Thorpe, Ph.D. ~ < Acting Director Division of Water Quality North Carolina 401 Water Quality Certification This certification is issued in conformity with the requirements of Section 401 Public Laws 92-500 and 95-217 of the United States and subject to the North Carolina Division of Water Quality (DWQ) Regulations in 15 NCAC 2H, Section .0500. It is issued to King's Grant Golf and Country Club resulting in 0.41 in Cumberland County pursuant to an application filed on the 4~ day of August 2001 to complete development at King's Grant Golf and Country Club. This application provides adequate assurance that the discharge of fill material into waters of unknown tributary of Carver's Creek in conjunction with the proposed development will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the state of North Carolina certifies that this activity will not violate the application portions of Section 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application conditions hereinafter set forth. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, or total perennial stream impact exceeds 150 feet, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed below. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion control, Coastal Stormwater, Non-discharge and Water Supply watershed regulations. Appropriate sediment and erosion control practices which equal or exceed those outlined in the most recent version of two manuals, wither the "North Carolina Sediment and Erosion Control Planning and Design Manual" or the "North Carolina Surface Mining Manual" (available from the Division of Land Resources in the DEHNR regional or Central Offices.) The control practices shall be utilized to prevent exceedances of the appropriate turbidity water quality standard (50 NTU's in all fresh water streams and river not designated as trout waters; 25 NTU's in all lakes and reservoirs, and all saltwater classes; and 10 NTUs in trout waters). A sediment curtain shall be utilized at all times until the dredging is completed in order to control tributary. 2. All sediment and erosion control measures placed in wetlands or waters shall be removed and the natural grade restored after the Division of Land Resources has replaced the project; 3. Measures shall be taken to prevent live or fresh concrete from coming into contact with waters of the state until the concrete has hardened; 4. Shall waste or borrow sites be located in wetlands or other waters, compensatory mitigation will be required since it is a direct impact from road construction activities; 5. Deed- notifications or similar mechanisms shall be placed on all remaining jurisdictional wetlands and water s to notify the stat in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 permit (whichever is later). 6. An additional condition is that a final, written stormwater management plan for the site shall be approved in writing by this Office before the impacts specfied in this Certification occur, if the final percent .impervious cover for this project exceeds 30% The stomtwater management plan must include plans -and specifications for stormwater management facilities designed to remove 85% TSS according to the most recent version of the NC DENR Stormwater Best Management Practices Manual. These facilities must be designed to treat the runoff from the entire project, unless otherwise explicitly approved by the Division of Water Quality. We understand that you have chosen to contribute to the Wetlands Restoration Program in order to compensate for these impacts to wetlands andlor streams. In accordance with 15A NCAC 2R .0402, this information will satisfy our compensatory mitigation requirements under 15A NCAC 2H .0506(h). According to 15A NCAC 2H .0506 (h) 0.39 acres of non-riparian wetland restoration will be required. Until the Wetland Restoration Program rec4eives and clears your check (made payable to DENR-Wetlands Restoration Program), wetland stream fill shall not occur. Your certification states that it is based on our application filed on August 4, 2001. please note that our application consisted of my letter to you dated September 12, 2001 which enclosed a copy of our Corps application and transmittal letter dated March 26, 2001 which requested approval for the disturbance of 0.4, ~cl r~r of wetlands. It is Hated that the Corps Public Notice of August 8, 2001 also Used the figure afp,39 acres, but enclosed our plans showing 0,41acres. In my contact with the Corps today, they aclcaiowledged this discrepancy and requested that X write them a letter pointing it out. 'rhe problem apparently arose when the Corps reviewed the plans for the Willlwaad Road extension and used the figure of32p0 square feet (4.p7 acre), of proposed disturbance instead af'4000 square feet (0.09 acre). Please Furnish a letter of arneadment to your Certification. You will scse from the earlier correspondence from Mr. Ron Ferrell of the N.C. VYetlanda Restoration Program that he had approved our 0.41 acres as candidates £ar mitigation under the NC'I~V'RP. Apparently the discrepancy was the use oi' 3200 square feet (0.47 acres) of wetland disturbance far the Williwoad Raad grassing (our sheet 2 aft for Bite Na. 9) instead of 4000 square feet (0,09 acres). i~ur mitigation authorl~ation dam the NCWI~P is for 0.41 acres and Z have requested that the NCDWQ Certification {DWQ Project # 01-0034) bo amended to reflegt the correct aereag® (0.41 acres), Please assure that the Department of the Army Permit authorizes , acres of wetland disturbance as requested. Also, they definitely need to manage stormwater from the Lionshead condominiums.