Dear Permittee:
Your facility is currently approved for operation under one of the Animal Waste Operation General Permits.
These permits expired on October 1, 2004. On June 11, 2004, the North Carolina Division of Water Quality
(Division) issued revised State General Permits for animal facilities. The General Permits were issued in
accordance with the directive of Senate Bill 733 (Session Law 2003-28). The Division staff is currently in the
process of issuing Certificates of Coverage for these revised general permits.
In order to assure your continued coverage under the general hermit, you must apply_to the Division for renewal.
Enclosed you will ,find a Permit Coverage Renewal Application Form. The application form must be completed
and returned within 60 days from receipt of this letter.
Failure to request renewal of your coverage under a general permit within the time period specified may result in
a civil penalty. Operation of your facility without coverage under a valid general permit would constitute a
violation of NCGS 143-215.1 and could result in assessments of civil penalties of up to $25,000 per day.

The Non -Discharge Permitting Unit has completed a preliminary review of the subject application. Additional information is
required before we can continue our review. Please address the following by April 27, 2003:
This office currently has a waste utilization plan (WUP) for this facility dated 12/11/1997. The plan was written for 175
head dairy operation. A letter sent to this office by Ms. Jo Ann McCall of Buncombe County Soil and Water
Conservation district provided further clarification on portions of the waste utilization plan. However, the page
references cited in her letter do not match with the WUP cop), on file here. Please verify that the same WUP is being
followed on this farm. If you have modified the WUP since then, please submit a copy of most recent WUP that reflects
correct number of animals, crops grown, field utilized and has field maps with acreage clearly marked on the maps.
Please note that all WUP revisions must be signed and dated by both the owner and the technical specialist.
Please reference the subject permit application number when providing the requested information. All information should be
signed, sealed, and submitted in duplicate io my attention at the address below. The information requested by this letter
must be submitted on or before April 27, 2003 or the Division will return your application as incomplete in
accordance with 15A N.C.A. C. 2H .0200 and your facility will be considered to be operating without a permit-

Your animal waste management facility is scheduled to be issued coverage under the Animal Waste
Operation General Permits in the near future_ The Division of Water Quality (Division) staff is currently
in the process of renewing the Animal Waste Operation General Permits and is scheduled to have the
permit reissued by early April 2003. Once the permit is reissued, your facility would be eligible for
coverage under the reissued permit.

This letter is being sent to clarify the recordkeeping requirement for Plant Available Nitrogen (PAN)
application on fields that are part of your Certified Animal Waste Management Plan.
In order to show that the agronomic loading rates for the crops being grown are not being exceeded, you
must keep records of all sources of nitrogen that are being added to these sites. This would include nitrogen
from all types of animal waste as well as municipal and industrial sludges/residuals, and commercial fertilizers.
Beginning January 1, 2000, all nitrogen sources applied to land receiving animal waste are required to
be kept on the appropriate recordkeeping forms (i.e. IRRI, IRR2, DRY1, DRY2, DRY3, SLUR], SLUR2,
SLD1, and SLD2) and maintained in the facility records for review_ The Division of Water Quality (DWQ)
compliance inspectors and Division of Soil and Water operation reviewers will review all recordkeeping during
routine inspections. Facilities not documenting all sources of nitrogen application will be subject to an
appropriate enforcement action.
Please be advised that nothing in this letter should be taken as removing from you the responsibility or
liability for failure to comply with any State Rule, State Statute, Local County Ordinance, or permitting
requirement.

