It should be noted that all impacts were previously approved (USAGE AID 199603454), however; the permit has expired. In addition, mitigation requirements were satisfied in compliance with the 1991, 1996 and 2000 permits through on-site mitigation as well as through NCEEP (see attached). I have also included correspondence from the USFWS and the. previous permit applications, which should help to clarify the project history. PURPOSE AND NEED STATEMENT The project consists of the construction of roads and subdividing the property for a residential subdivision and golf club. This project is currently in the final stages of construction. No additional wetlands impacts will occur following the completion of this phase. 2. WETLANDS AVOIDANCE AND ALTERNATIVES ANALYSIS In order to avoid wetland impacts, a detailed wetland delineation was conducted prior to site plan development. Due to location of wetlands, it was necessary to impact these wetlands in order to access high ground to connect all portions of the site. Moreover, this impact was approved in a previous submittal, indicating that it met the criteria for avoidance and minimization. 3. IMPACT MINIMIZATION The results of the wetland delineation were considered when developing the site plan to minimize the impact to streams and wetlands. An individual permit was previously issued in 1996 to cover the entire development. A portion of the previously permitted impacts were not constructed. A re-certification of the permit was issued but failed to include all remaining impacts needed to complete construction. 4. PROPOSED IMPACTS Attachment 3 (Agent Authorization Form) and Attachment 4 (Individual Permit Application Form) are included as procedural documents relative to this application. 4.1 Wetland Impacts Lillette Granade conducted a site meeting on November, 26 2002 (Action Id 200300178) to re-verify the delineation. The impacts requested in this application were previously authorized (Action ID 199603454) however, the permit has expired. Impacts in this request total 0.38 acres. 4.2 Stream Impacts No stream impacts are requested in this modification submittal. 5. PUBLIC INTEREST ISSUES In a document provided by the U.S. Corps of Engineers titled "Wetlands & Corps Wetland Regulations" and dated August 13, 2001, the Corps of Engineers lists 21 specific factors that will be reviewed related to Public Interest. These items are as follows: Conservation Water Quality Wetlands Flood Hazard Floodplain Value Land Use Recreation Safety Aesthetics Historic Properties Water Supply Navigation Energy Needs Mineral Needs Economics Fish & Wildlife Values Shore Erosion and Accretion Food & Fiber Production Environmental Concerns Property Ownership Needs and Welfare of the People Responses to each of the 21 Public Interest Issues are presented below. 5.1 Conservation: The remaining wetlands and streams will be preserved through deed restrictions. 5.2 Water Quality: The construction will meet all of the local, State and Federal design requirements with regards to protection of water quality. 5.3 Wetlands: Following construction the remaining wetlands will be preserved through deed restrictions. 5.4 Flood Hazard: The site is located outside of the 100 year floodplain, therefore flooding is not of concern. 5.5 Floodplain Value: The site is located outside the 100-year floodplain, therefore there are no impacts to any existing floodplain areas. 5.6 Land Use: The surrounding land use is primarily residential and includes a golf course. 5.7 Recreation: No public or private recreational facilities will be affected by the development and operation of the facility. 2 5.8 Safety: All entrances to the development along state roads are already installed and meet the standards of the North Carolina Department of Transportation (NCDOT) and Road Access and Driveway Permits have been obtained from NCDOT. In addition to the NCDOT constraints imposed for the sake of safety, there are also constraints on the construction process by state law and the Occupational Safety and Health Administration. 5.9 Aesthetics: Construction of the subdivision will not affect aesthetics of the surrounding area. 5.10 Historic Properties: No historic properties will be affected by the development of the final phases of this subdivision. Moreover, these impacts were previously approved. 5.11 Water Supply: Water supply for the site is derived from the Town of Fayetteville water supply. Development of the site and the resulting water needs will not adversely affect any existing off-site water supplies. 5.12 Navigation: The wetlands proposed to receive fill materials are not located in navigable waters. No impacts to navigation are anticipated as a result of site development. 5.13 Energy Needs: Electrical energy for the development will be supplied by the local network as operated by South River Electric Membership Coop. The development will not generate any of its own power and will not have energy needs in excess of normal residential development. 5.14 Mineral Needs: Neither supply nor demand for mineral resources will be affected by the development of this site. 5.15 Economics: The proposed subdivision and golf club will provide job opportunities for the residents of Fayetteville and the adjacent communities. 