(We're trying to save a creek that is getting hammered already, and this is adjacent to it.) I understand from our conversation today that the previous approval for use of the Nationwide WQC's issued by you in 1996 cannot apply to an Individual Permit. Odom, P.E. of Odom & Associates Engineering, Inc. of Shelby, N.C. This crossing was constructed by Kings Grant Fayetteville, LLC for their project called The Meadowbrook at Kings Grant Apartment Complex. Neither this company nor this project is associated with The King's Grant Club (Sol Rose et al). Note 2: The originally proposed alignment of the west end of Williwood Road would have required construction of two wetland road crossings and one storm sewer (See site numbers 8, 9, and 10 on the 1996 Master Plan). Upon review of this site, it was realized that the Fayetteville Page 1 Public Works Commission (PWC) obtained a Corps permit (ID No. 199800319) and has already constructed a Sanitary Sewer associated with the "College Lakes Outfall" across the same wetland area near our Site No. 9 of the proposed Williwood Road. In an effort to avoid further wetland disturbances in this area, King's Grant Club now wishes to change the route of Williwood Road to coincide with the existing area disturbed by PWC. This change will eliminate the need for a crossing at Site No. 8; and, in an effort to further reduce wetland impacts and conclude the permitting for King's Grant, the storm sewer crossing proposed at Site No.10 will be abandoned. The Ap lication. This application for an individual Corps permit includes descriptions of all of the remaining areas of proposed wetland disturbances for all of the King's Grant property. Those areas are (with reference to the 1996 Master Plan): Site No. 2 Extension of Ridgeway Drive; 6500 SgFt of wetland fill Site No. 3 Lionshead Condominiums; 7245 SgFt of wetland fill Site No. 9 Extension of Williwood Road; 4000 SgFt of wetland fill (previously disturbed) All of this proposed work involves a total wetland disturbance of 17,745 SgFt (0.41 acres). Mitigation. The permit history of King's Grant was detailed in my letters of December 27, 2000 and February 12, 2001 and should be considered in two parts: (1)those activities (avoidance, minimization, and mitigation) covered by the Corps permit Action ID No. 199100098 dated July 20, 1993; and (2) those activities (avoidance, minimization, and mitigation) covered by Corps permit Action ID No. 199600086 dated May 28, 1996. Mitigation for the 1991 permit (ID 199100098) involved: (1) restoration of several areas of previously disturbed wetlands in 12 already-platted residential lots and abandonment of the lots, (2) creation of wetlands by excavation of high ground or by damming water flow in 11 additional areas for a total addition of 4.81 acres of jurisdictional area. The permit was issued for the unmitigated loss of approximately three acres (2.86 acres) of wetlands. Two years later, in 1995, an application was submitted for the next development phase of King's Grant known as Swan Island Court (ID 199600086). The Corps and state decided to hold any action on this request in abeyance until consideration could be given to all of the anticipated cumulative wetland impacts for the overall King's Grant project. Accordingly, a master plan was submitted in January 1996 showing all future proposed wetland impacts for the entire development. With consideration of this plan, and subsequent meetings and agreements, the state issued aproject-wide Water Quality Certification on June 24, 1996 with conditions requiring abandonment of several previously platted lots. With consideration for the master plan, and other agreements as listed below, the Corps issued their permit on May 28, 1996. Keep in mind that the Swan Island Court permit was only for 0.14 acres of wetland loss, whereas the mitigative agreements required prior to issuance of that permit addressed all of the future wetland impacts listed on the master plan. Mitigation for the Corps permit and NCDWQ Water Quality Certificate consisted of (1) trades of sold wetland lots for high ground lots, (2) abandonment of unsold lots platted in wetlands, (3) commitment to endangered species agreements from USFWS, (4) agreement to record wetlands on subdivision plats (although not required by local government), and (5) redesign all of the remainder of King's Grant to remove future lots in wetlands and restrict future construction in wetlands to road or utility crossings. As noted on the enclosed copy of the above-mentioned master plan, the future cumulative impacts, Which were considered prior to the issuance of ID No.1996000086, were anticipated to tota10.92 