I reside at 21 Willie Mae Way and also have concerns. According to the guidelines of his Waste Utilization Plan I believe that Mr. Nesbitt is not within the buffers that were set forth. I believe that his spray is within 75 to 80 feet from a water well and he is definitely spraying less than 200 feet from my residence. I do not refute Mr. Nesbitts' right to a garden and business. We all have a right to live. I do however resent his apparent lack of regard of the laws and regulations as well as the welfare of the other families living around this Feld. 167 Respectfully yours, Mary R. It is probably far enough away from my home and well water ... but I'm not so sure about the other houses. Also, he just cleared the field two days ago. Is that enough time for a winter cover crop to be planted? Again, I really am not concerned as long as everyone's water is safe. I'm not trying to complain, only trying to make sure we are safe. I now have a 5 112 month old to think about! Thank you! Felicia Carter ______________ Original message from Bev Price <Bev.Price@nemail.net>:-------------- Mrs. Carter, The buffers are 100 from a water supply well and 200 feet from residences. Mr. Nesbitt had this Field added to his Waste Utilization Plan. The waste should be applied to a winter cover crop, Bev Price feliciaicarter a,bellsouth.net wrote; Bev - i just wanted to find out again what the stipulation was for Tony Nesbitt to spray the fields beside our home. I believe you said it was 100 feet away or more. I caught wind that he was going to spray the field tomorrow and I just wanted to make sure I knew the guidelines. This is for the property at 31 Willie Mae Way, Fletcher, 28732 in Buncombe County. Thank you! Nesbitt (Facility Number: 11-6) T & C Dairy PO Box 936 Fletcher, NC 28732 Dear Mr. Nesbitt: This letter is in follow-up of the Operation Review on December 10, 2001. During the review, no discharges from your dairy operation were observed. Your waste management system is functioning properly for collection and storage of waste. The areas for improvement noted on the review pertain mainly to record keeping. A copy of the Certificate of Coverage and General Permit should be kept with you other records, such as your Waste Utilization Plan and waste application records so that they will be available for review. Detailed records need to be kept for the amount of waste applied to each field and the PAN needs to be calculated for each field. A recent waste sample was on hand. Soil samples results should also be included in your records. A new maximum waste level marker will need to be installed in the slurry storage pond. Our staff can assist with the design of this marker and determining the elevation for placement. We will contact you in the near future to schedule a time to work on these items with you.
