You have our approval, in accordance with the attached conditions and those listed below, to
place fill within or otherwise impact 130 feet of streams, 4,457 square feet (ft?) of Zone 1 and
2,581 square feet (ft2) of Zone 2 protected riparian buffers ~or the purpose of providing access
for Lot 2-8 in the eastern portion of the proposed Haswell Bluff subdivision construction at the
subject property, as described within your application dated June 8, 2005 and received by the
N.C. Division of Water Quality (DWQ) on June 8, 2005. After reviewing your application, we
have decided that the impacts are covered by General Water Quality Certification Number(s)
3404 (GC3404). The Certification(s) allows you to use Nationwide Permit(s) 14 when issued by
the US Army Corps of Engineers (USACE). This letter shall also act as your approved
Authorization Certificate for impacts to the protected riparian buffers per 15A NCAC 2B .0233.
In addition, you should obtain or otherwise comply with any other required federal, state or local
permits before you go ahead with your project including (but not limited to) Erosion and
Sediment Control, Water Supply, Watershed and Non-discharge regulations. Also, this
approval to proceed with your proposed impacts or to conduct impacts to waters as
depicted in your application shall expire upon expiration of the 404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter and
is thereby responsible for complying with all conditions. If total fills for this project (now or in
the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may
be required as described in 15A NCAC 2H .0506 (h). This approval requires you to follow the
conditions listed in the attached certification and any additional conditions listed below.

The Additional Conditions of the Certification are:
1. Impacts Approved
The following impacts are hereby approved as long as all of the other specific and
general conditions of this Certification (or Isolated Wetland Permit) are met. No other
impacts are approved including incidental impacts:

2. Erosion & Sediment Control Practices
Erosion and sediment control practices must be in full compliance with all specifications
governing the proper desigI:l, installation and operation and maintenance of such Best
Management Practices in ofder to protect surface waters standards:
a. The erosion and sediment control measures for; the project must be designed,
installed, operated, and maintained in accordall~e with the most recent version of the
North Carolina Sediment and Erosion Control Planning and Design Manual,
b. The design, installation, operation, and maintenance of the sediment and erosion
control measures must be such that they equal, or exceed, the requirements specified
in the most recent version of the North Carolina Sediment and Erosion Control
Manual, The devices shall be maintained on all construction sites, borrow sites, and
waste pile (spoil) projects, including contractor-owned or leased borrow pits
associated with the project.
c. For borrow pit sites, the erosion and sediment control measures must be designed,
installed, operated, and maintained in accordance with the most recent version of the
North Carolina Surface Mining Manual.
d. The reclamation measures and implementation must comply with the reclamation in
accordance with the requirements of the Sedimentation Pollution Control Act.
3. No Waste, Spoil, Solids, or Fill of Any Kind
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas
beyond the footprint of the impacts depicted in the Pre-Construction Notification. All
construction activities, including the design, installation, operation, ana maintenance of
sediment and erosion control Best Management Practices, shall be performed so that no
violations of state water quality standards, statutes, or rules occur.
4. No Sediment & Erosion Control Measures win Wetlands or Waters
Sediment and erosion control measures shall not be placed in wetlands or waters to the
maximum extent practicable. If placement of sediment and erosion control devices in
wetlands and waters is unavoidable, they shall be removed and the natural grade restored

within six months of the date that the Division of Land Resources has released the
project.
5. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or
applicable Buffer Rules, and any subsequent modifications, the applicant is required to
return the attached certificate of completion to the 401/Wetlands Unit, North Carolina
Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
6. Aquatic Life Passage
Placement of culverts and other structures in waters, streams, and wetlands must be
placed below the elevation of the streambed by one foot for all culverts with a diameter
greater than 48 inches, and 20 percent of the culvert diameter for culverts having a
diameter less than 48 inches, to allow low flow passage of water and aquatic life.
Design and pl~,s~ment of culverts and other structures including temporary erosion
control measures shall nof.;be conducted in a manner that may result in dis-equilibrium
of wetlands or streambeds or banks, adjacent to pr upstream and down stream of the
above structures. The applicant is required to provide evidence that the equilibrium
shall be maintained if requested in writing by DWQ.
7. Diffuse Flow
All constructed stormwater conveyance outlets shall be directed and maintained as
diffuse flow at non-erosive velocities through the protected stream buffers such that it
will not re-concentrate before discharging into a stream as identified within 15A NCAC
2B .0233 (5). Ifthis is not possible, it may be necessary to provide stormwater facilities
that are considered to remove nitrogen. This may require additional approval from this
Office.
8. Deed Restriction
Deed notifications or similar mechanisms shall be placed on all retained jurisdictional
wetlands, waters and protective buffers in order to assure compliance for future wetland,
water and buffer impact. These mechanisms shall be put in place prior to impacting any
wetlands, waters and/or buffers approved for impact under this Certification Approval
and Authorization Certificate. A sample deed notification can be downloaded from the
401/Wetlands Unit web site at http://h2o.enr.state.nc.us/ncwetlands. The text of the
sample deed notification may be modified as appropriate to suit to this project.
Violations of any condition herein set forth may result in revocation of this Certification and may
result in criminal and/or civil penalties. The authorization to proceed with your proposed
impacts or to conduct impacts to waters as depicted in your application and as authorized by this
Certification, shall expire upon expiration of the 404 or CAMA Permit.
If you do not accept any of the conditions of this Certification (associated with the approved
wetland or stream impacts), you may ask for an adjudicatory hearing. You must act within 60