acres, whereas the final total, with this current request, has been reduced to 0.81 acres (35,630 SgFt). Page 2 I have been involved with the King's Grant project for ten years, coordinating and directing resolutions to wetland issues with JeiTRichter, Scott McLendon, Matt Flint, Mike Taylor, Mike Smith, Ernie Jahnke, and now yourself. It is clearly my understanding and the understanding of Mr. Sol Rose, that the agreements hammered out in late 1995 and early 1996 were a "once-and-for-all" solution to the completion of the King's Grant development. I am confident that if all of the above Corps collective memory were gathered together, our understanding would be consistent. Therefore, it is with that understanding and recognition that the above-listed very generous and very costly mitigation has already been expended that this permit request is submitted. THE SITES ARE LOCATED IN HEADWATERS OF AN UNNAMED TRIBUTARY OF CARVER'S CREEK, WITHIN THE KING'S GRANT GOLF AND COUNTRY CLUB PROPERTY, NORTHEAST FAYETTEVILLE, CUMBERLAND COUNTY, NORTH CAROLINA. The following description of the work is taken from data provided by the applicant and from observations made during a site visit by a representative of the Corps of Engineers. Plans submitted with the application show that the applicant proposes to construct road crossings over wetlands to high ground development areas at two sites, Sites Numbers 2, Ridgeway Drive Extension, and 9, Williwood Road Extension, as shown on the plans. The plans also show that the applicant proposes to construct an additional road crossing over wetlands and to fill several wetland areas for construction of four multi-family residential buildings at Site Number 3, Lionshead Condominiums. According to the applicant, the purpose of the work is to provide access to the three remaining areas of planned development at The King's Grant Golf and Country Club. According to Corps records, there has been a total of 7.4 acres of prior wetland impacts within the development, and 3.5 acres mitigation/restoration, leaving a current net total of 3.9 acres of permitted cumulative impacts for the development. Plans showing the work are included with this public notice. Wetlands that would be affected by the proposed project are palustrine broad-leaved forested wetlands, including hillside seep and streamhead pocosin communities. Wetland soils present at the project sites include Blaney loamy sand, Gilead loamy sand, and Johnston loam. Wetland vegetation at the project sites includes red maple (Acer rubrum), tulip poplar (Liriodendron tulipifera), loblolly pine (Pinus taeda), sweetbay magnolia (Magnolia virginiana), inkberry (Ilex glabra), sweet pepperbush (Clethra alnifolia), switchcane (Arundinaria gigantea), titi (Cyrilla racemiflora~, and laurel-leaved greenbrier (Smilax laurifolia). Current environmental functions of wetlands and waters of the U.S. within the project area include temporary floodwater storage and attenuation, conservation of groundwater discharge, filtration and assimilation of nutrients for downstream waters, erosion control, and diverse wildlife and plant habitat. The applicant has considered avoidance and minimization of impacts to wetlands and waters of the U.S. by limiting proposed work to minimal wetland crossings for access to high ground and minor fills necessary for project construction. Since the overall project development has been substantially completed, and this project proposal is for completion of remaining planned development, there are no alternative sites that would satisfy the applicant's project requirements. The "no action" alternative would prevent the applicant from realizing reasonable return on investment for planned development of the entire tract. The applicant is proposing compensatory mitigation for the unavoidable impacts to 0.39 acre of wetlands. The applicant proposes to pay an in-lieu fee to the North Carolina Wetlands Restoration Program for in-kind compensatory mitigation at a minimum one-to-one acreage ratio. The State of North Carolina will review this public notice to decide the need for the applicant to obtain any required State authorization. No Department of the Army (DA) permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Division of Water Quality (NCDWQ) has decided the applicability of a Water Quality Certificate as required by PL 92-500. This application is being considered pursuant to Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this site is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register is the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data maybe lost or destroyed by work under the requested permit. The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The applicant agreed on May 30, 1996 to initiate aged-Cockaded Woodpecker Management Plan for the entire development according to recommendations of the U.S. Fish and Wildlife Service. The decision, whether to issue a permit, will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts that the proposed activity may have on the public interest requires a careful weighing of all those factors that become relevant in each particular case. The benefits that maybe expected to accrue from the proposal must be balanced against its foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore decided by the outcome of the general balancing process. That decision should reflect the national concern for both protection and use of important resources. All factors that may be relevant to the proposal must be considered including the cumulative effects of it. