After reviewing your application, we have determined that the Division of Water Quality (DWQ) General Water Quality Certification Number 3400 covers these water impacts. This Certification allows you to General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition, you should get or otherwise comply with any other federal, state and local requirements before you go ahead with your project including (but not limited to) erosion and sediment control regulations and CAMA. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h). PROJECT SUMMARY: The applicant proposes to construct 12 dwellings (11 new homes and upgrade an existing dwelling), construct an access road and parking areas, relocate a boat ramp, construct a pier and platform in Pamlico Sound and construct 4 finger piers in the basin to create a total of 10 slips. Sapphire, LLC Dare County Aaron Hill Harbor Express Permit Review Program Project setting Ben Seal, Jr., on behalf of Sapphire, LLC, has requested the attached application be processed under the Express Permit Review Program, for a multi-unit housing development under the name of Aaron Hill Harbor. The project site is located in the Town of Salvo on NC 12 (at milepost 43), on a manmade canal and basin system off the Pamlico Sound in Dare County, North Carolina. The applicant's parcel of land comprises ±9.97 acres and is bisected by the aforementioned canal and basin. The access canal is ±75' wide by ±300' long and the irregular shaped basin is ±125' wide by ±250' long. A finger pier and associated tie pilings define two slips in the southeast corner of the basin. A finger pier with associated tie pilings exist in the southwest corner of the basin defining an additional two slips. A boat ramp is located in the northwest corner of the basin with an associated ±8' by ±30' dock. Currently there is no decking on the dock or the two finger piers. The entire basin and the south side of the access canal is bulkheaded. A deteriorated breakwater extends ±150' into the sound off the southwest corner of the bulkhead at the canal entrance. The average water depth is ±3.75' below the normal high water. The property is bordered on the north side by a manmade canal, and a manmade canal and Cedar Creek border the property on the south side. The upland portions of the adjoining properties are developed with dwellings but neither side has pier structures in the sound proper. There is adequate area at the head of both the adjoining canals to tie up a small boat. Currently, a house with a swimming pool and associated decks exist on the site between the basin and NC 12. Scattered around the site are an additional 5 structures that served as quest houses and/or storage. The project site around the basin and canal system with the exception of the north side is vegetated with open areas of upland grasses as well as several oaks and numerous clumps of pampas grass. The area around the house is also vegetated with ornamental shrubs. The portion of the site that abuts NC 12 is vegetated with upland grasses, pines and pampas grass. The northwest and southwest portions of the property have been delineated as Coastal Wetlands and are vegetated with S artina alterniflora, Juncus roemerianus, S. patens, and S. cynosuroides The applicant is currently working on raising the level of the front portion of the property with sand in areas outside of Coastal Management jurisdiction. The site is ±4' above the normal high water. The Estuarine Water of the Pamlico Sound in this area is classified as SA by the Environmental Management Commission and is open to shellfishing. Sapphire, LLC Dare County Aaron Hill Harbor Express Permit Review Program Page Two Project description The applicant proposes to redevelop the site by removing the existing house and pool along with the building nearest NC 12. Of the remaining 3 buildings, the one adjacent the canal on the south side of the property will be left intact, and the two buildings adjacent the basin will be repaired in the existing footprint (one will be converted into a residence and the other an accessory building for the development). An additional eleven houses will be constructed around the east and south sides of the basin. The three story dwellings will have a ±40' by ±60' footprint with 6 bedrooms in each unit and all units tivill be pile supported. None of the proposed dwellings will be constructed closer than 30' to the existing basin. The existing 16' wide by 33' long concrete boat ramp and dock will be removed and the area will be buikheaded and back-filled. A new:!-30'-,vide by ±12' long boat ramp is proposed on the south side of the basin. The new boat ramp will be construct with the toe of the ramp in line with the existing bulkhead and no excavation is proposed in the existing basin. The applicant proposes to construct wing walls to stabilize the sides of the new boat ramp created by cutting into the existing hiahground. A -5' wide by ±20' long finger pier is proposed in the center of the new ramp to ease in loading and unloading, and a pump out will be located on this finger pier for the owners use. Approximately 1,360' of 5' wide boardwalks are proposed around the east, south and west side of the basin adjacent the existing bulkhead and will extend ±300' along the south side of the access canal. Five-foot wide boardwalks are also proposed connecting units 6 through 11 to the basin boardwalk. The existing -150' long breakwater will be repaired and a ±5' wide by ±75' long access pier will be constructed on top of the structure with a ±l 5' by ±20' platform at the end of the new pier. The platform will be covered with a -17' by ±22' roof (drip line) creating a gazebo as per the attached plat. The applicant proposes to construct four - 5' by 20' finger piers in addition to using the existing 8' by 35' finger pier in the southwest corner of the basin. The existing finger pier in the southeast comer of the basin will be removed to allow for 4 of the new slips in this area. Twelve mooring pilings are proposed in association with the finger piers creating a total of 10 slips. The slip size is based on an average boat size of ±25'. By restrictive covenant, the applicant is not allowing any side to mooring along the existing bulkhead and has limited the total number of permanently moored boats in the basin to 10. The applicant proposes to construct an access road (Aaron Harbor Lane) that will access the dwellings. Parking will be provided adjacent to and under each new unit as well as beside the existing two buildings. The proposed access road will encroach within the 75' Estuarine Shoreline _f Sapphire, LLC Dare County Aaron Hill Harbor Express Permit Review Program Page Three along the south and west sides of the basin. With the exception of the relocated boat ramp, no impervious structures are proposed within 30' of the basin. The total amount of impervious surface within the 