The Division of Water Resources greatly appreciates DOT notifying us of the violation and taking immediate action to correct the violations of the construction company. With respect to the violations cited, it is ultimately DOT's responsibility (as the responsible party in the 404/401 approval), to make sure that impacts to waters do not exceed those authorized in that approval. We do understand the complexities of this issue and the manner in which the DOT's oversight was subverted.