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (according to Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized would not comply with the Environmental Protection Agency's 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer decides that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to decide whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment (EA) and/or an Environmental Impact Statement (EIS) pursuant to the National Environmental Policy Act (NEPA). Comments are also used to decide the need for a public hearing and to decide the public interest of the proposed activity. Generally, the decision whether to issue this Department of the Army (DA) permit will not be made until the North Carolina Division of Water Quality (NCDWQ) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The NCDWQ considers whether the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the Department of the Army (DA) permit serves as application to the NCDWQ for certification. You suggested several items which would be helpful to you and others who may not be familiar the overall King's Grant project. I am enclosing a 404 permit application and I offer the following information in response to your suggestions: His 1. Corps Action ID # 19900098: The Corps involvement with this project goes back to about 1990 and is replete with numerous meetings and negotiations which resulted in several areas being restored and several permits being granted which included various mitigation features. The initial Corps action was a:Cease & Desist letter dated November 20, 1990 which addressed the disturbance of several areas of wetlands in the absence of the necessary Corps permits. The primary problem for the Developers was that the Fayetteville Public Works Commission (PWC) had previously, without any Corps permit, constructed a regional sewer outfall system right through the heart of the creek and wetlands running through the King's Grant property. Little care was taken by PWC to limit the width of their construction comdor and considerable areas of wetlands were left filled or drained. King's Grant innocently assumed that the PWC work was OK and used some of the filled areas for their project (golf course, etc.). King's Grant rebuilt the dam that had failed at the (now-existing) lake and re-established the lake level into the cypress swamp. In order to resolve the 404 issues, King's Grant removed all unsold wetland lots from their plans and assisted the owners of sold wetland lots with trades for high ground or with wetland permits for minor fills. Remaining wetland fills (some done by PWC and some done by King's Grant) were partially offset by onsite mitigation and then authorized by an after-the-fact permit (Corps Action ID No. 199100098) on July 20, 1993. No mitigation credit was requested or received from the restoration of the Cypress lake. As the final agreements were being reached, King's Grant revised their plans to eliminate additional lots in wetlands and re-arranged their road system to limit future wetland disturbance to only that needed for access to their remaining high ground. The permit authorized disturbance of 18 small wetland areas for a total gross impact of S.b acres, 2.73 acres of which were offset by mitigation, leaving a net wetland loss of 2.87 acres. Five areas, totaling about 2 acres were restored to wetlands. 1 M~. Page 1 Co_pr s Action ID # 199600086 Because of the proximity to Fort Bragg/Pope Air Force Base, the progress of the King's Grant development was significantly affected by the impact of the Desert Storm for several months, delaying the submittal of a new permit application until October 7, 1995 for a road crossing to implement the development of an area named Swan Island Court. At that time, Federal and state agencies called for an overall projection of all future wetland impacts and the approval of a development approach that assured protection of endangered species, specifically the red cockaded woodpecker. Also, at that time, we reviewed the status of lot fills that were either already permitted or had been identified as candidates for future fill. As a result of that review, several lots were abandoned, including some that had already been permitted (lots 70, 71, and 136}, thereby further narrowing the scope of impending wetland disturbance. A plan was prepared and provided in January 1996 to the Corps and state showing all of the future anticipated road crossings and sewer connections. This plan was addressed in my letter of May 9, 1996 and was the basis of an overall Water Quality Certification issued by NCDWQ on June 13, 1996 (DWQ Project # 960469) for the remaining projected impacts across the entire project. This plan was also the basis for previous Corps actions on Shawcroft Road Extension (Corps Action ID Nos. 199603454 and 199603458). And this Plan was the basis for an agreement with the U.S. Fish & Wildlife Service regarding the preservation of habitat for the Red- Cockaded Woodpecker (see Corps file on Action ID 199600086), and King's Grant committed to a continuing process of recording wetland boundaries on final subdivision plats. Description of Work. The Lionshead Condominium project is proposed to be sited on about five acres of high ground near the southern edge of the King's Grant Development. It consists of the construction of four multi-family buildings with access streets and resident parking. 