Subject: U-5852 Benjamin Parkway Jurisdictional Determination Agency Concurrence
The purpose of this memo is to provide an update on the Benjamin Parkway agency concurrence that
occurred on April 25, 2019. Atkins Biologist Ben Cogdell met on site with Mr. David Bailey (USACE), Ms.
April Norton (NCDENR), Bill Barrett (NCDOT) and Jeff Hemphill (NCDOT) at Guilford Hills City Park located
on Pembroke Road between Benjamin Parkway and Surry Drive.
Stream SL (Figure 1), located near Guilford Hills, was reviewed and confirmed by Ms. Norton and Mr. Bailey
as an Intermittent stream. Mr. Bailey and Ms. Norton agreed that no edits would be necessary to the limits of
Stream SL. A topographic crenulation identified by Mr. Bailey with LiDAR data was evaluated approximately
175 feet to the north of Stream SL—Mr. Bailey and Ms. Norton agreed that the feature was ephemeral and
was an artifact of the LiDAR data. Mr. Cogdell then suggested that the group move to review problematic
areas.
Stream SK (Figure 1), located west of Surry Drive and south of Fernwood Drive (running parallel to Benjamin
Parkway) was evaluated —Ms. Norton and Mr. Bailey concurred that the initiation of SK was appropriately
identified and no edits to Stream SK would be necessary. However, Mr. Bailey requested the addition of a
small linear wetland within the roadside ditch immediately upstream of SK due to the presence of hydric soils
(F3 indicator) and sparse wetland vegetation along the fringes of the ditch.
Stream SG (Figure 1), on the east side of Benjamin Parkway was reviewed next. Mr. Bailey and Ms. Norton
agreed that the upstream portion of the feature was correctly identified. However, Mr. Bailey argued that the
lower portion of SG lacked the appropriate "bed and bank" and "Ordinary High Water Mark" necessary to be
represented as shown, and would be better represented as a wetland. The feature contained hydric soils
consistent with the F3 indicator, sparse wetland vegetation, and primary indicators of wetland hydrology.
After some consideration Ms. Norton, agreed that the lower half of SG should be included as a wetland.
A depressional signature was identified by Mr. Bailey with LiDAR data along a utility easement east of
Alderman Drive and west of Benjamin Parkway. Two small wetlands were added along the utility line south
of Stream SJ and west of Stream SA (Figure 1). These features were consistent with the F8 hydric soil
indicator, contained wetland vegetation, and contained standing water.
Mr. Bailey requested to see Pond PA (Figure 1) as the final stop for the site review. Mr. Bailey and Ms.
Norton agreed on the outer limits of the pond as depicted in the Draft Preliminary Jurisdictional
Determination (PJD) package, however Mr. Bailey requested that the vegetated areas be treated as an
emergent wetland and it would be acceptable to digitize the wetland on a current aerial photograph. Mr.
Bailey informed Mr. Hemphill that he would ultimately let NCDOT decide whether to pursue an Approved
Jurisdictional Determination vs. a Preliminary Jurisdictional Determination for this wetland at the time
environmental permitting becomes necessary.
Mr. Cogdell agreed to flag and GPS the requested wetland additions for inclusion in the Draft PJD package
except for the emergent wetland within the stormwater pond as Mr. Hemphill said it would not be necessary

for the purposes of the PJD. Mr. Hemphill requested that USACE Wetland Determination Data Forms and
N.C. Wetland Assessment Method (NC WAM) forms be included in the updated PJD Package.
The updated jurisdictional features for inclusion in the revised PJD Package are depicted in Figure 1 and
labeled as "Agency Additions".
