Review of an application for Ivey Staley Goodman, Naked Creek, Ashe County
Mr. Goodman is requesting a letter of concurrence from the North Carolina Wildlife Resources Commission
(NCWRC) to obtain a -l0-l penllit from the U,S. Anny Corps of Engineers, TIle NCWRC has reviewed information
provided by the applicant, and field biologists on our starr arc familiar with habitat values of the project area. TI~ese
comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.c. -l66 et. seq.) and
the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.c. 661-667d).
TIle proposed project is to pipe 115 linear feet of Naked Creek with lW-ineh CMP and connect the 84-inch CMP to
an existing North Carolina Department of Transportation (NCDOT) culvert. TIlC lot would thcn be backfillcd for a
gravel automobile commercial parking lot. Secondary and cumulative impacts are occurring to jurisdictional waters
in and around the Jefferson and West Jefferson commwlities.
Based on the infonnation provided by the applicant and our infonnation on the range of trout in the project area, '\'e
do not believe this project will cause significant effects to waters supporting trout. However, we are concerned
about fragmented and lost aquatic habitats in the arca as well as cumulative impacts to important headwaters.
Accordingly, we recommend Ulat Ule stream be relocated around Ule perimeter of the property using natural channel
design teclmiques and native riparian plants instead of piping the stream. Relocating the stream should maintain or
enhance existing stream habitats and be cheaper to accomplish. Stonnwater management should be required that
maintains post development hydrographic conditions close to pre development conditions if the stream is piped, A
minimwn twenty-five (25) foot buffer should be provided and pennanently preserved Ulrough deed restrictions if the
stream is relocated.

As noted below, I have copied this document to State Land Quality, Water Quality and Wildlife
Departments as required in the form,
The purpose of installing the 115' section of 84" diameter corrugated metal pipe in Naked Creek is
to provide commercial frontage along the four-lane business US 221 on South Main Street in
Jefferson, NC. The banks of Naked Creek have been maintained with grass through this
residential property. The proposed culvert will tie in to the NCDOT box culvert that runs under the
four-lane US 221. The culvert will terminate short of the two 24" diameter corrugated metal pipes
that feed into Naked Creek on the property.

Attach a vicinity mall clearly sho\ving the location of the property with respect to local
landmarks such as to\\TIS, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding propcrties. Both the vicinity map
and site plan must include a scale and north arrow. The spccific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survcy with the property

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide

The purpose of installing the 115' section of 84" diameter corrugated metal pipe in Naked Creek is
to provide commercial frontage along the four-lane business US 221 on South Main Street in
Jefferson, NC, The banks of Naked Creek have been maintained with grass through this
residential property. The proposed culvert will tie in to the NCDOT box culvert that runs under the
four-lane US 221. The culvert will tenninate short of the two 24" diameter corrugated metal pipes
that feed into Naked Creek on the property,

Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
