The information you provided us indicated that your operation's animal population does not exceed the number set forth by 15A NCAC 2H .0217, and therefore does not require registration for a certified animal waste management plan. Under 15A NCAC 2H .0217, your facility is deemed permitted if waste is properly managed and does not reach the surface waters of the state. Any system determined to have an adverse impact on water quality may be required to obtain a waste management plan or an individual permit. You are reminded that a discharge of wastes to the surface waters of the state will subject you to a civil penalty up to $25,000 per day. Should you decide to increase the number of animals housed at your facility beyond the threshold limits listed below, you will be required to receive approval from the Division of Water Quality prior to stocking animals to that level. The report identifies.nitrate atconcentrations.above 10 mg/l in groundwatenat the site. After reviewing the report, I scheduled asite visit .to Wallace Farms. Based on .my visit, .I suggested that additional monitor wells :be installed .and sampled .at -the site in order to determine the source of .the contamination. On March 29, 2000, I received a report, containing the results of this -additional sampling. Thave attached azopy"of this report for your review. Based on the.analytical results, Phil Thompson, an environmental consultant for Wallace Farms, suggests that the elevated nitrate in the grouridwater is related .to:the former dairy operation and not _the •current -composting operation. His conclusion .is . based -upon the ,distribution of the nitrate with respect to areas of different land use, both former -and current,.at the site. I agree.that the groundwater data collected to -date is consistent with an agricultural source for the nitrate, via leaching'from the former"lagoons".and/or the former -cow ".lounging" areas. As a responsible party for'.the nitrate :contamination, 'Wallace Farms is required .by 15A NCAC 2L .0106(b) -to -"terminate -and control.the discharge:[and] mitigate1azards resulting from -exposure to the pollutants." Responsible parties for .groundwater .contamination related -to .agricultural activities are .not .required .to perform specific .assessment .and corrective .action requirements outlined -in 15A NCAC 2L .0106(c)..Since the pits'bave reportedly been excavated, :the lagoon is -out "of .use and ".the dairy is no longer in operation, :the initial corrective action requirements of .0106(b) appear to have been .met. Existing water supply wells in .the area are potential exposure pathways and -need to be sampled. 1 believe that periodic groundwater monitoring is needed -at -this site. In order to show that the agronomic loading rates for the crops being grown are not being exceeded, you must keep records of all sources of nitrogen that are being added to these sites. This would include nitrogen from all types of animal waste as well as municipal and industrial sludges/residuals, and commercial fertilizers. Beginning ,January 1, 2000, all nitrogen sources applied to land receiving animal waste are required to be kept on the appropriate recordkeeping forms (i.e. 1RR1,11RR2, DRY1, DRY2, DRYS, SLUR1, SLUR2, SLDI, and SLD2) and maintained in the facility records for review. The Division of Water Quality (DWQ) compliance inspectors and Division of Soil and Water operation reviewers will review all recordkeeping during routine inspections. Facilities not documenting all sources of nitrogen application will be subject to an appropriate enforcement action. An excavator is utilized to mix the manure and wood waste. The goal is tb obtain a mix in the 30% to 35% TS range. The mix is then removed and placed .in a dump truck for . r transportation to the composting pad. The mix is placed into windrows. A front end loader is. used to better form the windrows, if required. Cotton mill waste is then placed on top of the windrow with a front end loader. The windrows are periodically turned with a towed turner. Windrows are constructed approximately 12 feet wide at the base and three to five feet high. The temperatures will be measured in each windrow daily until PFRP is achieved. PFRP will be achieved by maintaining temperatures above or equal to 131 °F for 15 days while turning the pile five times during the same period. Vector attraction reduction shall be met by maintaining. pile temperatures above 104°F for 14 days or longer, and the average temperature for that time shall be greater than 113°F. Material will remain in windrows for approximately six to ten weeks during the active composting period. 