Impact Justification and Mitigation Qj� 1. Avoidance and Minimization Ia. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: S&EC completed a wetland delineation and Neuse River Buffer evaluation for the entire property in order to identify natural resources so that impacts could be avoided & minimized to the mabmum extent practicable. Proposed impacts include one (1) road crossing and one (1) sanitary sewer connection. Impact 1 is a proposed road crossing necessary for access to the property from Brooks Cross Drive. Proposed impacts include permanent and temporary intermittent stream impacts, permanent and temporary wetland impacts, and riparian buffer impacts. Additionally, permanent, no permanent stream impacts have been quantified for the riprap dissipaters needed at the inlet and the outlet of the stream crossing. The stream crossing is necessary for access to the new development, the eAsting driveway does not meet the Town of Cary standards for a subdivision road design. Stream, wetland and riparian buffer impacts have been minimized by utilizing head walls and retaining walls, and by utilizing the existing culvert crossing location. Impact 2 is a proposed sanitary sewer connection to an existing manhole. This impact is requesting riparian buffer impacts only and has avoided wetlands and streams. This connection has been designed at a near perpendicular angle to minimize riparian buffer impacts. Temporary wetland impact will be brought back to pre -construction contours and allowed to re -vegetate with adjacent seed source. Temporary stream impacts will be brought back to pre -construction stream bed elevations and the stream banks will be stabilized. 1 b. The Chandler Cove project is a residential development. Additionally, the project is located within the Town of Cary jurisdiction, therefore the adjacent properties that have potential for development will have the following regulations to protect downstream waters: 1) the Neuse River Basin Riparian Buffer Protection regulations, these regulations require limited development within the riparian buffer area, in addition to "diffuse flow' requirements and could require Best Management Practices that control nitrogen if diffuse flow cannot be achieved; 2) the Phase II NPDES Stormwater Permit Program, this program includes permitting requirements for Municipal Separate Storm Sewer Systems (MS4s) in addition to post -construction stormwater management requirements.
