PROJECT SUMMARY: The applicant proposes to construct five buildings, four ofwhich would provide for eighteen (18) residential town-home units, a community building, access drive, swimming pool, stormwater infiltration trench and utilities. PROJECT DESCRIPTION: Michael Gallant, P.E., P.A., on behalf of Tradewinds of Anna Maria, LLC, has requested that the attached application be processed under the Express Permit Review Pilot Program. The applicant's project is located off Roland Avenue (NC Highway 50/210), adjacent to Topsail Sound, near the Surf City Swing Bridge, in Surf City, Pender County. To find the property, take Highway 17 North from Wilmington and turn right on N.C. State Highway 50 (approximately 20 miles from Wilmington). Head east on Hwy 50 and the property will be located on the left hand side, just before the Surf City swing bridge, near Sear's Landing. The applicant has submitted an Express CAMA Permit Application to develop approximately 1.4 acres between Roland Avenue (Highway 50) and an unnamed tributary to the Atlantic Intracoastal Waterway (AIWW), adjacent to Topsail Sound. The high ground portion of the tract is mostly cleared of vegetation and is relatively flat with an elevation of 2.0' to 5.0' above Mean High Water (MEW). Several small stands of Southern Wax Myrtle (Merica cerifera), Yaupon (Ilex von itoria), and Red Cedar (Juniperus virginiana) exist on western side of the property. The property has approximately 200 linear feet of shoreline along an unnamed tributary to the AIWW. Along the north side, the high ground vegetation is bordered by transitional species including Sea Oxeye (Borrichia frutescens) and Grounsel-bush (Baccharus halimifolia). A very thin section of high coastal marsh vegetation including Black Needle Rush (Juncus roemarianus), Spike Grass (Distichlis spicata) and Sea Lavender (Limonium, spp., also exists along the northern property line in the inter-tidal zone. Smooth Cordgrass (Spartina alterniora) is located just along the waters edge on the northern portion of the property. The shoreline along the northern, western and southern property lines is not bulk-headed, however, there is an existing bulkhead, boat ramp and dock located along the eastern side of the property, adjacent to the unnamed tributary to the AIWW. This bulkhead and the existing eight slip docking structure were permitted under CAMA Major Permit No. 147-02 issued to Homeco Builders, Inc. on November 22, 2002 (See Field Investigation Report dated September 4, 2002). This site was utilized as the spoil disposal area for approximately 4,500 cubic yards of material resulting from the excavation of the channel adjacent to the Harbour Point Development. With the exception of a boat ramp, bulkhead and floating dock system, the site is undeveloped. The waters of the AIWW and Topsail Sound (adjacent to the project) are classified as SA by the North Carolina Division of Water Quality. They are designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries, and they are open to the harvest of shellfish. The Town of Surf City Land Classification Map classifies the upland areas of the project site as Developed. PROPOSED PROJECT The applicant proposes to construct five (5) buildings, four of which would provide for 18 residential town home units, and the other would serve as a community center. In additional to the town home units, the applicant also proposes to construct an access drive, parking areas, utilities and swimming pool. The total disturbed area for the entire project would be 1.4 acres. The density of the proposed project would be 12.9 units/acre. Access to the lots will be provided by the construction of a single driveway from NC Highway 50/210. The road would provide the subdivision with one entrance and exit from Highway 50/210. The drive would extend from the southern end of the property to the northern end with parking on both sides. The applicant proposes to construct a retaining wall (divided into two sections) just inside of the property lines, around the perimeter of the proposed development. The retaining wall would startjust inside of the southern property line, from a point on the eastern side of the proposed access drive. From there, the wall would continue east (approximately 120') and run parallel with the property line on the southern and eastern sides (approximately 180'). The wall would discontinue along the southern edge of the existing boat ramp. The second section of the retaining wall would start from the northwest corner of the existing boat ramp and would run approximately 53' in an easterly direction before turning towards the north and running approximately 110' towards the northeast corner of the property. From there, the retaining wall would run approximately 145' in a westerly direction, paralleling the northern property line. From the northwest corner, the retaining wall would run approximately 273' in a southerly direction along the western property line and would terminate approximately 20' from the bend in the southwest corner of the property. The post construction elevation at the top of the retaining wall would be 9.0'. Backfill material would be placed behind the retaining wall in order to bring the elevation at the site from 4.0' to 9.0' Mean Sea Level (MSL). Tradewinds of Anna Maria, LLC for Harbour Sound Townhomes Page Three Building 1, as indicated on the work plat drawings, measures approximately 50' x 60' (all as measured from the roof line) and would be located in the southeast corner of the property. The applicant is proposing to install an oval shaped swimming pool just north of Building 1. As proposed, the pool would be surrounded by a 5' wide concrete walkway. Building 2 (40' x 50') would be located just north of the swimming pool, adjacent to the existing boat ramp. Building 3 (50' x 100') would be constructed on the northern side of the boat ramp. This building, in addition to Building 2 and the swimming pool, would be located within the 75' Area of Environmental Concern (AEC), but outside of the 30' buffer. Building 4 (50' x 160') would be constructed in the northwest corner of the property and 5 (50' x 60') would be constructed in the southwest corner. Buildings 4 and 5 would run parallel to the western property line. A stormwater infiltration trench is proposed along the southern portion of the property between Building 1 and Building 5. The trench would measure approximately 30' x 110', and would collect stormwater run-off from the proposed town homes, parking areas and driveway. An Express Stormwater Permit (SW8041029) was issued by the Division of Water Quality on 11 /23/2004. Additionally, a Sedimentation and Erosion Control Plan (permit #-Pende-2005-135) has been issued for land disturbance activities. Municipal water and sewer would be provided by the Town of Surf City. As proposed, no portion of the subdivision, including but not limited to the dwellings, eaves, access road, parking areas or swimming pool would impact any portion of coastal wetlands or "404" type wetlands. 10. ANTICIPATED EVIPACTS: The initial grading of the property (for the two proposed town home units, driveway, parking areas and swimming pool) would result in the disturbance of an additional 1.41 acres of high ground. The proposed dwellings, drive, parking areas, and swimming pool would result in the creation of approximately 0.93 acres (40,932 square feet) of impervious surface. Total impervious surface coverage within the 75' Estuarine Shoreline AEC would be 41%.
