Location description: The site is located at 280 Ralph Gwaltney Lane, in Banner Elk, Avery County, NC. Coordinates
are: 36.174869 -81.867439.
Description of projects area and activity: This permit authorizes the after -the -fact installation of culverts and
placement of fill for road access to residential lots for a development known as Red Fox Meadows. Impacts to stream
channels and wetlands authorized by this permit total 291 linear feet of stream channel and 0.063 acre of wetlands. Of
this total permitted impact, approximately 150 linear feet of stream channel and 0.003 acre of wetlands are associated
with recent after -the -fact road crossings. Approximately 0.060 acre of wetland will be excavated/filled to re-establish a
previously existing pond. Temporary impacts include 101 linear feet of stream channel that will be restored as
conditioned below (see Special Condition #1). An existing/historical culvert is located in the proiect area
(approximately 401f) as noted in attached plans which is incorporated in this permit approval (see Special Condition
#2).
Special Conditions:
1. Approximately 101 linear feet of UT -1B1 as shown on the attached plans/maps will be restored to pre -construction
contours through rip rap removal and grading; the riparian buffer should be replanted with native vegetation as
proposed in your trout buffer restoration plan (dated March 14, 2019). All restoration work should be completed by
June 30, 2019.
If additional impacts to waters of the U.S., on/adjacent to this property as part of this development are proposed at a
later date then those impacts will be combined with the current impacts to waters of the U.S. and will be reviewed
cumulatively. Generally, compensatory mitigation will be required if individual or cumulative (i.e. past and present)
losses or degradation of waters of the U.S. are greater than 150 linear feet of stream channel and/or 0.10 acre of
wetland. Please note, due to the current amount of permanent stream impacts on the site (190 linear feet),
compensatory mitigation can be required for any additional/permanent impacts. Additionally, cumulative impacts
that result in the loss or degradation of greater than 300 linear feet of stream channel* and/or 0.5 acre of wetland,
will be processed under an Individual Permit. This verification of the use of the Nationwide Permit Program for this
project does not imply that this office will necessarily approve any future proposal to impact waters of the U.S. on
this property. *The District Commander has the ability to waive the 300 linear foot limit for intermittent stream
channels on a case-by-case basis. All requests for a waiver must be in writing and shall include rationale for the
request.
3. Any future tree clearing or percussive activities on the site should be coordinated with the U.S. Fish & Wildlife
Service, Asheville Ecological Field Office due to the site being located near hibernation sites for the federally
endangered Northern Long -Eared Bat (Myotis septentrionalis). Mr. Hamstead's contact is 828-258-3939 and

Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the
attached conditions, above noted special conditions, and your submitted application and attached information dated
May 6, 2019. Any violation of the attached conditions or deviation from your submitted plans may subject the permittee
to a stop work order, a restoration order, a Class I administrative penalty, and/or appropriate legal action.
This verification will remain valid until the expiration date identified below unless the nationwide/regional authorization is
modified, suspended or revoked. If, prior to the expiration date identified below, the nationwide/regional permit authorization
is reissued and/or modified, this verification will remain valid until the expiration date identified below, provided it complies
with all requirements of the modified nationwide/regional permit. If the nationwide/regional permit authorization expires or is
suspended, revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the
nationwide/regional permit, activities which have commenced (i.e., are under construction) or are under contract to commence
in reliance upon the nationwide/regional permit, will remain authorized provided the activity is completed within twelve months
of the date of the nationwide/regional permit's expiration, modification or revocation, unless discretionary authority has been
exercised on a case-by-case basis to modify, suspend or revoke the authorization.
Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification.
You should contact the NC Division of Water Resources (telephone 919-807-6300) to determine Section 401 requirements.
For activities occurring within the twenty coastal counties subject to regulation under the Coastal Area Management Act
(CAMA), prior to beginning work you must contact the N.C. Division of Coastal Management.
This Department of the Army verification does not relieve the permittee of the responsibility to obtain any other required
Federal, State or local approvals/permits.
