Facility has not been operational since 1998. This facility's lagoon is in approx. 80 % closed. The majority of the liquid waste has been
applied to adjacient fields. Currently, the owner is working with Wake County Soil and Water during this closure. When weather
conditions permit the owner plans to land apply the remaining sludge. Highly recommend a new waste (sludge) sample should be taken
before application begins. Removal confirmation was requested by the owner.

- Dear Mr. Pippin:
On October 23, 1998, Charles Alvarez from the Raleigh Regional Office conducted a
compliance inspection of the subject animal facility. This inspection is part of the Division's
efforts to determine compliance with the State's animal waste nondischarge rules.
The inspection determined that the swine operation was not -causing any adverse effects on
Waters of the State at the time of the inspection. However, a condition exists that requires
=_ your attention to comply with the Certified Animal Waste Management Plan for your facility.
_
- No current waste analysis was available during the inspection. A waste analysis of
the lagoon must be made within a period of 60 days before or 60 days after the
1 application of swine waste.
Please respond in writing to this office, within 30 days of receipt of this Ietter, outlining your
t - r plans to correct this condition.
The Raleigh Regional Office appreciates your cooperation in this matter. If you have any

I do apologize for overlooking my responsibility to get a waste analysis report
during the time of applying my lagoon water. I will be sure to have regular analysis done
on my lagoon in the future.

This is the same plan that was considered and denied at the last meeting. Since that
meeting, the land planner has provided soils information that indicates that the Barrow
property to the southwest of the site cannot be developed with more than eleven lots,
and therefore according to Sec. 3-4-8 (2)(D)of the, subdivision regulations should not
require a public road stub to that property. In light of this, the proposed plan generally
complies with the standards of the Subdivision Regulations, staff recommends
approval subject to the following condition:
1. Stub roads into adjoining properties will need to' have at least 4 lots fronting
them in order for NCDOT to accept maintenance responsibility.

On August 8, 1997, Mr. Charles Alvarez from the Raleigh Regional
Office conducted a compliance inspection of the subject animal
facility. The inspection is part of the Division's efforts to
determine compliance with the State's animal waste nondischarge
rules.
The inspection determined that your swine operation was not
discharging wastewater into waters of the State and that your waste
lagoons had the required amount of freeboard. As a result of the
inspection the facility was found to be in compliance with the
State's animal waste nondischarge regulations.
Effective wastewater treatment and facility maintenance are an
important responsibility of all animal waste producers. The
Division of Water Quality has the responsibility to enforce water
quality regulations in order to protect the natural resources of
the State.

Senate Bill 1217, An Act to Implement Recommendations of the Blue Ribbon Study
Commission on Agricultural Waste, enacted by the 1996 North Carolina General Assembly,
requires a certified operator for each animal waste management system that serves 250 or more
swine by January 1, 1997. The owner of each animal waste management system must submit a
designation form to the Technical Assistance and Certification Group which designates an
Operator in Charge and is countersigned by the certified operator. The enclosed form must be
submitted by January 1, 1997 for all facilities in operation as of that date. Failure to designate a
certified operator for your animal waste management system is a violation of 15A NCAC 2H
.0224 and may result in the assessment of a civil penalty.
If you have questions concerning operator training or examinations for certification, please
contact your local North Carolina Cooperative Extension Service agent or our office.
Examinations have been offered on an on -going basis in many counties throughout the state for
the past several months and will continue to be offered through December 31, 1996.

under an Animal Waste Operation General Permit. Upon receipt of this letter, your farm has sixty (60) days to submit the
attached application and all supporting documentation. In accordance with Chapter 626 of 1995 Session Laws (Regular
Session 1996), Section 19(c)(2), any owner. or operator who fails to submit an application by the date specified by the
Department SHALL NOT OPERATE the animal waste system after the specified date. Your application must be
returned within sixty (60) days of receipt of this letter. Failure to submit the application as required may also subject your
facility to a civil penalty and other enforcement actions for each day the facility is operated following the due date of the
application.
The attached application has been partially completed using information listed in your Animal Waste Management
Plan Certification Form. If any of the general or operation information listed is incorrect please make corrections as noted on
the application before returning the application package. The signed original application, one copy of the signed application,
two copies of a general location map, and two copies of the Certified Animal Waste Management Plan must be returned to

This letter is being sent to clarify the recordkeeping requirement for Plant Available Nitrogen (PAN)
application on fields that are part of your Certified Animal Waste Management Plan.
In order to show that the agronomic loading rates for the crops being grown are not being exceeded, you
must keep records of all sources of nitrogen that are being added to these sites. This would include nitrogen
from all types of animal waste as well as municipal and industrial sludges/residuals, and commercial fertilizers.
Beginning January 1, 2000, all nitrogen sources applied to land receiving animal waste are required to
be kept on the appropriate recordkeeping forms (i.e. IRR1, ]RR2, DRY1, DRY2, DRY3, SLUR1, SLUR2,
SLD1, and SLD2) and maintained in the facility records for review. The Division of Water Quality (DWQ)
compliance inspectors and Division of Soil and Water operation reviewers will review all recordkeeping during
routine inspections. Facilities not documenting all sources of nitrogen application will be subject to an
appropriate enforcement action.
Please be advised that nothing in this letter should be taken as removing from you the responsibility or
liability for failure to comply with any State Rule, State Statute, Local County Ordinance, or permitting
requirement.