2. Wetland Impacts. A small (Area 1:400 square feet) wetland crossing is necessary to provide access to the tract, within which the access street will impact 3 additional small areas (Area 2: 489 SF, Area 3: 1587 SF, and Area S: 1090 SF). No Buildings will be sited in the wetlands, but the steep terrain requires cut or ftll in four additional small wetland areas (Area 4: 1811 SF, Area 6: 1544 SF, Area 7: 347 SF, Area 8: 65 SF, and Area 9: 2 SF. The total wetland impact across the Lionshead Condominium project is proposed to be 7245 square feet (0.17 Acres). 3. Avoidance. Minimization. and Mitigation. Considerable effort has been expended to avoid wetland loss on this project. The current proposal represents the best of several engineering alternatives whereby the four buildings, the street and the required parking areas have been moved around to result in the least environmentally damaging alternative that can achieve the project requirements. Most of the affected areas are at the upper edges of wetland seeps. Page 2 The approximately five-acre wetland was a part of a small stream run flowing westward toward the larger creek and Rankin Pond to the west and north of the Lionshead Condominium site. In the late 1980's, the Fayetteville PWC dug a by-pass ditch in the high ground adjacent to the northern edge of this wetland in order to install a sewer line through the wetland. This ditch was never closed and has continued to by-pass the stream flow around this-area, thereby starving the system of its needed hydrology. During the development of the 1996 overall plan, representatives of the Corps of Engineers and NCDEM inspected this site and recommended that the stream be reconnected to its ordinal channel. They also recommended that the proposed extension of Shawcroft Road across the main stream leading to Rankin Pond be eliminated. Accordingly, as a part of this project, King's Grant proposes to close and fill the high-ground ditch and re-direct the stream flow back into its original braided wetland channel. This restoration of hydrology to this previously viable five=acre swamp-forest-wetland-will-vastly-offset the minorwetland losses described above and result in considerable net wetland enhancement. Additionally, the storm water from the streets and roofs will be directed into the adjacent swamp wetlands to further restore and enhance their productivity Future Activities. 1. 1996 Overall Plan of Development. King's Grant continues to abide by the overall plan of development required by the Corps and the state and which was submitted to them in January of 1996. This plan was given state approval under WQC # 960469 dated June 13, 1996. A copy of that plan has been redrawn forthis submittat on which I have added a copy of the Legend from the 1996 map. Project numbers 4, 5, and 6 have been previously permitted and are complete (~} & 5 =-COE ID # 199603458; 6 c~. 7 = COE ID # 199b0345s1). This current request for the Lionshead Condominiums is Project number 3 on the legend. You will note that we had estimated a wetland impact of 4500 square feet, whereas the final design resulted in an impact of 7245 square feet. We had not anticipated, however, the generous wetland restoration and enhancement that will be realized by the closing of the old PWC by-pass ditch. 3. Remaining Projects. There are no detail plans yet available for projects Nos. 1, 2, 8,9, and these projects are anticipated to only require small wetland crossings as indicated on The map and result in final insignificant overall wetland impacts for the entire King's Grant :Development. Overall Cumulative Impacts. The King's Grant property encompasses 535 acres of land of which about 50 acres are jurisdictional wetlands. Innocent wetland violations were made in the past and difficult and costly actions were taken to bring this project within compliance of Federal and state regulations that were not in place when the project was commenced. Since then, there is a remaining commitment to fully comply with all local, state, and Federal requirements. The Lionshead Condominium project-falls withinthat commitment and.represents-the next step in-the completion of the overall environmentally responsible development of this large tract. We believe that the final net cumulative wetland impact for this project, considering the restoration of the 20- acre Rankin Pond and now this 5-acre riparian swamp forest, will be significantly positive.
