APPROVAL of 401 Water Quality Certification with Additional Conditions
Dear Mr. Brinkley:
You have our approval, in accordance with the attached conditions, to dredge 110.3 acres of creek bottom in order
to conduct maintenance excavation on channelized portions of Ahoskie Creek upstream of US 13 in Hertford County, as
described in your application received by the Division of Water Quality on April 5, 2004. After reviewing your application, we
have,determined that this fill is covered by General Water Quality Certification Number 3400, which can be downloaded
from our web site at http://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use your CAMA Permit when
issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits
before you go ahead with your project including (but riot limited to) Sediment and Erosion Control, Non-Discharge, Water
Supply Watershed, Coastal Stormwater and U.S. Coast Guard regulations. Also this approval will expire when the
accompanying CAMA Permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us in writing and you may be required to send us anew application for a new certification. If the
property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for
complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory
mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the
conditions listed in the attached certification and the additional conditions listed below:
1. You are required to return the attached Certification of Completion form to notify DWQ when all work included in
the 401 Certification has been completed;
2. Erosion and sediment control practices must be in full compliance with all specifications governing the proper
design, installation and operation and maintenance of such Best Management Practices in order to protect
surface waters standards:
a. The erosion and sediment control measures for the project must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control
Planning and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be
such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina
Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow
sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the
project.
c. I For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and
' maintained in accordance with the most recent version of the North Carolina Surface Mining Manual.
d. ! The reclamation measures and implementation must comply with the reclamation in accordance with the
requirements of the Sedimentation Pollution Control Act.
3. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of
the impacts depicted in the Preconstruction Notice Application. All construction activities, including the design,
installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be
performed so that no violations of state water quality standards, statutes, or rules occur;.

4. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent
practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they
shall be removed and the natural grade restored within six months of the date that the Division of Land
Resources has released the project;
5. Sediment and erosion control measures shall adhere to the design standards for sensitive watersheds [15A
NCAC 4B .0024]; see NCDOT publication, Best Management Practices for the Protection of Surface Waters
(March 1997);
6. Silt fences must be maintained throughout construction and until revegetation has stabilized the banks.
7. No dredge spoil shall be placed in wetlands adjacent to the canal.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh,
N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing.

Project Setting
The project area is located on the channelized waters of Ahoskie Creek from the
US Highway 13 bridge, south of Ahoskie, upstream to the bridge crossing on SR 1118
near the community of Mintons Store in Hertford County. The project area includes 13
miles of channelized creek that mainly traverses through wooded wetlands, pine
plantations and agricultural fields. The entire Ahoskie Creek project begins at the old
Seaboard Coastline Railroad bed located 3 miles west of the intersection of Bertie,
Hertford and Northampton Counties and continues to US Highway 13 south of Ahoskie.
The Division of Coastal Management jurisdiction begins at SR 1118 near the Mintons
Store community and proceeds downstream. The channelized Creek at this point is f 20
feet wide with a well defined access corridor and existing spoil area on the north side of
the Creek. Wooded wetlands exist in this area of the project. As the project progresses
downstream it crosses SR 1112. At this point the Creek has the same features as the SR
1118 crossing. The Creek is shallow and water velocities are routinely swift. Between SR
1112 and US Highway 11 the Creek starts to widen, t40 feet, sand bars, deep runs and
pools are evident and the access corridor is well maintained. Spoil from previous
maintenance activities is stockpiled on the north side of the Creek and access corridor.
Pine plantations are located on the Southern side of the Creek with wooded wetlands
located to the North. Other semblances of naturalization such as blockages from fallen
trees and beaver dams are located throughout the Creek. Continuing downstream to SR
1108 the Creek flows through wooded wetlands and agricultural fields. The access
corridor and spoil berm are still present. Within the confines of the cut bank /
channelization sand bars, deep runs and pools give the Creek a more naturalized
appearance. Between SR 1108 and NC Highway 42 the creek passes within the City
limits of Ahoskie. There is a USGS stream monitoring station at this crossing. The Creek
widens to f 50 feet and also starts to get deeper in this area. The sand bars become more
elongated and defined. The active access corridor also increases in width to t 70 feet.
The top of cut bank / ground elevation on the North side of the Creek is t 15 feet above
normal water flow conditions. The spoil pile in this area is significant, t 15 feet in height
above ground elevation. The elevation of wooded wetlands on the southern side of the
Creek is f 8 feet above normal flow conditions. These conditions exist until you get
approximately .5 mile downstream of SR 1101. The access corridor at this point has not
been routinely maintained for vehicular access. The spoil area is approximately 50 feet
wide. Between SR 1101 and US Highway 13 the topographic elevation drops drastically.
Wooded wetlands are located on both the Northern and Southern side of the Creek from
this point to US Highway 13. A spoil berm is still evident in wooded wetland along this
corridor of the Creek. The elevation of the spoil berm in the last 500 feet of the project
ranges from 18 inches to 2.0 feet above the Creek level and adjacent wetlands. The Creek
width increases to approximately 70 feet. The relic spoil berm in this area is f 30 feet
wide. Large Maple and Gum ranging from 12 inches to 14 inches at DBH are located on
the relic spoil berm. Occasional breaks in the spoil berm are evident within the last 500

