This permit shall be effective from the date of issuance until March 31, 2019, and shall be subject to the conditions and limitations as specified therein. Please pay particular attention to the monitoring requirements in this permit. Failure to establish an adequate system for collecting and maintaining the required operational information will result in future compliance problems. Any increase in volume or increase in stocked animals above the.listed values in this permit will require a modification to this permit and shall be completed prior to actual increase in either flow or number of animals. If any parts, requirements or limitations contained in this permit are unacceptable, the Permittee has the right to request an adjudicatory hearing upon written request within 30 days following receipt of this permit. This request shall be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings at 6714 Mail Service Center, Raleigh, NC 27699- 6714. Unless such demands are made, this permit shall be final and binding. The issuance of this Permit does not excuse the Permittee from the obligation to comply with all applicable laws, rules, standards, and ordinances (local, state, or federal) nor convey any property rights in either real or personal property. Please be advised that any violation of the terms and conditions specified in this Permit may result in revocation of this Permit or penalties in accordance with NCGS 143-215.6A through 143-215.6C, the Clean Water Act, and 40 CFR 122.4 1, including civil penalties, criminal penalties, and injunctive relief. This permit shall be effective from the date of issuance until March 31, 2019, and shall be subject to the following specified conditions and limitations: I. PERFORMANCE STANDARDS The animal waste collection, treatment, and storage system permitted under this permit shall be effectively maintained and operated as a non -discharge system to prevent the discharge of pollutants to surface waters, wetlands, or ditches. If the Buncombe County facility is in compliance with this permit and unintentionally discharges as a result of a storm event greater than the 25 -year, 24-hour storm, the facility will not be considered to be in violation of this permit. 2. A violation of this permit may result in the Permittee having to take immediate or long term corrective action(s) as required by the Division of Water Resources (Division). These actions may include modifying the waste management plan, or reducing the number of animals from the facility. 3. This facility may not be expanded above the capacity shown in this permit until a new permit reflecting the expansion has been issued. • 4. A copy of this permit, waste removal agreements, and certification forms shall be readily available at the livestock facility (stored at places such as the livestock facility, office, outbuildings, etc.) where animal waste management activities are being conducted for the life of this permit. These documents shall be kept in good condition and records shall be maintained in an orderly fashion. 5. The following buffers shall be maintained: a) 100 feet between wastewater treatment or storage units and any wells that supply water to a public water system, or any other well that supplies water for human consumption, and b) 50 feet between wastewater treatment or storage units and property lines_ II. OPERATION AND MAINTENANCE REQUIREMENTS 1. The collection, treatment, and storage facilities shall be maintained at all times and properly operated. 2. Domestic and/or industrial wastewater from showers, toilets, sinks, etc. shall not be discharged into the animal waste collection, treatment, and storage system. 3. Disposal of dead animals shall be done in accordance with the North Carolina Department of Agriculture and Consumer Services (NCDA&CS) Veterinary Division's regulations. 4. All uncontaminated runoff from the surrounding property and buildings shall be diverted away from the animal waste storage structures to prevent any unnecessary addition to the waste in the structures. 5. All treatment units shall be kept free of foreign debris including, but not limited to, tires, bottles, light bulbs, gloves, syringes or any other solid waste. 6. At all times, the facility must have a legal agreement with an appropriately permitted third party or manure hauler to transport and accept the animal waste generated at this facility. M. MONITORING AND REPORTING REQUIREMENTS 1. Adequate records shall be maintained by the Permittee tracking the amount of waste stored and disposed. These records shall include, but are not necessarily limited to, the following information a. Amount of waste generated per event, b. The dates and amounts of solid waste removed from the site, and c. The name and address and permit number of the party responsible for removal of solid waste. 