 24-Hour Intensity? (If yes, include a brief listing of incidents and suspected causes.): Yes. Evidence of a discharge (pools of wastewater and accumulated solids) from the Number one lagoon (#1-L.) was documented by this Office on December 9, 1992. Another discharge occurred from the same lagoon on March 19, 1993. No 25-year, 24-hour intensity storm event, which is 6.2 inches for union County, was reported in the area. The first discharge was reportedly due to a broken pump (pump is used to move wastewater from Number one lagoon to Number Two lagoon). The second discharge occurred when the manager failed to turn on the pump. Approximately 3 days prior to the discharge the area received 2 to 4 inches of rainfall. Type of Waste Management (Examples: type of confinement -free stall barns, sheltered or limited shelter dirt lots, paved or dirt open lots, swine houses, pasture; type of waste handling - direct spreading in solid form, slotted floor with lagoon or pit, single or multi -cell lagoon, aerated lagoon, land application of liquid manure, spray irrigation, contractor disposal, etc.): Two of the three swine houses appear to be constructed of concrete floors with flush water systems. One parlor has a concrete floor with gutters. Manure is flushed from the houses into the Number One waste storage lagoon (.25 to .5 acre surface area). Wastewater is pumped from Number One lagoon into Number Two lagoon (1.5 to 2 acres surface area). Number Two lagoon wastewater is pumped into a small holding pit (approx. 400 square feet surface area) and is used to fill the flush tanks of each house. Once each day, flush tank water flushes manure into the Number One lagoon for recycling. Condition of Waste Management Facility (rate as poor -good, no discharge, sufficient freeboard in lagoon, etc. Include weather conditions during inspection): The condition of the facility was fair. The condition of the Number One lagoon was rated poor; it appeared to contained excessive solids, had no freeboard and was discharging wastewater into the adjacent stream. Animal Waste Discharge (including photos and witness's names, addresses, telephone numbers and statements of fact): Joseph Crabb (Inspector- Division of Environmental Management, Mooresville Regional Office) observed an overflow discharge from the Number One lagoon on March 17, 1993. Downstream sampling CC resulted in a 26,000/100 ml Fecal Coliform (FC) count and Dissolved Oxygen (Do) concentration of 9.4 ppm; while upstream sampling resulted in 1,200/100 ml FC count and DO concentration of 9.4 ppm. A sample collected directly from the discharge produced a FC count of >600,000/100 ml (see attached results). Water Quality Assessment: (Include description of sampling, field measurements, visual observations and slope and vegetative cover of land adjacent to Water, extent of rainfall and other factors relative to the likelihood or frequency of discharge of animal wastes and process Wastewaters): Visual observations revealed solids accumulations on grass, weeds, and rocks where the overflow was occurring. Due to excessive turbidity upstream and downstream; the receiving stream could not be evaluated. With no freeboard in the Number One lagoon it is likely that an overflow would occur during a minor rainfall event (especially if the pump is not maintained). Recommendations Made to Owner/Operator: Immediately cease the discharge. Maintain adequate freeboard in all lagoons (i.e. installation of automatic level controls, alarms, surface water diversions, etc.). Contact Union County SCS and Extension Agency for waste management recommendations. Porter JREASON FOR VISIT: Overflowing Waste Storage Lagoon COPIES TO: Union County Health Department REPORT: On March 19, 1993, Mr. Joe Crabb of this Office conducted a follow --up investigation of a complaint concerning an overflowing lagoon at Mr. Joseph Porter's swine farm on Lander Benton Road (SR 1531). During the investigation it was found that a waste lagoon was overflowing. The discharge was occurring due to no freeboard in the Number One waste storage lagoon. Mr. Porter's employee turned on the pump which transfers wastewater to the Number Two lagoon. After several minuets of pumping the water level was lowered and the discharge ceased. The volume of wastewater which entered a nearby stream could not be determined. Stream samples collected that day indicate that Fecal Coliform levels exceeded stream standards both upstream and downstream. Water quality violations were not documented. Designation of Concentrated Animal Feeding Operation has. been recommended by this Office. Porter REASON FOR VISIT: Overflowing Waste Storage Lagoon COPIES TO: Union -County Health Department REPORT: On March 19, 1993, Mr. Joe Crabb of this Office conducted a follow-up,investigation of a complaint concerning an overflowing lagoon at.Mr. Joseph Porter's swine farm on Lander Benton Road (SR 1531). During the investigation it was found that a waste lagoon was overflowing. The discharge was occurring due to no.freeboard in the Number One waste storage lagoon. Mr. Porter's employee turned on the pump which transfers wastewater to the Number Two lagoon. After several minuets of pumping the water level was lowered and the discharge ceased. The volume of wastewater which entered a nearby stream could not be determined. Stream samples collected that day indicate that Fecal Coliform levels exceeded stream standards both upstream and downstream. Water quality violations were not documented. Designation of Concentrated Animal Feeding Operation has been recommended by this Office. Recommend enforcement action if non -compliant after sixty (60) days from designation.
