Medford: Dee Freeman Secretary The Animal Feeding Operation Unit of Division of Water Quality's Aquifer Protection Section has completed a preliminary review of the subject permit application package submitted to this office on January 29, 2009. The package is currently being returned to you without any action because of the following reasons: 1. No change in animal numbers: It appears that the number of animals specified in the application package remains the same as the current permitted capacity (130 milk cows). If the application was sent to update the nutrient management plan, a copy of it is being forwarded to our Asheville Regional office that gets a copy of any nutrient management plan revisions. No action is necessary from this Central office for such revisions. 2. Change in ownership: If the application is submitted to seek the change in ownership of this facility from Frank D. Medford to Charles F. Medford, then please submit a completed Notification of Change of Ownership of Animal Waste Management Facility (see enclosed) to this office. No other documents are required for such change. Permit Renewal: Your current certificate of coverage is due to expire on September 30, 2009. This office will notify you of the date to apply for a renewal shortly. At that time, you will be required to submit a renewal form along with a copy of your nutrient management plan. Please be sure to include in the future a cover letter with all your permit packages highlighting the nature of changes that are being requested with each package. Medford: This letter is being sent to clarify the recordkeeping requirement for Plant Available Nitrogen (PAN) application on fields that are part of your Certified Animal Waste Management Plan. In order to show that the agronomic loading rates for the crops being grown are not being exceeded, you must keep records of all sources of nitrogen that are being added to these sites. This would include nitrogen from all types of animal waste as well as municipal and industrial sludges/residuals, and commercial fertilizers. Beginning January 1, 2000, all nitrogen sources applied to land receiving animal waste are required to be kept on the appropriate recordkeeping fortes (i.e. IRR], IRR.2, DRY], DRY2, DRY3, SLUR], SLUR?, SLD1, and SLD2) and maintained in the facility records for review. The Division of Water Quality (DWQ) compliance inspectors and Division of Sol] and Water operation reviewers will review all recordkeeping during routine inspections. Facilities not documenting all sources of nitrogen application will be subject to an appropriate enforcement action. Please be advised that nothing in this letter should be taken as removing from you the responsibility or liability for failure to comply with any State Rule, State Statute, Local County Ordinance, or permitting requirement.