2. NC Department of Agriculture and Consumer Services must provide the waste analysis to the third party applicator or the manure hauler who has responsibility to meet all other requirements including application at agronomic rates, soil testing, field evaluations, etc. 3. This Permit allows for the distribution of up to four cubic yards of manure per visit, with a maximum of ten (l 0) cubic yards per year, to individuals for personal use. The Permittee must provide the recipient(s) with information on the nutrient content of the manure. The Permittee must inform the recipient(s) of his/her responsibilities to properly manage the land application of manure. Record keeping is not required for the distribution of manure to individuals for personal use. 4. The Permittee or their designee shall inspect the waste collection, treatment, and storage structures and runoff control measures. These inspections shall be conducted at a frequency to insure proper operation but at a minimum frequency of monthly and as well as after all storm events. For example, structures should be inspected for evidence of erosion, leakage, damage by animals or discharge. The Permittee shall keep an inspection log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Permittee for a period of five years from the date of the inspection and shall be made available upon request to the Division or other permitting authority. 5. Any major structural repairs must have written documentation from a professional engineer certifying proper design and installation. However, if a piece of equipment is being replaced with a piece of equipment of the identical specifications, no technical specialist approval is necessary [i.e. piping, reels, valves, pumps (if the GPM capacity is not being increased or decreased), etc.]. 6. All records, including maintenance, repair and disposal records, shall be maintained on site and in chronological and legible form for a minimum of three years by the Permittee. These records shall be maintained on forms provided by the Division and shall be readily available for inspection. 7. Any groundwater quality monitoring, as deemed necessary by the Division, shall be provided. 7. Regional Notification: The Permittee shall report by telephone to the Asheville Regional Office, telephone number (828) 296-4500 as soon as possible, but in no case more than 24 hours following first knowledge of the occurrence of any of the following events: a. Failure of any component of the animal waste collection, treatment, and storage system resulting in a discharge to surface waters. b. Any failure of the animal waste treatment and disposal program that renders the facility incapable of adequately receiving, treating or storing the animal waste and/or sludge. C. A spill or discharge from a vehicle or piping system transporting animal waste or sludge which results in, or may result in, a discharge to surface waters or an event that poses a serious threat to surface waters. d. Any deterioration or leak in a storage unit that poses an immediate threat to the environment. Any discharge that bypasses a treatment unit resulting in a discharge to surface waters or that poses a serious threat to the environment. For any emergency which requires immediate reporting after normal business hours, please contact the Division of Emergency Management at 1-800-858-0368. The Permittee shall also file a written report to the appropriate Division's Regional Office of the occurrence within five calendar days following first knowledge of the occurrence. This report shall outline the actions taken or proposed to be taken to correct the problem and to ensure that the problem does not recur. The requirement to file a written report may not be waived by the Division's Regional Office. i V. INSPECTIONS The Permittee shall allow any authorized representative of Department, upon the presentation of credentials and other documents as may be required by law and in accordance with reasonable and appropriate biosecurity measures, to: a. Enter the Permittee's premises where the regulated Facility or activity is located or conducted, or where records must be kept under the conditions of this Permit; b. Have access to and copy, at reasonable times, any records that must be kept under the conditions of this Permit; c. Inspect, at reasonable times any facilities, equipment (including monitoring and control equipment), practices, or operations regulated or required under this Permit; and, d. Sample or monitor, at reasonable times, for the purpose of assuring permit compliance, any substances or parameters at any location. VI. GENERAL CONDITIONS The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface waters or ground waters resulting from the operation of this program. 2. The Groundwater Compliance Boundary is established by 15A NCAC 2L and 15A NCAC 02T .011.1(c). An exceedance of Groundwater Quality Standards at or beyond the Compliance Boundary is subject to the requirements of 15A NCAC 2L and the Division in addition to the penalty provisions applicable under the NCGS. 3. Should the Division have good reason to believe that any activities conducted pursuant to this permit may cause or contribute any waste, directly or indirectly, to be intermixed with the waters of the State, the Division may require any monitoring (including but not limited to groundwater, surface water, animal waste, sludge, soil and plant tissue) necessary to determine the source, quantity, quality, and effect of any waste upon the waters of the State. Such monitoring, including its scope, frequency, duration and any sampling, testing, and reporting systems, shall meet all applicable Environmental Management Commission requirements. "Good Reason" may be based on the findings of a related Federal, State, Commission, or DENR authorized study or report, or other evidence showing that violations of State water quality standards or other applicable environmental standards have occurred or may occur. 4. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division in accordance with North Carolina General Statute 143 -215.6A -6C and may include the requirement to obtain additional treatment or storage units and/or addition of land application, and/or the modification of the animal waste management system. 5. The issuance of this permit does not excuse the Permittee from the obligation to comply with all applicable statutes, rules, regulations, or ordinances (local, state, and federal). 6. If animal housing ceases, the Permittce is responsible for developing, implementing and completing a "closure plan" which will eliminate the possibility of an illegal discharge, pollution, erosion, and the potential for injury. Closure shall include notifying the Division. The annual permit fee shall be paid by the Permittee within thirty (30) days after being billed by the Division. Failure to pay the fee accordingly constitutes grounds for revocation of this permit. 4 E 8. Failure of the Permittee to maintain, in full force and effect agreements that are required in the permit application and shall constitute grounds for revocation of this permit. 9. This permit is effective only with respect to the nature and volume of wastes described in this permit for NC Department of Agriculture and Consumer Services. 10. The issuance of this Permit does not prohibit the Division from reopening and modifying the Permit, revoking and reissuing the Permit, or terminating the Permit as allowed by the appropriate laws, rules, and regulations. 11- This permit is not automatically transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 12. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension. Upon receipt of the request, the Commission will review the adequacy of the facilities described therein, and if warranted, will extend the permit for such period of time and under such conditions and limitations as it may deem appropriate. VIL PENALTEES 1 _ Failure to abide by the conditions and limitations contained in this Permit and/or applicable state law; may subject the Permittee to an enforcement action by the Division including but not limited to the modification of the animal waste management system, civil penalties, criminal penalties, and injunctive relief. 2. The Permittee must comply with all conditions of this Permit. Any Permit noncompliance constitutes a violation of state law and is grounds for enforcement action; for Permit coverage termination, revocation and reissuance, or modification; or denial of Permit coverage renewal application. It shall not be a defense for a Permittee in an enforcement action to claim that it would have been necessary to halt or reduce the permitted activity in order to maintain compliance with the conditions of this Permit. V. The Groundwater Compliance Boundary is established by 15A NCAC 2L and .15A NCAC 02T .011 1(c). An exceedance of Groundwater Quality Standards at or beyond the Compliance Boundary is.subject to the requirements of 15A NCAC 2L and the Division in addition to the penalty provisions applicable under the NCGS. 3. Failure to abide by the conditions andlimitations contained in this permit may subject the Permittee to an enforcement action by the.Division in accordance with North Carolina General Statute 143 -215.6A -6C and may include the requirement to obtain additional treatment or storage units and/or addition of land application, and/or the modification of the animal waste managemenUsystem. 5. The issuance of this permit does not excuse the Permittee from the obligation to comply with all applicable statutes, -rules, regulations, or ordinances (local, state, and federal). b. If animal housing ceases, the Permittee is responsible.for developing, implementing and completing a "closure plan" which will eliminate the possibilityof an illegal discharge, pollution,. erosion, and the potential for. injury. Closure; shall include notifying the Division. 7. The annual permit fee shall be paid by the Perinittee within thirty (30) days after being billed by the Division. Failure to pay the fee accordingly constitutes grounds for revocation of this permit. 4 8. -Failure of the -Permittee to maintain, in full force and effect agreements that are required in the permit.applicatiori and shall constitute grounds for revocation of this permit_. 9, This permit is effective .only with respect to the nature and volume of wastes described in this permit for NC Department of Agriculture and Consumer Services. 10. The issuance of this Permit does not prohibit the Division from reopening and modifying the Permit, revoking and reissuing the Permit, or terminating the Permit as allowed by tine appropriate laws, rules, and regulations. 