7.4 - Curing and Storage -cam.. After active composting, material will be stored in a static pile for approximately one month prior to screening. Final curing and storage capacity for approximately 18 months of compost production is available on an open pad. Additionally, approximately four months of storage capacity is provided under a roof. The low concentrations frorh these type of operations are generally accepted to be below any health risk but may cause puisance problems. Johnson SUBJECT: Fast Track (DD) Mr. Arlen Buttke Dairy Operation, Unpermitted Discharge On June 12, 1998 Mr. Samar Bou-Ghazale of this Office, was conducting a wetland inspection at a potential housing development site near the Arlen Buttke diary (john Wallace Sr., property owner) in Mecklenburg County. During his investigation Mr. Bou-Ghazale observed a Iarge amount of animal waste in a ditch that flowed approximately 1000 ft. to a tributary of Clarks Creek. Mr. Alan Johnson of this Office contacted the diary operator as well as Mr. Wallace regarding the problem. On June 16, 1998 Mr. Johnson performed the annual inspection of the diary operation. During the inspection Mr. Johnson located the source of the discharge. Mr. Harold Buttke (dairy representative) informed Mr. Johnson that a bucket had lodged in the clean-out basin below the trench silos and blocked the culvert through which the waste flows to the storage ponds. The clean-out basin overflowed and the waste flowed into the clean water diversion ditch, thus bypassing the storage ponds. At the tirhe:uf the inspection waste was still observed in the clean water diversion ditch however, the overflow from the clean-out basin had been terminated. Mr. Buttke was informed that a grate should be placed over the top of the basin to prevent a reoccurrence. Preston Howard, Jr., Director of the Division of Water Quality (DWQ), make the following: I. FINDINGS OF FACT: A. Mr. Arlen Buttke operates a 1300 head dairy operation in Mecklenburg County, NC. B. The dairy operation was deemed permitted as a nondischarge facility on February 1, 1933 in accordance with 15A NCAC 2H.0217. C. On June 12 and June 16, 1998, DWQ staff observed evidence of a discharge of animal waste from a clean-out basin via a clean water diversion ditch. The discharge entered a tributary of Clarks Creek, which is a Class C water in the Yadkin -Pee Dee River Basin. D. Mr. Buttke did not have a valid permit for the above described discharge. The discharge was not the result of a 25 -yr., 24 -hr. storm event. E. The cost to the State of the enforcement procedures in this matter totaled $298.41. The degree and extent of harm to the natural resources of the State, to the public health, or to private property resulting from the violations: No harm has been documented; however, the discharge of inadequately treated wastewater can be detrimental to aquatic, as well as human life. 2. The duration and gravity of the violations: The duration of the bypass is unknown. However, the discharge was large enough to flow approximately 1000 ft. to the tributary of Clarks Creek. Waste was observed in the creek approximately 1500 ft. downstream. The effect on ground or surface water quality or quantity or on air quality No adverse effect is expected on groundwater quantity or quality or on air quality. Surface water was likely to have':been impacted by the increased levels of fecal coliform bacteria that could present a human health hazard. Untreated wastewater would also increase the oxygen demand in the stream, thus affecting aquatic biota. 4. The cost of rectifying the damage No damage has been documented. 5. The amount of money saved by noncompliance: No money appeared to have been saved by allowing the discharge. 6. Whether the violations were committed willfully or intentionally: There was no indication that the discharge was intentional. 7. The prior record of the violator in complying or failing to comply with programs over which the Environmental Management Commission has regulatory authority: There is no record of any prior enforcement against Mr. Buttke. 8. It is downhill from the trench silos and a direct view is prevented due to an accumulation of soil and concrete debris. However, a grate covering the top of the basin or a routine inspection of the wastewater system may have prevented the incident. 12. WALLACE, SR, Telephone: 704-875-2975 BACKGROUND INFORMATION: This is a 1700 dairy cow operation managed by Arlin Buttke. Mr. Buttke owns the cows and dairy equipment and leases the dairy facilities and land from the Wallace Dairy Farm, John W. Wallace, Sr. owns the land, machinery, composting equipment, and buildings. The Wallace Family operates a composting and bagging facility (Wallace Farm) adjoining the dairy. Wallace Farm currently has a solid waste composting facility permit application pending with the Division of Solid Waste. A draft plan, dated October 1997, for meeting the requirements and set backs for solid waste was submitted by E & A Environmental Consultants, Inc. to the Division of Solid Waste for review and approval. NARRATIVE OF OPERATION: This dairy operation has �- a;ge manure pits for solids on the east side of Eastfield Road (behind the milking parlors) and t�h aP Wa e storage ponds for liquids, surface water runoff, silage runoff, and milkroom flush water on the west side of Eastfield Road (below the silage pits). The milk cows and dry cows are confined to the lot 24 hours per day. The dairy also maintains heifers and replacement cows on pasture. The dairy operates around the clock with 12 milking sessions in each of the two milking parlors. All of the animal solid waste is pushed into one of two pits. These pits are cleaned out on bimonthly schedule by Wallace Farm for use in the composting facility. The surface runoff from the dairy lot, dairy buildings and the milkroom wash water is collected into 2 below ground storage tanks. The solids are allowed to settle out