3 5.16 Fish & Wildlife Values: The following species have been federally listed as Threatened or Endangered for Cumberland County: Common Name Scientific Name Status Red-cockaded woodpecker Picoides borealis Endangered Rough -Leaf Loosestrife Lysimachia asperulifolia Endangered Michaux's Sumac Rhus michauxii Endangered Southern Spicebush Lindera melissifolia Endangered Saint Francis' Satyr Neonympha mitchellii francisici Endangered American Chaffseed Schwalbea americana Endangered A survey for Red-cockaded woodpeckers was performed by S&EC and it was determined that no active RCW cavity trees were found within the undeveloped portions within the area evaluated. The previously recorded cavity trees within the vicinity of our site did not show signs of recent activity. Given the fact that a large tract of foraging habitat exists on nearby Fort Bragg and based on site observations it is unlikely that the development of these tracts will have a negative impact on populations of RCW populations known to occur in Cumberland County. Moreover, a restrictive covenant has been established within the existing Kings Grant subdivision (see attached). The covenant limits the removal of long-leaf pine and promotes the establishment of potential foraging habitat. No other species on this list were encountered during this survey. 5.17 Shore Erosion & Accretion: This public interest issue is not applicable to this application as the subdivision will not affect shore erosion or accretion. 5.18 Food & Fiber Production: The Sunset Ridge North subdivision will produce neither food nor fiber as part of the facility operations. 5.19 Environmental Concerns: Noise No adverse impacts to noise levels in the area are anticipated from the development of this site 4 Prevention of Contamination All construction activities and resulting infrastructure will be in compliance with applicable environmental laws. No facilities are planned that have a significant risk for production or release of environmental contaminants. Erosion and Sedimentation Construction at the site will be performed under an approved Erosion and Sedimentation Control Plan to minimize sedimentation and erosion in the construction areas. Stormwater will be managed using sedimentation basins and other control devises that will reduce the sediment load in runoff and will attenuate peak flow rates to prevent downstream erosion. Attachment 6 includes specific stormwater details and level spreader worksheets. Air Quality No adverse impacts to local air quality are anticipated as a result of this development. 5.20 Property Ownership: The land upon which Phase D of the King's Grant Subdivision is being constructed is currently owned by the SRW Builders INC, of Fayetteville, NC. 5.21 Needs and Welfare of the People: Providing housing in an area where populations are expected to increase dramatically addresses the needs and welfare of the people. 6. MITIGATION With the issuance of the original individual permit (Action ID 199603454), all mitigation has been previously paid for these impacts. Therefore it is not expected that mitigation will be required for this modification. Please refer to the letters from Charlie Hollis for additional information regarding the project history and the mitigation history. Box 103 Fayetteville, North Carolina 28302 Dear Mr. Rose: This letter follows our visit to discuss the endangered red-cockaded woodpecker at King's Grant in Fayetteville on April 8, 1996. You and I, along with Mr. Ken Graham and Ms. Sandra Allred of U.S. Fish and Wildlife Service, and Mr. Matt Flint and Bill Adams of the U.S. Army Corps of Engineers, visited the permit area under consideration, as well as the golf course and other developed portions of King's Grant. Previous surveys along a proposed highway corridor have identified red-cockaded woodpecker cavity trees in the vicinity of King's Grant, as well as to the north at Pine Forest High School. We visited known cavity trees and evaluated their occupation status as well as habitat conditions around them. At least 2 of the cavity trees (1 cavity tree on the golf course, and 1 just north~of College Lake on McLean-Thompson property) in the cluster at the King's Grant golf course demonstrated recent maintenance of resin wells by red-cockaded woodpeckers. One of the cavity trees at the cluster just north and towards Pine Forest High School demonstrated similar signs of red-cockaded woodpecker activity. The pattern of use by red-cockaded woodpeckers was not clear, there may be other undetected cavity trees housing ared-cockaded woodpecker group in the immediate vicinity, or individuals dispersing from nearby groups may be attempting to re- establish territories at these 2 clusters. More field work could yield a better understanding of the situation. The habitat conditions around most of the cavity trees was typical offire-suppressed Sand_hdlls community types- dense turkey oak proliferation in the midstory- not ideal for red- cockaded woodpeckers. The habitat on the golf course and developed residential areas was open and suitable habitat for red-cockaded woodpeckers. I agree that continued development of the areas proposed will not adversely affect the red- cockaded woodpeckers present, provided that you incorporate certain features and practices into the construction and operation of the development. The~attached pages provide some suggested language to include in restrictive covenants for residential lots, as well as layout features to minimize loss of pine trees. The key points are: - Design lots and roadways to minimize pine tree loss and to maintain pine trees outside of building envelopes on residential lots, - Incorporate measures into restrictive covenants which will limit builder and landowner removal of pine trees, Incorporate landscape requirements which favor longleaf pines, low-growing native ornamentals, and protect existing and future cavity trees on the golf course and residential areas.