11. This permit is not automatically transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must W submitted to the Division accompanied,by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. Horse show season runs from March through early October. Events are typically held on Friday, Saturday and Sunday. Some events, The facility has stall space for a maximum of approximately 874 horses. The facility has 6 horse barns with stalls as well as approximately 200 portable stalls. Attachment included entitled 'Waste Utilization Calculations for Horse Complex' developed by Jeff Young, PE dated November 30,2012. Volume and concentration numbers from these calculations were used in development of the Plan in the NC Nutrient Management Software. Waste volume and nutrient concentration for horse manue production were obtained from the NRCS 633 Waste Utilization Standard (now part of the NRCS 590 Standard). Bedding quantity was obtained from WNC Ag Center records. The plan projects annual waste volume of 165,560 cubic feet (approximately 1,764 tons). The WNC Ag Center is a busy and high profile public venue. Waste material is kept contained in bins or barns and the grounds are constantly kept clean. Containment prevents any runoff during precipitation events. See also, attached 'Operation and Maintenance Plan for Nutrient Management' for O&M and record-keeping plan. Bedding and waste are scraped and carried to nearby outdoor cement storage bins that are 10'x20'x4' and enclosed on three sides and the bottom. After horses leave the complex (typically Sunday), bedding and waste are scraped to the center of the barns. This material remains inside the barns until staff load it on trucks to go directly to third party receivers (starting typically on Monday). During clean-out operations the 7 outdoor, tempoiary.storage bins are emptied and loaded to the trucks as well. Trucks are covered with a tarp during transport. In the rare occasion that the outdoor temporary storage bins become full during an event staff will load the material onto trucks and transport to third party during the event. All of the animal waste and bedding generated at the facility are moved off site through third -party agreements where it is utilized as a carbon, bedding or nutrient resource. This Plan addresses essential elements of proper operation and maintenance of the animal waste management system at the WNC Agricultural Center horse facility. The facility has a plan to operate in a manner that protects soil and water resources. Waste and used bedding are contained in bins or barns on site. Areas around bams and storage bins are. kept clean at all times. All of the animal waste and bedding generated at the facility are moved off site through third -party agreements where it is utilized as a carbon and nutrient resource. This practice requires following a regular operation and maintenance plan to maintain satisfactory performance. The following are some requirements that are essential in implementation of a sound operation and maintenance program. Operation and Maintenance 1. There should be periodic waste plan review to determine if adjustments or modifications to the plan are needed or as necessary when operational changes occur. Revisions must be approved by a certified nutrient s management specialist. 2. All areas in and around the horse barns are kept dean during all events. Used bedding and manure are transferred to cement storage bins (total of 7 measuring 10'x20'x4' each in size). Manure and used bedding are protected from any leakage or spillage. 3. Bedding and manure material remaining in the stalls will be scraped and piled and will remain covered in the bams until it is loaded on trucks and transported off site. 4. Bin storage is typically adequate for a given event. For the rare occasion that bins become full, the farm will transfer material to trucks and deliver to third party during an event to ensure adequate storage space on site. 5. Material is delivered to a third party receiver as soon is logistically possible after each event_ Material is covered with a tarp during transport. Transport does not occur during rain events unless it is absolutely essential. 6. Bedding and manure is promptly removed to prevent establishment of insect pests and development of odors 7. Contracts are established with a third -party who will properly manage the bedding material and manure they receive from the WNC Ag Center. 8. Maintaining records to document plan implementation. As applicable, records include: • The producer shall have a written agreement with the third party applicator that they are receiving the material and will manage it property. • Keep a record of the name, address and phone number of all third party applicators you have agreements with. • Quantity of material (cubic feet) removed from site, along with record of date and recipient. • Periodic waste analysis of material from NCDA Agronomic Division Lab. Sampling and waste analysis every 120 days is recommended. Results are to be made available'to third party -recipients. • Daily records for all precipitation events. Events greater than 1" of rainfall in a 24 hour period will require an inspection of the waste storage system to insure integrity of storage