S. Fish and Wildlifc Servicc (Service) on thc subject Public Notice (PN), dated June 16,2005. The applicant, Carolina Marlin Club Association, has applicd for a Departmcnt of the Army (DA) permit to perform maintenance dredging and cxpand an existing spoil disposal arca in association with an cxisting community marina. Thc proposed work is being considcred under Regional Gcneral Permit #198000291, a permit/proccssing agreement for work that has been approvcd pursuant to thc North Carolina Coastal Area Managcment Act (CAMA). These comments are submitted in accordance with the Fish and Wildlife Coordination Act (FWCA) (48 Stat. 401, as amended; 16 U.S.C. 66l-667d). Comments relatcd to thc FWCA arc to be uscd in your determination of compliance with 404(b)( 1) guidelines (40 CFR 230) and in your public interest review (33 CFR 320.4) in relation to the protcction of fish and wildlife resources. Additional comments arc provided regarding thc District Enginecr's determination of project impacts pursuant to section 7 of the Endangered Species Act (ESA) of 1973, as amended (16 U.S.c. 1531-1543). Proposed Activities and Anticipated Impacts Thc project area, proposed work, and anticipated impacts are given in the Field Investigation Report (FIR) of the North Carolina Division of Coastal Managemcnt (NCDCM). The project arca is on the east bank ofthc Newport River and the existing community marina has access to the Atlantic Intracoastal Waterway (AIWW) by way of a maintaincd channcl. Thc applicant proposes to dredge the marina basin, cntrance channel, and access channcl to a depth of six feet below mean low water (ML W). The proposed dredging would remove approximately 4,650 cubic yards of bottom sediment by hydraulic dredging. The pem1it application states that the area to be dredged does not contain submerged aquatic vegetation. Dredging would impact 271,188 square feet (ft\ or approximately 6.2 acres. The Projcctive Narrative states that the material " ~ 2 would be pumped to an existing confined disposal area within the development. However, there is no discussion of the route over which the material would be transported. Federally Protected Species The Service has rcviewed available information on fedcrally-threatened or endangered species known to occur in Carteret County. We have also reviewed information from the North Carolina Natural Heritage Program (NCNHP) database which contains exccllent data on the special status species, both federal and state. This database can be accessed by topographic quadrangle (quad) of the U. S. Geological Survey (USGS). Data from USGS quads provide the most project-specific information on species which should be considered in permitting this project. The project area is located in the Core Creek quad. The occurrence data of special status species within this quad can be obtained on the internet at < httn://www.ncsparks,nct/nhn/quad.html >. Our review indicates that the only federally listed species likely to occur in the project area is the West Indian manatee (TriclzecllUs mal/atlts), a federally-endangercd mammal. The species is known to occur in Carteret County and the NCNHP databasc has a current record for the species in the Core Creek quad. The shallow, estuarine waters ofthc lower Newport River may providc suitable habitat for manatecs that move along the Atlantic Coast during summer months and are seasonal transients in North Carolina, primarily from June through October. Manatees feed in water one to two meters (3.3 -6.6 fect) deep that may support submerged aquatic vcgetation. The species moves extensively when in North Carolina waters and past occurrence records cannot be used to prccisely determine the likelihood that it will be prescnce at a particular construction site. Existing water depths appear to be sufficient for manatec use and thc proposed drcdging may pose a risk to manatees. To protcct manatees in North Carolina, the Servicc developed guidelines entitled "Precautions for Gcncral Construction in Areas Which May Be Used by thc West Indian Manatee in North Carolina." These guidelines address all types of in-water construction, except blasting, and should produce littlc, if any, additional expense. The guidelines are intcnded mainly to ensure that construction personnel are infonned that manatees may occur in the work area, that work should ccase if a manatee approaches the work area, work should not resume until the manatce leaves the work area, and proccdures for reporting the death or injury of a manatee. The risk to manatees could bc reduced to an acceptable level by the implementation of the Service's guidclines. The risk would be further reduced by perforn1ing the work during the pcriod of November through May. With the inclusion of our manatee guidelines, the Service would concur with a determination by the District Engineer that the action is not likely to adversely affect species designated as threatened, endangered, or their designated critical habitat. The Corps' requirements pursuant to section 7 of the ESA would be fulfilled. However, the Corps must reconsider its obligations under section 7 if: (1) new infom1ation reveals , ~ 3 impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered; (2) this action is subsequently modified in a manner