Capps Post Office Box 81 Norlina, N.C. 27563 Dear Mr. Capps: Ain o mwj, IDEHNR Division of Environmental Management April 9, 1996 Subject: Compliance Inspection Report Capps Farm Operation NC Highway 1 Warren County On April 3, 1996, Mr. Steve Mitchell, from the Raleigh Regional Office conducted a compliance inspection of the subject animal facility. This inspection is a part of the Division's efforts to reinspect facilities determined to have potential problems associated with liquid waste disposal systems. Mr. Mitchell's site visit determined that wastewater from your facility was not discharging to the surface waters of the state. No manmade pipes, ditches, or other prohibited conveyances (for the purpose of willfully discharging wastewater) were observed. It was also easily noted that the facility had burnt to the ground, the pigs had been removed, and cattle have been established on the farm. This office would also like to take this opportunity to remind you that if you intend to restock this facility, you are required to have an approved animal waste management plan, by December 1997. This plan must be Certified by a designated technical specialist or a professional engineer. For a listing of certified technical specialists or assistance with your waste management plan you should contact your local Soil and Water Conservation District. If you choose to close out this operation, please solicit assistance from Mr. Larry West. The Raleigh Regional Office appreciates your cooperation in this matter. This inspection is a part of the Division's efforts to determine potential problems associated with liquid waste disposal systems. Mr. Mitchell's site visit determined that wastewater from your facility was not discharging to the surface waters of the state. There were no manmade pipes, ditches, or other prohibited conveyances (for the purpose of willfully discharging wastewater) observed. However, as a result of the inspection, the following management deficiencies were observed: —Your lagoon has little freeboard, less than 12 inches in some areas. This problem should receive prompt attention in order to prevent a future discharge or a lagoon breech. In addition to continued waste facility management, this deficiency must be immediately addressed to help prevent the possibility of an illegal discharge. Please respond to the Raleigh Regional Office with a written response to the aforementioned issue within 30 days of receipt of this letter. You should specifically address how you plan to correct this problem and submit a schedule (with dates) stating when this management deficiency will be corrected. Effective wastewater treatment and facility stewardship are a responsibility of all animal facilities. The Division of Environmental Management is required to enforce water quality regulations in order to protect the natural resources of the State. Accordingly, illegal discharges of wastewater to surface waters of the State are subject to the assessment of civil penalties of up to $10,000 per day, and may also result in the loss of deemed permitted status, requiring immediate submission of a waste management plan. This office would also like to take this opportunity to remind you that you are required to have an approved animal waste management plan by December 1997.