structures, that nutrient - containing material is contained and that there are no negative impacts to surface or ground water. There must be documentation in the design folder that the producer either owns or has an agreement for use of adequate land on which to properly apply the waste. If the producer does not own adequate land to properly dispose of the waste, he/she shall provide evidence of an agreement with a landowner, who is within a reasonable proximity, allowing him/her the use of the land for waste application: It is the responsibility of the owner of the waste production facility to secure an update of the Nutrient Management Plan when there is a change in the operation, increase in the number of animals, method of application, receiving crop type, or available land. 3. Animal waste shall be applied to meet, but not exceed, the nitrogen needs for realistic crop yields based upon soil type, available moisture, historical data, climatic conditions, and level of management, unless there are regulations that restrict the rate of applications for other nutrients. 4. Animal waste shall be applied to land eroding less than 5 tons per acre per year. Waste may be applied to land eroding at more than 5 tons per acre per year but less than 10 tons per acre per year provided grass filter strips are installed where runoff leaves the field (see USDA, MRCS Field Office Technical Guide Standard 393 Filter Strips). 5. Odors can be reduced by injecting the waste or by disking after waste application. Waste should not be applied when there is danger of drift from the land application field. 6. When animal waste is to be applied on acres subject to flooding, waste will be soil incorporated on conventionally tilled cropland. Liquid waste shall be applied at rates not to exceed the soil infiltration rate such that runoff does not occur offsite or to surface waters and in a method which does not cause drift from the site during application. No ponding should occur in order to control odor and flies. S. Animal waste shall not be applied to saturated soils, during rainfall events, or when the soil surface is frozen. 9. Animal waste shall be applied on actively growing crops in such a manner that the crop is not covered with waste to a depth that would inhibit growth. The potential for salt damage from animal waste should also be considered. 10. Nutrients from waste shall not be applied in fall or winter for spring planted crops on soils with a high potential for leaching. Waste/nutrient Ioading rates on these soils should be held to a minimum and a suitable winter cover crop planted to take up released nutrients. Waste shall not be applied more than 30 days prior to planting of the crop or forages brealdng dormancy. 11. Any new swine facility sited on or after October 1, 1995 shaII comply with the following: The outer perimeter of the land area onto which waste is applied from a lagoon that is a component of a swine farm shall be at least 50 feet from any residential property boundary and canal. Animal waste, other than swine waste from facilities sited on or after October i, 1995, shall not be applied closer that 25 feet to perennial waters. 12. Animal waste shall not be applied closer than 100 feet to wells. 13. Animal waste shall not be applied closer than 200 feet of dwellings other than those owned by the landowner. 14. Animal waste shall not be discharged into surface waters, drainageways, or wetlands by a discharge or by over -spraying. Animal waste may be applied to prior converted cropland provided the fields have been approved as a land application site by a "technical specialist". Animal waste shall not be applied on grassed waterways that discharge directly into water courses, and on other grassed waterways, waste shall be applied at agronomic rates in a manner that causes no runoff or drift from the site. 16. Domestic and industrial waste from washdown facilities, showers, toilets, sinks, etc., shall not be discharged into the animal waste management system. 17. A protective cover of appropriate vegetation will be established on all disturbed areas (lagoon embankments, berms, pipe runs, etc.). Areas shall be fenced, as necessary, to protect the vegetation. Vegetation such as trees, shrubs, and other woody species, etc., are limited to areas where considered appropriate. Lagoon areas should be kept mowed and accessible. Berms and structures should be inspected regularly for evidence of erosion, leakage, or discharge. 18. if animal production at the facility is to be suspended or terminated, the owner is responsible for obtaining and implementing a "closure plan" which will eliminate the possibility of an illegal discharge, pollution, and erosion. 19. Waste handling structures, piping, pumps, reels, etc., should be inspected on a regular basis to prevent breakdowns, leaks, and spills. A regular maintenance checklist should be kept on site. 20. Animal waste can be used in a rotation that includes vegetables and other crops for direct human consumption. However, if animal waste is used on crops for direct human consumption, it should only be applied pre -plant with no further applications of animal waste during the crop season. 