feet of the project area. Fine sediments cover the leaf litter indicating that the area is
routinely flooded. At the terminal end of the channelized portion of Ahoskie Creek the
water depth of the natural meandering Creek through wooded swamp is - 2.5 feet to - 3.0
feet at normal flow conditions.
Project Description
The project is maintenance excavation of 13 miles of the channelized portion of
Ahoskie Creek. The project will start at US Highway 13 and proceed upstream. The
applicant proposes to remove approximately 2.0 feet of material. Final project depths will
be 6.5 feet below normal water level. The spoil generated from the maintenance
excavation will be placed on the old spoil berm, which will be leveled and seeded.
Erosion control measures will be used if necessary. In addition to the maintenance
excavation, culvert replacements, mowing and spraying of access corridor are also
proposed.
Anticipated Impacts
Approximately 4,804,800 ft2 of channelized Creek will be excavated with 13
miles of Creek bank graded, filled then leveled resulting in f 3,775,200 ft2 of land
disturbance. There will be some short term turbidity in the Creek during the maintenance
excavation. All tendencies of the Creek to revert to meandering flows, runs, and pools,
etc. to the extent possible within the confines of the cut bank channelization will be
removed to more clearly make Ahoskie Creek a ditch.

Please find the attached major CAMA permit application with supporting data and information.
As the project summary indicates, the Bertie Hertford Northampton Drainage District #1 referred to as
Ahoskie Creek is a PL566 Drainage District Project which was constructed between 1962-1964 and has
been maintained as it was constructed since that time.
It has come to the attention of the Watershed Commissioners that the Washington North Carolina
CAMA field office declared that the outlet end of the Ahoskie Creek Watershed project to be navigable
waters in or around 1995.
The enclosed information is intended to supply the necessary information for CAMA to review the
project for the issuance of a CAMA major permit on an existing drainage canal system.
Provided Information:
A. Typical survey cross section data showing the planned silt removal in the main canal of
Ahoskie Creek
This cross section data shows the planned volume of silt to be removed and the locations of
the placement of the spoil (all spoil will be placed on the existing spoil bank and stabilized or
removed by truck).

An easement is held by the Bertie Hertford Northampton Drainage District #1 on the entire
main canal affected by the CAMA determination. This easement gives the Watershed
Commissioners the legal authority to use the easement area as needed to maintain the canal
system All proposed work will be carried out on the easement area.
A table has been attached indicating the easement widths as recorded in the Hertford County
Register of Deeds office.

The scope of the work is to maintain the main canal to its original size. The maintenance access
lane will be maintained on one side of the canal only. Existing inlet pipes will be repaired or replaced as
needed to carry water under the travel lane. The area will be vegetated to eliminate any erosion from the
travelway or canal banks.
The last 2 miles may have a small amount of permanent standing water where as the upper areas
will only contain the depth as necessary to flow the incoming waters which will vary based on the season
and rainfall amounts. The canal will flow out of its banks periodically and at times it will only flow as little
as 6 inches deep.
The watershed project is operating in accordance with the North Carolina Environmental Policy
Act (N.C.G.S. 113A-1 to 10). The project is maintained with funds collected by annual local tax
assessments.

Basic maintenance operations include such items of work as sediment removal, culvert
replacements, mowing and spraying of travelway and canal slopes and bottom.
Sediment removal is. carried out by drag line and hydraulic excavators in a dig and throw
process. The sediment is of a fairly coarse nature and piles well and stays where it is
placed. The travelway is mowed annually. The canal slopes and bottom are sprayed to
control woody vegetation only. Grasses and shrubs are allowed to flourish providing
maximum stabilization. Culverts are replaced as they show signs of failure. This process
is carried out with an excavator. Occasionally a new culvert will be placed in areas
showing a need or requested by adjacent owners. The intent of the above maintenance is
to help the watershed project functioning as it was originally designed and constructed.
There are a few areas which maintenance has been delayed for years due to a lack of
adequate funds. An area such as this exists between highway 350/42 and highway 13
bridge. The spoil bank is present in this area; however trees have grown in the spoil for
several years. Many of these type areas were present in mid-1980 and most of these
areas were dipped out and the travelway reshaped to allow annual maintenance with light
mowing equipment.
Start & End Points
The project starts at US Highway 13 bridge just South of Ahoskie, NC. The area of
CAMA jurisdiction for the CAMA permit process ends at the DOT bridge located on SR
1118 near Tri-County Airport. The actual expanse of the PL566 drainage project
continues westward to the old Seaboard Coastline Railroad bed located 3 miles west of
the intersection of Bertie, Hertford, and Northampton Counties. This can clearly be seen
on the enclosed Ahoskie Creek Watershed Maintenance map.

Spoil areas which are currently piled and were not leveled following the last
sediment removal are now fully vegetated. Future spoil areas will be
leveled following placement and stabilized with seeding. It is not
ant icipated that any special control measures will be needed to manage the
spoil during clean out. The spoil material is fairly coarse in texture and dip
out work is done during extremely low flow. The material has in the past
not moved from where it was place. This will be monitored and addressed
as new dip out work is performed. All necessary measures such as
temporary dikes and silt fences will be used if needed. A seeding
specification guide is provided as part of DCM-MP-2 5A.

The Department of Environment and Natural Resources hereby gives public notice as required by

application, Bertie Hertford Northampton Drainage District #1, applicant, proposes to conduct
maintenance excavation on channelized portion of Ahoskie Creek upstream of US Hwy 13 in
