And to clarify the purpose of my previous line of questioning, I wanted to make sure that the change would not result in the filling of any areas under the house that fall below mean high water, thus raising them above high water and potentially converting title to the state in accordance with NCGS 146-6. Additionally, under our policies in 15A NCAC 07M .0202 (d)- if there is any state involvement (through funding or sponsorship) in a beach nourishment project, the entire restored portion of the beach is to become under public ownership. We just want to be sure there weren't any unintended ownership/title complications resulting from the modification... With that said, can you also please confirm that the Town has easements/authorizations in place with Cherry Inc for any work that would fall within the limits of their remaining property? I confirm that no sand will be placed or pushed under the Cherry Inc house, and a 10 -ft buffer will be left around that house. GLDD will use dozers to push the nourishment sand from the immediate adjacent areas without changing the overall integrity of the completed sections. No sand will be placed under the house, and no state or federal funds will be involved. Yvonne said you May have a window between 12 and 1 this afternoon.