75' Estuarine Shoreline has been calculated at ±21,979 ft' or ±10.1 % (includes the homes, road and boat ramp approach). Other than the ±16' of bulkheaded needed to close off the old boat ramp, and the new wing walls for the new boat ramp, no additional shoreline stabilization is proposed for this project. The existing water depth of ±3.75' eliminates the need for dredging. No grading or filling work is proposed within 30' of the normal water level with the exception of the road area and boat ramp described above. Anticipated impacts The construction of the pier, covered platform, and finger piers will result in the shading of ±1,429 ft' of sound and/or canal bottom and permanent mooring space for 10 boats (±25' in average length). The project as proposed will result in the disturbance of±163,350 ftz (3.75 acres) of uplands as a result of the development activities. The project as proposed will result in localized turbidity as a result of the construction activities. David W. Moye -18 May 2005 NARRATIVE AARON HILLL HARBOR MAJOR CAMA PERMIT May 4, 2005 Aaron Hill Harbor is a 9.97 acre tract of land located on the sound side of NC Highway 12 at Salvo, Dare County, North Carolina. The site has an existing boat basin which is bulkheaded on the south and east. Access to the boat basin is provided by a boat ramp at the northeast corner of the basin. The site also contains three existing singly family residential structures, a mobile home and three accessory use buildings. The owner, Sapphire LLC, plans a redevelopment project to convert to a single family group housing project which will consist of building sites for eleven (11) 6-bedroom residences. In addition, one of the existing accessory buildings will be remodeled for use as a residence for a total of twelve residences. Two of the other accessories use buildings will be refurbished and remain. All other structures will be demolished and or removed from the site. The existing boat basin will become an amenity for the exclusive use of homeowners of Aaron Hill Harbor and their guests. The existing boat ramp will be bulkheaded and filled in. A new boat ramp will be constructed as shown on the plan. Four new finger piers will be constructed and one existing pier will remain for a total of ten boat slips. Existing bulkheading and break water will remain except where modifications are required for abandonment of the existing boat ramp and construction of a new one. No excavation or dredging is planned below NWL. Upland excavation and fill will be required for abandonment and reconstruction of the boat ramp. Steven Price, LSS, with Soil and Environmental Consultants had prepared a report for the site prior to our visit. Mr. Price evaluated the site potential for a 5000GPD system utilizing pretreatment and a low pressure pipe system in fill. I performed 8 borings, to a depth of 54 inches, in the initial and repair areas proposed by Mr. Price. Those borings revealed that the soil wetness condition was at least 18 inches below the natural soil surface, with most borings revealing a 24-inch depth to soil wetness. The texture was found to be sand at all depths. My borings confirmed the findings of Mr. Price. The LTAR proposed for the system is 1.0 GPD/FT2, which is acceptable for an LPP system in fill provided the effluent receives pretreatment to a TS-1 level prior to the LPP fields. I have since looked at the mounding analysis for this proposal, which was done by S&EC. The soil inputs appear to accurately reflect the conditions at the site. It appears that the model assumes the sound to be located 200 feet from the proposed fields. This accurately reflects the natural boundary conditions at the site needed for the model. Our engineering staff in Raleigh will need to verify the accuracy of the calculations utilizing these inputs, prior to final approval of the plans. If the calculations are accurate the proposed system would be suitable for the site, because the mounding analysis shows that the water table will remain below the natural ground surface, and the required 2 foot separation distance from the bottom of the LPP trenches to the mounded water table can be maintained by the addition of fill to the site. My preliminary calculations show that 3 feet of fill may be needed instead of 2.5 feet as specified in the S&EC report. All portions of the proposed LPP fields must be maintained 25 feet from the property line and 200 feet from the adjoining sound. My borings revealed that a portion of the proposed fields contains gravel from a driveway located on the site. The depth of the gravel is about 6 inches from the ground surface, This gravel should be carefully removed and replaced with clean san fill prior to construction of system in that area. Wetlands BMP and Vegetated filter will be inspected monthly or after every runoff producing rainfall event for sediment build-up, erosion, and trash accumulation. a. Accumulated sediment and trash will be removed as necessary. b. The orifice will be checked and cleared of any obstructions such that the down draw of the temporary pool occurs within 2 to 5 days as designed. 2. Eroded areas will be repaired and revegetated as needed and in a timely manner based on the monthly inspections. Vegetation selection will be of the same species as original plantings. 3. Catch basins, curb cuts, velocity reduction devices, and piping will be inspected monthly or after every significant runoff producing rainfall event. Trash and debris will be cleared away from grates, curb cuts, velocity reduction devices and piping. 4. Accumulated sediment will be removed from the forebay and deep pool semi- annually or when depth is reduced to 75% of the original design depth. Removed sediment shall be disposed of in an appropriate manner and shall be handled in a manner that will not adversely impact water quality (i.e. stockpiling near a wet detention basin or stream, etc.). The measuring device used to determine the sediment elevation shall be such that it will give an accurate depth reading and not readily penetrate into accumulated sediments. When the permanent pool depth reads 1.88 feet in the deep pool, the sediment shall be removed. When the permanent pool depth reads 2.25 feet in the forebay, the sediment shall be removed. 5. Neither wetlands nor vegetated filters will be altered, piped, or filled in without prior approval from NCDENR Division of Water Quality. 6. The water level in the wetland is controlled by an adjustable weir at the inlet structure and an adjustable orifice plate at the outlet structure. These levels will not be adjusted unless the adjusted level is approved by DWQ. 7. If the basin must be drained for an emergency or to perform maintenance, the flushing of sediment through the emergency drain shall be minimized to the maximum extent practical. All components of the wetland basin system shall be maintained in good working order.