which was not considered in this review; or, (3) a new species is listed or critical habitat determined that may be affected by the identified action. Service Concerns and Recommendations The Service has no objections to the proposed maintenance dredging. Our only concern is that a pipelinc used to move the material could be placed on coastal wetlands. Furthermore, spills occurring during sediment movement could bury coastal wetlands. We recommend that the Coordinated Federal Position (CFP) request that the project permit prohibit the placement of any pipelinc in vegetated wetlands and that the project have procedures for detecting and repairing accidental spills as well as plans for removing any spoil accidentally spilled into vegetated wetlands. With prudent measures to protect manatees, measures to detect and rectify sediment spills, and the prohibition of pipeline placement on vegetated wetlands, the Service does not opposc the issuancc of a DA permit for the proposed work. Whcn dewatcring ceases ~ 1 and satisfactory bacteriological water samples are obtained, the waters shall be rcopencd to shcllfishing. * * f Sedimentation and Erosion Control NOTE: An Erosion and Sedimentation Control Plan shall be required for this project. I I I I ~ ;} The West Indian manatee (TricJzecJzus manatlls), which is listed as a federally endangered species, has been reported in thc tidal waters of New Hanover County. In order to protect the \Vest Indian manatee all work should be done during the period from Novcmber 1 to May 31. If work must be done during the period from June through October the enclosed guidelines, entitled "Precautions fro General Construction in Areas Which May Be Used by the West Indian Manatee in North Carolina" shall be followed. This approval allows you to: 1. Maintenance dredge existing access channel to a depth of -6 NLW (1573' X 60'). 2. Maintenance dredge an existing entrance channel to a depth of -6 NLW (200' x 45'). 3. Maintenance dredge an existing marina basin to a depth of -6 NLW (a semi-circular shape of 368' X 456'). 4. Use existing spoil disposal area for dredged material and expand site without impacting any jurisdictional wetlands. This approval is only valid for the purpose and design that you described in your CAMA Major application received by the Division of Water Quality (DWQ) Wilmington regional Office (WiRO) on May 26,2005. After reviewing your application, we have determined that General Water Quality Certification Number 3400 covers this activity. This Certification can also be found on line at: http://h20,enr.state.nc.us/ncwetlands/certs.html.This Certification allows you to use your CAMA Permit when the NC Division of Coastal Management issues it. Please keep in mind that there may be additional Federal, State or Local regulations applicable to your project, such as (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations, NPDES and Coastal Stormwater. NARRATIVE DESCRIPTION: Project Setting The Carolina Marlin Club Assoc., Inc. is located at 409 Island Drive adjacent to the Newport River near Beaufort, Carteret County, North Carolina. The site was developed as an inland basin marina for the lot owners in the adjacent Deerfield Subdivision. The existing channel and basin were originally dredged under CAMA Permit #18 and D & F Permit #210-78 and were later deepened to -6' below NLW under subsequent permits. The channel and basin were last dredged in March and April of 2003 under CAMA Permit 67-88. The existing docks consist of a main "T" dock in the center of the basin with finger piers around the perimeter of the basin for a total of 74 boat slips. There is an existing boat ramp on the east sicie of the basin; The inside of the basin is protected with a wooden bulkhead, while the entrance to the basin is protected with the bulkhead reinforced with riprap. The shoreline in the vicinity of the entrance channel is bordered with Spartina alterniflora that ranges between 15' to 60' in:width and can be found as close as 45' from the entrance channel. The land rises quickly from the water to approximately 6' to 8' above Mean Sea Level. There is a clubhouse, pool and poolhouse, and associated driveways and parking areas currently on the project site. The remaining portion of the site is covered with lawn grass. The Carteret County Land Use Plan categorizes this area of the county as Limited Transition, with all AEC's classified as Conservation. The waters of the Newport River in the vicinity of the projecfare classified as SA High Quality Waters and are open to shellfish harvesting with. the exception of a 100' radius from the entrance of the marina basin. The Newport River is not classified as a primary or secondary Nursery Area by the N.C. Division of Marine Fisheries. The water depths around the channel portion of the project area are typically in the -2' to -3' below NL W range, with the center of the existing channel averaging approximately -5.5' to -6.0' below NLW. The water depth in the existing marina basin averages -6.0' below NL W. The channel and marina bottom consists of fine sand and silt material. No submerged aquatic vegetation was observed in the proposed excavation areas. Project Proposal The applicant proposes maintenance excavation of an existing access