days of the date that you receive this letter. To ask for a hearing, send a written petition, which
conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative
Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its
conditions are final and binding unless you ask for a hearing.
Any disputes over determinations regarding this Authorization Certificate (associated with the
approved buffer impacts) shall be referred in writing to the Director for a decision. The
Director's decision is subject to review as provided in Articles 3 and 4 ofG.S. 150B.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean
Water Act and the Neuse riparian buffer protection rule as described within 15A NCAC 2B

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property
boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion,
so long as the property is clearly defined. For administrative and distribution purposes, the
USACE requires infonnation to be submitted on sheets no larger than II by 17-inch format;
however, DWQ may acccpt paperwork of any size. DWQ prefers full-size construction

construction schedules. The applicant requestcd a detailed wetland dclineation prior to site plan
developmcnt. On February 2, 2005, Mrs. Deborah Edwards of the NC-DWQ conducted a site
visit to confinn our detemlination. A copy of Mrs. Edward's buffer confinnation lettcr is
attached. No pennits have been requested for this project prior to this application.

of the construction of a 50' NCDOT right-of-way that will serve the home sites for lots 2-8 in
the proposed Haswell Bluff Subdivision. Typical heavy equipment associated with road
construction will be used for this project. Impacts resulting from the construction of this
drive will consist of 130 linear feet of stream channel (1,083 sq. ft., .025 acres) and 4,457
square feet of zone I Neuse River Riparian Buffer, and 2,581 square feet of zone 2 Neuse
River Riparian Buffer (7,038 total for zone 1 and zone 2).

the propcrty from Woodland Church Road. Bccause the applicant has no choice but to construct
this drive to acccss the proposed lots due to the fact, and because they have minimized impacts
to just one crossings, S&EC believes further compensatory mitigation should not be required by
the USACE.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mItigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 lincar feet of total impacts to perennial
streams.
USACE - In accordance with thc Final Notice of Issuance and Modification of Nationwidc
Pernlits, published in the Fcderal Registcr on January 15, 2002, mitigation will be rcquircd whcn
nccessary to ensure that advcrsc effects to the aquatic environment are minimal. Factors
including sizc and type of proposed impact and function and relativc value of thc impacted
aquatic rcsource will be considcrcd in dctcrmining acccptability of appropriate and practicable
mitigation as proposed. Examplcs of mitigation that may be appropriate and practicable includc,
but are not limitcd to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegctatcd buffers to protcct open watcrs such as streams; and rcplacing losscs of
aquatic rcsource functions and valucs by crcating, rcstoring, cnhancing, or prcscrving similar
functions and valucs, prefcrable in thc samc watershcd.
If mitigation is rcquircd for this project, a copy of the mitigation plan must bc attachcd in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCEEP concurrcnce shall be placcd on hold as incomplete.

On-Site Determination for Applicability to the Neuse River Riparian Area Protection Rules
(15A NCAC 2B .0233)-EXPRESS REVIEW PROGRAM
Dear Ms Sisson:
On February 2,2005, at your requcst I conducted an on-site determination to review one feature
located on the subject property for applicability to the Neuse Buffer Rules (15A NCAC 2B
.0233). The feature is labelcd as "A" on the attached maps initialed by me on February 3, 2005.
The Division of Water Quality (DWQ) has determined that the feature labeled as "A" on
the attached maps is subject to the Neuse Buffer Rule, this feature is subject throughout
property. The two other features identified on these maps were not contested and
therefore remain subject to the Neuse Buffer Rule. These features and their associated
buffers should be identified on any future plans for this property. The owner (or future owners)
should notify the DWQ (and other reIcvant agencies) of this decision in any future
correspondences conccrning this property. This on-site determination shall expire fivc (5) years
from the date of this letter.
Landowners or affected parties that dispute a dctermination made by the DWQ or DeIegatcd
Local Authority that a surface water exists and that it is subject to the buffer rule may request a
determination by the Director. A request for a dctcrmination by the Director shall be referred to
the Director in writing c/o John Dorney, DWQ WetIands/401 Unit, 2321 Crabtree Blvd.,
Raleigh, NC 27604-2260. Individuals that dispute a determination by the DWQ or Delegatcd
Local Authority that "exempts" a surface water from the buffer rule may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. Applicants are
hercby notified that the 60-day statutory appeal time does not start until the affected party
(including downstream and adjacent landowners) is notified of this decision. DWQ recommends
that the applicant conduct this notification in order to bc certain that third party appeals arc made
in a timely manner. To ask for a hearing, send a written petition, which conforms to Chapter
150B of the North Carolina Gcneral Statutes to thc Office of Administrative Hearings, 6714 Mail
Service Center, Raleigh, N.C. 27699-6714. This dctermination is final and binding unless you
ask for a hearing within 60 days.