21. Highly visible markers shall be installed to mark the top and bottom elevations of the temporary storage (pumping -volume) of all waste treatment lagoons. Pumping shall be managed to maintain the liquid level between the markers. Waste shall be tested within 60 days of utilization and soil shall be tested at least annually at crop sites where waste products are applied. Zinc and copper levels in the soils shall be monitored and alternative crop sites shall be used when these metals approach excessive levels. pH shall be adjusted and maintained for optimum crop production. In total more than 7,000 horses pass through the facility each year. Six barns provide a total of 6,000 stalls for these events. It is estimated that 400,000 lbs. of used bedding material is generated annually and must be properly disposed. Show participants use stalls provided by the Horse Complex during events. Participants buy from show organizers high quality packaged shavings and on occasion news print and spread them in assigned stalls. During events, manure is removed as needed by participants to manure storage areas located along sides of barns. After shows, the stalls are thoroughly cleaned and the used bedding is loaded on trucks and hauled to a farm site where it is further used as bedding for dairy cattle before disposal. During clean out and loading, the bedding is never piled and exposed to rainfall and runoff. The receiving farm is responsible for proper disposal of the bedding material after further use (see attached copy of agreement with farm). Manure in storage areas along barns is loaded weekly and moved to an area where it is piled for composting_ Citizens in the area then obtain the composted material at no charge and utilize it on their land. Citizens receiving the free composted bedding and manure are responsible for proper utilization and disposal on their property. K".0 9 ' -Vi 1 a I� L ! y - The bedding waste generated by the Horse Complex is very low in nutrient content (see attached Waste Analysis Report). Due to minimum usage at the Horse Facility, it can be further used as a bedding material for cattle and other animals. It is also suitable for use as a carbon source in a composting operation. The small amount of nutrients in the bedding material can also be used in crop production but the major advantage to land application is improved soil structure due to addition of organic matter. A copy of a representative analysis of the bedding material is provided to the farm receiving the material A copy of a representative analysis of the composted waste is also available for citizens receiving the free composted product. Since the bedding material is loaded directly from the barn and delivered to the receiving farm, there is no risk of rainfall moving water soluble nutrients or debris to storm water. Special effort is made during loading to avoid spillage of bedding near storm drains. An accounting of the loads of bedding material delivered to the receiving farm is maintained. In order to protect manure storage areas from rainfall, a tarpaulin or plastic cover will be provided at each storage area. After each event, the storage areas will be covered as needed to protect the waste product from significant rainfall that could move water soluble nutrients and/or debris into storm water. Manure storage areas are constructed with concrete floors and block walls to form a U-shaped or L-shaped area for easy access in loading. Grass buffers are maintained around the storage areas where possible to further reduce movement of nutrients and debris with storm water. The compost storage area is located on well drained soil with adequate grass and/or riparian buffers around it to protect surface waters from runoff. Several horse washing facilities are located in the Horse Complex. They consist of a concrete pad on which animals are prepared for show. Wash water from these facilities drains into the municipal waste treatment system or settling areas where suspended solids are removed before the water enters the storm drain. Users of these facilities will be instructed no to wash manure into the drain system. The staff will remove droppings in these areas to manure storage areas as required. Gutters have been installed on all buildings at the Horse Complex. This greatly reduces runoff from areas of intensive traffic. Dirt roads and paths will be maintained to avoid surface water accumulation and movement of sediment and debris to storm drains. Grass buffers are maintained along intensive use areas such as riding arenas to minimize movement of sediment and nutrients. 44 J!!LJ' .I As funding becomes available, consideration will be given to paving access roads around the horse barns. This will further reduce sediment loading of storm water_ Consideration will also be given to covering waste loading areas at ends of.bams. If tarpaulins are not adequate, consideration will be given to constructing permanent covers for temporary waste storage areas along barns. Construction of a covered composting storage area will be considered to protect composting materials from rainfall and further reduce risk of nutrient and debris movement in surface water.