channel, entrance channel, and marina basin to a final depth of -6' below NLW using a hydraulic dredge. The area to be excavated within the existing access channel is 1573' in length and 60' in width. The applicant would remove an average of 1.3' of material from the access channel. The applicant has also requested in the application for authorization for future maintenance excavation in the area of the entrance channel located at the mouth of the marina basin and for future maintenance of the marina basin. The entrance channel and marina basin currently do not require any dredging due to the protective structures around them, however, the applicant anticipates in the future that these areas will eventually require maintenance excavation and requests that they be considered in this permit application. The entrance channel is 200' in length and 45' wide with rip rap along each side of the chanrtel. The marina basin is semi-circular in shape and 368' in length and 456' in width. The total volume of the spoil material to be removed for the current project is 4,650 cubic yards for the access channel only. To accommodate the dredge spoils, the applicant FIELD INVESTIGATION REPORT: CAROLINA :MARLIN CLUB ASSOC., INC. PAGE #3 proposes to enlarge an existing spoil disposal area by adding an "L" shaped section to the existing spoil disposal pit and increasing the height of the existing spoil berm to 15' above MSL. The additional section would be 360' in length, 214' in width, and 15' in height which would create a total volume of 31,824 cubic yards for spoil storage. The spoil pit would be dewatered and the dry spoil material removed and hauled offsite for additional storage area when needed for future maintenance dredging operations. The existing and proposed spoil areas would be located entirely on upland areas that include areas classified as isolated non-jurisdictional wetlands which. were created by previous spoil disposal activities. The spoil disposal site is located on the north side of Cupid Drive and approximately 1500' southeast of the marina basin. Anticipated Impacts The hydraulic dredging of the access channel, entrance channel, and boat basin will result in the disturbance of approximately 271,188 sq. ft. of previously dredged channel and marina basin bottom. This will result in 4,650 cubic yards of silt and fine sand spoil being deposited on 171,626 sq. f1. of high ground. The disposal site is located approximately 140' from the closest water body which is an unnamed tributary to the Newport River that is open to shellfishing. The effluent from the dredge spoils will flow into the unnamed tributary to the Newport River as it has done historically for all previous dredging operations at the marina. The dredging operation would therefore continue to withdraw spoils from the closed areas of the basin and entrance channel and would divert the effluent from the spoil disposal area to the unnamed tributary of the Newport River that is open. This will result in the temporary closure of the waters of the unnamed tributary to the Newport River. It is also anticipated that a localized and short-term increase in turbidity will occur in conjunction with the proposed dredging activity. The project can be reached by land by traveling north from Beaufort on N.C. Highway 101, turning left on S,R. 1165, left on Cupid Drive, right on Rudolph Drive, right on Island Drive to the Yacht Club Facility. The applicant proposes to conduct maintenance dredging of the marina basin and the entrance and access channels that connect the marina basin to the Intracoastal Waterway (see sheet 2 of 3). The dredged material will be pumped to an existing confined disposal area located between Cupid Drive and Island Drive. Expansion of the disposal area is included as part of this application. Removal by hydraulic dredging methods of approximately 4,650 cubic yards of material from the access and entrance channel during the dredging window following permit approval and dredging of the entrance and access channels and the marina basin with disposal in the confined disposal area as required over the life of the permit. Expansion of the existing confined disposal area owned by the applicant and constructed under previously issued CAMA permits, The existing confined disposal area has an available volume (by filling 5,5 vertical feet from elev. 7.5' to 13J of 18,320 cubic yards. The expanded disposal area will provide an additional 13, 504 cubic yards by filling the area from elevation 6,0 to 13.0 feet. The total volume available in the existing and expanded disposal area will be 31,824 cubic yards. Additional volume will be made available in the disposal area by excavating the dewatered material and hauling it away. The excavated material will be used for landscape fill or other low quality fill material applications, EXISTING CONDITIONS The channel and marina were originally constructed in approximately 1985 as part of the development of the Deerfield Subdivision. The access channel experiences above average siltation rates because the channel is perpendicular to the flow of sediment and tidal flows along the shoreline of the Newport River. Dredging is the most cost effective and environmentally sensitive means of maintaining the channel.
