On May 31, 2005, the Wetlands/401 Unit of the Division of Water Quality received a Fax/email request
from Mr. George Chiles regarding a project known as "Garner Residence" for acceptance into the
Express Review Program. To date, DWQ has not received the required application, supporting
documentation, and fees in order to be able to review your project. Furthermore, it was apparent during
subsequent telephone conversations with you and your consultant that the Express Review Program is
not a suitable forum for reviewing this project. The Express Review Program is a process that requires
all parties to participate in a timely manner. Additionally, it, presumes competence on the part of the
applicant and/or their representative either by demonstration`of attendance at an Express Review
training session or through the thoroughness of the material supplied to support a review of the
environmental issues.
At this time, the DWQ feels the Express Review Program is the incorrect review program for your
project. This letter advises you that your project will be considered ineligible for Express Review and
removed from the Program. You must receive Neuse Buffer Authorization and 401 Water Quality
Certification through the regular program. If you have any questions or wish to discuss these matters

residential structure was located and does not encroach into any Neuso Buffers, assuming that DWQ is not
going to claim buffers around the "T° shaped basin. If you are in agreement will you please ccnfirm this in writing.
The local LAMA official with the Craven County Inspections Department requires something in writing from DWQ
to his effect prior to issuing a CAMA Minor.
