Dear Mr. Bennett:

You have our approval, in accordance with the attached conditions, to place fill material within or
otherwise impact 0.0267 acrcs of waters to replace existing picr and add two boat lifts, as described in
your application received by the Division of Water Quality (D"\VQ) Wetlands/401 Unit on May 27,2005.
After rcviewing your application, wc have determined that the Division of Water Quality (DWQ) General
Water Quality Certification Number 3400 covers these water impacts. This Certification allows you to
General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). ill addition,
you should get or otherwise comply with any other federal, state and local requirements before you go
ahead with your project including (but not limited to) erosion and sediment control regulations and
CAMA. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters
as depicted in your application shall expire upon expiration of the 404 or CAMA Permit.

This approval is for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions. If total fills for this projcct (now or in the futurc) exceed one acre of
wetland or 150 linear feet of stream, compensatory mitigation may be required as describcd in 15A
NCAC 2H .0506 (h). This approval requires you to follow the conditions listed in the attached
certification and any additional conditions listed below.

Buffcr Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 40l/Wetlands Unit, North Carolina Division of Water Quality,
1650 Mail Service Center, Raleigh, NC, 27699-1650.

3. Water Quality Certification

The proposed project must comply with all of the conditions of General Water Quality
Certification (GC) 3400.

Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon
expiration of the 404 or CAMA Permit.

If you do not accept any of the conditions of this Certification (associated with the approved water
impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you
receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter l50B of the
North Carolina General Statutes to the Office of Administrative Hcarings, 6714 Mail Service Center,
Raleigh, N.C. 27699-6714. This certification and its condition\are final and binding unless you ask for a
hearing. \

8. PROJECT SUMMARY: The applicant is proposing to construct a private pier, gazebo and two boatlifts with
covered boathouses.

9. PROJECT DESCRIPTION:
The subject property is located at 819 Shoreline Drive West (NC Hwy 179), adjacent to the Atlantic
Intracoastal Waterway (AIWW), in the town of Sunset Beach, Brunswick County. To get to the proposed site
from Wilmington, head south on US Hwy 17. At the intersection of US Hwy 17 and NC Hwy 179, turn left
onto NC Hwy 179 towards Sunset Beach. Travel west along NC Hwy 179 (Shoreline Drive) and the property
will be located on the left, approximately 0.20 miles before the intersection of Shoreline Drive and Bonaparte
Road. The property has approximately 110' of shoreline adjacent to the AIWW. Elevation at the property
varies from 5' -9' above Mean Sea Level. Residential properties border the subject site to the north, west and
east, and the AIWW borders the property to the south.

The property consists of approximately 1.1 acres of high ground. Presently, there is a residence, bulkhead and
dilapidated pier located along the southern portion of the tract. High ground vegetation consists of: Live Oaks
(Quercus virginian a), Catbriar (Smilax sp.), Wax myrtles (Myrica cerifera), Long-leaf Pines (Pinus palustris)
and Yaupons (Ilex vomitoria). A section of coastal marsh exists along the southern shoreline (approximately
50' wide by 100' long) and consists primarily of Smooth Cord grass Marsh (Spartina alterniflora) and Black
Needle Rush (Juncus roemarianus). Upper coastal wetlands species such as Salt Grass (Disticlzlis spicata),
interspersed with Sea Lavender (Limoium carolinanum), Salt Meadow Hay (Spartina patens) and Sea Ox-eye
(BorriclliafmteScens) complete the transitional area to the high ground.

The waters of the AIWW, adjacent to the proposed project area, are classified "SA" by the Division of\Vater
Quality. This section of the AIVlW is designated as a Primary Nursery Area by the Division of Marine
Fisheries. According to maps provided by Shellfish Sanitation, the area is CLOSED to the harvesting of
shellfish.

The applicant received a CAMA General Permit (#-40350) on March 10,2005, for the construction ofa pier
(6' x186'), gazebo (16' X 24'), two boatlifts (13' x 13 ') and a 15' x 26' boathouse over the western boatlift.
Since that time, the applicant has decided to apply for a CAMA Major Permit to include the construction of a
second boathouse (15' x 26'), which would be located on the eastern side of the proposed gazebo. Since no
work was ever ihitiated under the CAMA General Permit, the applicant is re-applying for a CAMA Major
Permit to include the proposed activities associated with the initial construction as well as the addition of the
proposed boathouse.

PROPOSED PROJECT: The applicant is proposing to remove the remnants of the previous pier and
construct a new pier, gazebo and two boatlifts with covered boathouses. The proposed pier (6' x 186') would
span in a southerly direction from the center of the property at the intersection of the bulkhead, and would
terminate at the proposed 16' x 24' gazebo. A 16' x 16' section of the "T-Head" gazebo would be covered and
the remaining 8' x 16' would be open. A 13' x 13' boatlift would be constructed on each side of the gazebo
(one on the eastern side and one on the western side). Each boatlift would be covered by a 15' x 26' boathouse.
The pier, gazebo and boathouses/boatlifts would be located on the landward side of the U.S. Army Corp of
Engineers 80' setback line. Water depth measurements average -1.0' to -2.0' at the terminal end of the
docking facility.

10. ANTICIPATED IMPACTS
The construction of the proposed pier and docking system would incorporate approximately 1,164 sq ft of
estuarine waters .and public trust area. Minor increases in turbidity should be expected during construction,
however long term impacts are not anticipated.
