The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other
suitable materials approved by department personnel. No excavation or other land disturbing activities
is permitted except for that which shall be required for the construction of the bulkhead wall, riprap,
deadmen cables, etc. This permit does not authorize any excavation waterward of the approved
alignment without permit modification.

5) The backfill material shall be clean and free of any pollutants except in trace quantities.

This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public

The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. .
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.

Dear Mr. Whitehurst:
You have our approval, in accordance with the attached conditions, to place fill material within or
otherwise impact 0.089 acres of waters to construct a bulkhead and pier, as described in your application
received by the Division of Water Quality (DWQ) Wetlands/401 Unit on June 1,2005. After reviewing

your application, we have determined that the Division ofWate~ Quality (DWQ) General Water Quality
Certification Number 3400 covers these water impacts. This Cenification allows you to General Permit
No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition, you should get
or otherwise comply with any other federal, state and local requirements before you go ahead with your
project including (but not limited to) erosion and sediment control regulations and CAMA. Also, this
approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in
your application shall expire upon expiration of the 404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application, If the property is sold,
the new owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions. If total fills for this project (now or in the future) exceed one acre of
wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A
NCAC 2H .0506 (h). This approval requires you to follow the conditions listed in the attached
certification and any additional conditions listed below.
The Additional Conditions of the Certification are:

2. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality,
1650 Mail Service Center, Raleigh, NC, 27699-1650.
3. Water Quality Certification
The proposed project must comply with all of the conditions of General Water Quality
Certification (GC) 3400. '
Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon
expiration of the 404 or CAMA Permit.
If you do not accept any of the conditions of this Certification (associated with the approved water
impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you
receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the
North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, N.C. 27699-6714. This certification and its conditions\are final and binding unless you ask for a
hearing. \

Proiect setting
The project site is located off SR 1344 at Newberry Landing on the south side of the
Albemarle Sound near Roper in Washington County, North Carolina. The site is a .5-acre residential
lot. Historically, there has been a bulkhead at the project site, but it has virtually been destroyed by
natural elements. Since the time the bulkhead was damaged the shoreline has experienced severe
erosion. The average erosion escarpment is :1:19' landward of the previous bulkhead.
Man-made features on the lot consist of a house, remnants of a bulkhead and pier. The lot is
mostly vegetated with lawn grasses, ornamental shrubs, loblolly pines and various hardwoods, Both
adjacent properties on the downstream (east) side and upstream (west) side are developed lots. A
residence and bulkheaded shoreline are located on both properties. The project site is approximately
4 feet above normal water level.
The Albemarle Sound is classified as SB by the Environmental Management Conunission at
the project site. The Albemarle Sound is Coastal waters and is not open to shell fishing.
Proiect description
The applicant proposes to bulkhead and backfill :1: 171 ' of shoreline on the same alignment as
the upstream and downstream bulkheads. This aligrunent will place the bulkhead on average :1: 19'
waterward and a maximum distance of :1:26' wuterward of the normal water level. The applicant also
proposes to construct a =6' by :1:48' pier with 2-:1:3' by =16' step-down platforms with a :I: 16' by:l: 16'
T -head platform at the terminal end of the pier. Also proposed is a single pile supported jet ski lift,
which is to be located adjacent the bulkhead.
Anticipated impacts
The construction of the bulkhead and installation of backfill as proposed will result in the
filling of approximately 3,250 ft2 of sound bottom. The construction of the pier, finger piers, and
platforms will result in the shading of :l:640ft2 of sound bottom. The project will result in localized
turbidity as a result of the construction of the bulkhead and pier structures.

THE PURPOSE OF THIS PROJECT IS TO REPLACE AN EXISTING BULKHEAD AND
PIER. THIS PROPERTY HAS EXPERCIENCED SEVERE HURICANE DAMAGE AND
MOST RECENTLY WINDS MEASURED AT 70 MPH. CONTUINIOUS HIGH \VINDS ARE
FUTHER ERODING AWAY LAND IN THE BACK YARD. THE AJOINING PROPERTY
OWNERS ARE EXPERIENCING DAMAGE NOW TO THEIR BULKHEADS,
THE PROPOSED BULKHEAD WOULD TIE-IN TO MY NEIGHBORS BULKHEADS, THUS
SAVING THE REPLACEMENT OF MORE BULKHEAD AND SAND OR SOIL BY THEM.
THE BULKHEAD WILL BE BUILT USING 6 X 6 POST X 12' LONG AND (2) 4 X 6
STRINGERS. THE STRINGERS WILL BE 2' APART FOR THE LENGTH OF THE BULKHEAD.
TWO COATS OF 1 X 8 ROUGH BOARDS X 10' LONG WITH A 2 X 12 CAP BOARD. THE POST
WILL BE EVERY 4' APART, BOLTED WND TIED BACK AT EVERY POST WITH 3/8"
GAL V ANIZED CABLE TO A 4 X 6 DEADMAN POST, THERE WILL BE A 7' WIDE FILTER CLOTH
BEHIND THE BULKHEAD. ALL LUMBER EXCEPT FOR THE 2 X 12 WILL BE 2.5 TREADED.
THE 2 X 12 WILL BE ABOVE GROUND TREADED.
THE PIER WILL BE 5'7" X 48', PLUS A 16' X 16' PLATFORM AND (2) 3' X 16' STEPDOWNS.
MATERIAL WILL BE 6 X 6 PILING X 16' AND 2 X 8 STRINGERS AND DECKING. EVERY PILING
DOUBLE BOLTED.
WHITE SAND WILL BE USED TO BACKFILL AND STABILIZE AFTER THE BULKHEAD IS
BUILT.