and the liquid is piped'under Eastfield Road and discharges into the upper most waste storage pond. Surface water from around the silage pits as well as any runoff from the silage pits are also collected and piped to the storage ponds. The solids from the below ground storage tanks are periodically removed and piped to the holding pits for use by the Wallace Farm composting facility. The 3 storage ponds are in series. The first pond fills and discharges into the second pond and the second pond fills and discharges into the third pond. There is no discharge from the third pond. The majority of the surface water around the waste storage ponds has been diverted away from these storage ponds. As solids accumulated in the upper ponds, the dairy operation contracts with the composting operation to remove the solids from the ponds. The solids are used by Wallace Farm in the composting operation. The third pond has very little solids present and is used for irrigation and recycled flush water. According to Mr. Buttke, approximately 70,000 gallons of water is recycled daily from the pond by the milking parlors. The water is used to flush the holding pens and the parlors. The water is applied by a solid set irrigation system to the hay field, and it is applied to the pasture with a tractor pulled 4600 gallon liquid manure tank. The solid set system was designed Hughes Supply of Charlotte, NC. WASTE MANAGEMENT: Your animal waste management facility has been designed for a given storage capacity. When the waste reaches the designed level, it must be remove from the holding pits and holding ponds and then managed/applied according to the waste management plans to prevent pollution of surface and/or ground water. The plant nutrients in the animal waste should be used to reduce the amount of commercial fertilizer required for the crops on the fields where the waste is to be applied. This waste utilization plan uses nitrogen as the limiting nutrient. Waste should be analyzed before each application cycle and annual soil tests are encouraged so that all plant nutrients can be.balanced for realistic yields of the crops to be grown. Several factors are important in implementing your waste utilization plan in order to maximize the fertilizer value of the waste and to ensure that it is applied in an environmentally safe manner. Always apply waste based on the needs of the crop to be grown and the nutrient content of the waste. Do not apply more nitrogen than the crop can utilize. Soil types are important as they have different infiltration rates and leach potential. Waste shall not be applied to land eroding at greater than 5 tons per acre per year. Do not apply waste on saturated soils or on land when the surface is frozen. Either of these conditions may result in run off to surface waters. Wind conditions should also be considered to avoid drift and downwind odor problems. To maximize the value of nutrients for crop production, the waste should be applied to a growing crop not more than 30 days prior to planting. The acres needed to apply the animal was is based on typical nutrient content for this type of facility. Acreage requirements may be more or less based on the waste analysis report from your waste management facility. The scheme of your waste management facility is based on the following: Amount of Waste Produced Per 180 days: I. Liquids are applied to hayland by a solid set irrigation system and to pasture by a tractor pulled 4600 gallon liquid manure tank spreader. You should plan time and have appropriate equipment to move and manage the waste in a timely manner. Cooperation between Buttke Dairy Enterprises and Wallace Farm is essential to avoid mismanagement of the animal waste which may cause a discharge. Since the Wallace Farm composting facility will be receiving all animal waste solids from the dairy operation, the solid waste plan for Wallace Farm developed by your engineer and pending approval -from Division of Solid Waste should be followed to manage the manure solids. The liquid waste should follow this plan. This animal waste utilization plan requires a minimum of 34 acres of hay land for animal waste application. The dairy operation has available 53 acres of suitable land for waste application. The pond will be pumped as needed to provide adequate waste storage or as needed for irrigation water on the growing hay crop during the times listed in the chart on the previous page. Soils for the fields used for application of liquid waste include: IrA - Iredell fine sandy loam, 0 to 1 percent slope IrB - Iredell fine sandy loam, 1 to 8 percent slope Recommendations and calculations are based on the NRCS Technical Guide for waste utilization and the current pasture/hayland system. Wastewater must be analyzed within 60 days of application. Yearly soil samples are required on each field receiving animal waste to better utilize the nutrients in the waste with the nutrient needs of the crop. Refer also to specifications guide Exhibit A6 and A7 for additional specifications and recommendations. On June 16, DWQ staff observed animal waste in the ditch. The unnamed tributary of Clarks Creek is Class C waters of the State within the "Yadkin - Pee Dee River Basin. E. Buttke Dairy Enterprises, Inc, had no valid permit for the above-described