The Non -Discharge Permitting Unit has completed a preliminary engineering review of the subject application. Additional
information is required before we can continue our review. Please address the following by October 23, 1999:
I . The application form submitted indicates that there are two waste storage ponds at this facility. Please
provide waste storage pond capacity documentation for the second pond. The volume submitted was for the
pond with a capacity of 14,212 cubic feet.
2. The irrigation parameters listed in your Waste Utilization Pian (WUP) exceed current recommendations.
Irrigation events are to be listed in the WUP as the maximum application allowable for that soil type from
the time the pumps are turned on until the time.they are shut off. The application events listed in your WUP
appear to be out of the Sprinkler Irrigation Guide. The Application Amounts listed in this guide have not
been adjusted for the application of animal waste. It is currently recommended that total application
amounts not exceed one inch in any application event for any soil type. If your application rates need to be
adjusted for the application of animal waste, please have your Technical Specialist revise your WUP to
reflect the appropriate application amount per event. If the rates exceed the recommended one inch, please
have your Technical Specialist justify the increased application rate in the narrative of your WUP.
3. Please provide a map that identifies (outlines or highlights) and shows the acreage for each field to be used
for waste application.
4. Please contact your technical specialist and have application windows (months) added to your WUP for
each crop grown.
5. Your WUP indicates that you will be applying animal waste on land that you do not own. Please provide
lease, agreements or other land use agreements for this land. Be sure to include field and tract numbers and
acreage amounts on these agreements.
6. Your application package indicates that there is 30 days storage in the waste storage pond and 30 days
storage in the dry stack structure. Please contact your technical specialist and demonstrate that this amount
Of storage is adequate for the cropping system in place. Also, please provide a narrative of what waste, and
from where, goes into the pond what goes to the dry stack.

accordance with Chapter 626 of 1995 Session Laws (Regular Session 1996), Section 19(c)(2), any
owner or operator who fails to submit an application by the date specified by the Department
SHALL NOT OPERATE the animal waste system after the specified date. Your application must

may also subject your facility to a civil penalty and other enforcement actions for each day the facility is
operated following the due date of the application.

In Secretary McDevitt's response to your June 10, 1998 letter on this subject dated
June 17, 1998, the Secretary asked that I address your request for ongoing
sampling support in the Newfound watershed.
As your letter noted, this special study sampling began in 1996 in order to develop
a baseline of water quality conditions in this watershed so that improvements to
water quality from planned efforts to implement rather intensive installation of
agricultural BMPs in the drainage could be described in some detail. Efforts to
[move forward with intensive BMP installation in the area have not progressed as
rapidly as expected, but baseline sampling of the watershed has continued. We are
very pleased to see the commitment of your agency to accomplish BMP installation.
The Asheville Regional Office has continued to gather data on the Newfound
watershed. The opportunity to document direct water quality improvements from
BMP installation within an important and impacted watershed of the French Broad
River Basin continues to be a powerful motivator for continuation of this effort. I
would point out, however, that monitoring resources are limited and are generally
allocated statewide through the Basinwide Water Quality Management Process. In
addition to the chemical sampling performed by the Asheville Office, we are also
periodically using biological monitoring resources from the Environmental Sciences
Branch in Raleigh to track changes in the ecological quality of the waters in this
drainage area- Due to overall resource commitments, the special study effort in the
Newfound watershed will be continued on a year to year basis contingent upon our
ability to continue to support this effort. We do plan to continue this study through
FY 1998-99 (July 1 to June 30) and will evaluate the potential for further sampling
based on the availability o resources and the progress made toward getting BMPs
installed.

The Buncombe County Soil and Water Conservation District has received
funding from the North Carolina Clean Water Management Trust Fund (CWMTF) to
coordinate and implement a quality water improvement project in Newfound Creek
Watershed. However, the grant funding from CWMTF only provides for the staff
position to oversee the project. The French Broad River Basinwide Wafer Quality
Management Plan designates Newfound Creek as impaired by sedimentation and
nutrients_ The plan also states that Newfound Creek should receive high priority as
sediment control programs are implemented.
Linda Wiggs, ambient monitor with the Division of Water Quality, Asheville
Regional Office has been monitoring the water quality in Newfound Creek since 1.996.
We understand that this is a special study that Ms. Wiggs has taken on above and
beyond her regular duties and we commend her for her efforts. We would like to
recognize Linda Wiggs for her commitment to ARO ambient monitoring and for her
initiative to take on special projects for the interest of water quality.
In addition, we would like to get a formal commitment from NCD

Thank you for your June 10 letter. I appreciate your sharing the favorable
comments on behalf of Ms. Linda Wiggs and recognizing her for going above and
beyond her regular duties by conducting a special study and monitoring the water
quality in Newfound Creek since 1996.
By -copy of this letter to Assistant Secretary for Environmental Protection
Bill Holman and Director of Water Quality Preston Howard, I am requesting that
they address your request for a formal commitment to continue to monitor water
_quality parameters on a monthly basis and to do special projects that would
document improvements from various BMPs within the Newfound Creek
Watershed. I am asking that they keep me informed of their progress & work
directly with you.