activity. F. The cost to the State of the enforcement procedures In this matter totaled $248.41. In general, the management of the waste and the setup for handling surface runoff at the facility appeared fine. But as was mentioned, some buffers may be required adjacent to the drainage areas. Because of the uniqueness of your operation, it is suggested that all persons/agencies involved in the operation of your facility be informed of the certification process. Any occurrence with the distribution program which results in the land application of significant amounts of wastes which are abnormal in quantity or characteristic. b. Any failure of the distribution program resulting in a release of material to receiving waters. c. Any time that self-monitoring information indicates that the facility has gone out of* compliance f- compliance with the conditions and limitations of this permit or the parameters on which the system was designed. d. Any process unit failure, due to known or unknown reasons, that render the facility incapable of adequate residual treatment. e. Any spillage or discharge from a vehicle or piping system during transportation of residuals. Persons reporting such occurrences by telephone shall also file a written report in letter form within five (5) days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. _ IV. INSP,ECIMS 1. This log of inspections shall be maintained by the Permittee for a period of five years from the date of the inspection and shall be made available to the Division of 'Water Quality or other permitting authority, upon request. 3 2. Any duly authorized officer, employee, or representative of the Division of Water Quality may, upon presentation of credentials, enter and inspect any property, premises or place ora or related to the treatment site or facility at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records that must be kept under the terms and ' conditions of this permit; and may obtain samples of groundwater, surface water, or leachate. 1. This permit shall become voidable unless the distribution activities are carried out in accordance with the conditions of this permit, the supporting materials, and in the manner approved by this Division. 2. This permit is effective only with respect to the nature and volume of residuals described in the application and other supporting data. 3. This permit is not automatically transferable. In the event that there is a desire for the facilities to change ownersl^.ip or a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 4. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Water Quality in accordance with North Carolina General Statute 143.215.6(a) to 143-215.6(c). 5. The annual administering and compliance fee must be paid by the Permittee within thirty (30) days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15 NCAC 2H .0205 (c)(4). 6. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 7. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension. Upon receipt of the request, the Commission will review the adequacy of the facilities described therein, and if warranted, will extend the permit for such period of time and under such conditions and limitations as it may deem appropriate. 8. As a certified, or soon to be certified, farm your files at a minimum must contain the following information, and need to be available for review during the inspection: Certification forms Site diagram - showing fencing, streams, buffer zones Waste application records/forms Maps of acreage and irrigated fields Waste utilization plan Waste and soil analysis records Emergency action plan and mortality & odor control checklist Regarding waste application records, all information should be recorded. This includes (but is not limited to) the field used, total minutes waste was applied (if required), the amount of waste irrigated/ hauled, the amount of nitrogen applied and the crop nitrogen balance, The crops and fields that are being utilized for waste application must be specified in the certified waste management plan. For those facilities that grow hay, the date when the hay is harvested should be recorded. If you feel the plan does not allow you the flexibility you need, contact a technical specialist to have the farm plan modified. For lagoons/storage ponds, remember that a freeboard of 12 inches plus an additional 5 - 9 inches (depending on location) for a 25 year/24 hour rain event must be maintained from the top of the storage pond/lagoon. If there is an emergency spillway/pipe, then the level must be maintained to compensate for a 25 yr/24 hr storm. A pumping marker must also be installed. An NOV may be issued for the following instances, among others: a) inadequate freeboard, b) inadequate land for waste application, c) application on an unapproved crop/acreage, d) discharge of waste from lagoon/facility, e) excessive vegetation on the sideslopes of a lagoon/pond, or f) other minor deficiencies. Examples of a deficiency would be the waste or soil analysis forms not being up to date or the application records not being filled out properly. Please note, failure to submit the certification form by December 31, 1997, does not exclude you from the responsibility of maintaining your storage pond/lagoon levels and waste application records.