On October 23, 1998, Charles Alvarez from the Raleigh Regional Office conducted a
compliance inspection of the subject animal facility. This inspection is part of the Division's
efforts to determine compliance with the State's animal waste nondischarge rules.
The inspection determined that the swine operation was not -causing any adverse effects on
Waters of the State at the time of the inspection. However, a condition exists that requires
your attention to comply with the Certified Animal Waste Management Plan for your facility.
No current waste analysis was available during the inspection. A waste analysis of
the lagoon must be made within a period of 60 days before or 60 days after the
application of swine waste.
Please respond in writing to this office, within 30 days of receipt of this letter, outlining your
plans to correct this condition.
The Raleigh Regional Office appreciates your cooperation in this matter. If you have any

GENERAL
Calvin Pippin was an integrator with Murphy Family Farms. He owned and operated a1000 feeder to
finish swine production facility. The swine operation had been in existence since 1980 when a 1.4
acre waste treatment lagoon was built. The maximum design treatment & storage capacity was for
1040 animals.
VOLUME OF WASTE TO BE REMOVED
Total liquid & sludge = 1,013,000 gallons
LAND APPLICATION OF WASTE
All waste will be applied at agronomic rates. Waste will be agitated, pumped, and spread over 77.7
acres of land. See attached map for location of fields. Refer to tables 1 and 2 for acres available for
application of waste and the hydrologic loading rates.

1. Waste will be applied in a manner not to exceed the crop nitrogen requirement as outlined
below.
2. All sludge will be removed from the lagoon. Fresh water may need to be added after the
lagoon is agitated and pumped out so that the sludge residue can be removed.
3. Closure of this operation must be done without any runoff of the effluent.
4.. Waste shall not be applied to saturated soils or during rainfall events.
5. Waste shall be applied to actively growing crops and no earlier than 30 days prior to planting a
crop.
6. Waste shall not be applied closer than 100 feet to wells.
7. All disturbed areas must be established in permanent vegetation according to NRCS
standards.
8. All grading when filling in lagoon should be done so that no ponding will take place and
necessary erosion control practices such as terraces or diversions must be installed where
necessary to prevent erosion before vegetation is established.
9. Only soil will be used to fill lagoon. No building debris should be buried in the lagoon.
10.All inlet and devices used to convey animal waste into the lagoon shall be removed before
filling the lagoon.
11. Contractor will keep records on number and amount of waste applied on each field. A copy of
records will be given to NRCS personnel after completion of job.
I agree to close out this lagoon according to the above plan that meets NRCS standards and
specifications.

period of practice installation up to, but not beyond, the first Wednesday in June 2004, and includes all
items pursuant to 15A NCAC 6E .0102 (g).
THE COOPERATOR(S) AGREES TO:
(1) Except as provided in (1)(a) below, not begin installation until approval is given by the NC
Division of Soil and Water Conservation.
a. Provided conditions i-iv are met, the cooperator may choose to exercise the option of
proceeding with installation of best management pra.ctice(s) prior to receiving final
approval from the Division of Soil and Water Conservation.
i. The total amount of the contract does not exceed twenty-five hundred dollars
($2500); and
ii. The best management practices described in the CPO are solely vegetative in
nature; and
iii. The cooperator(s) is not a district supervisor; and
iv. The cooperator (s) has not used this exception prior to this instance during the
program year of the CPO.
Cooperators choosing to exercise this option must initial to acknowledge understanding
of each condition below.
I understand that this contract has not been approved by the Division of Soil
and Water Conservation and that I am proceeding with project installation at the
risk that the Division of Soil and Water Conservation may not approve thfs
contract.
I understand that I will not receive payment for installing practices under this
contract until the NC Division of Soil and Water Conservation has approved the
contract and the request for payment.
i understand that I may not hold the NC Division of Soii and Water. NC
Department of Environment and Naturai Resources, or the District liable for non -
reimbursement of the items below or for the improper installation of the BMP.
(2) Implement the best management practice(s) to the best of his/her ability in compliance with the
rules governing this cost share program and according to the attached Conservation Plan of
Operation (CPO).
(3) Complete 113 of the installation of the Best Management Practice(s) as described in the
attached CPO, as determined by the Wake Soil and Water Conservation District
within the first twelve (12) months following approval of the CPO by the NC Division of Soil and
Water Conservation. Failure to comply with this item will result in the immediate termination of
this Cost Share Contract. Cooperator(s) may request the _Wake_ Soil and Water
Conservation District for a six (6) month extension of this provision to avoid termination of
contract.
(4) Maintain and continue the cost shared best management practices on the attached CPO for the
minimum life set forth by the Soil and Water Conservation Commission, if the cooperator(s) fails
to properly maintain or continue the cost shared practices for their intended use for the life of the
practice, the cooperator(s) shall be required to repair or reimplement the practice within 30 days
(up to one calendar year for vegetative practices) or be required to repay the State of North
Carolina a pro -rated amount of the cost share payment as set forth in 15A NCAC 6E. If the
cooperator(s) abandons the current operation, converts the use of the cost shared practices or
fails to maintain the practices properly, the cooperator(s) will be required to repay to the State of
North Carolina a pro -rated amount of the cost share payment(s) as set forth in the rules
governing this program.
(5) Soil test at least every two years on benefited acres for the duration of the contract maintenance
period. Samples must be submitted to the NCDACS Agronomic Division (or other acceptable
testing facility) and the fertilizer application recommendations followed as closely as reasonably
and practically possible.
(6) As a condition for receiving cost share assistance for waste management systems, have the
waste material analyzed once every year to determine its nutrient content and if the waste is
land applied, to annually submit a soil test sample for analysis of the area of waste application, -
and to apply the waste as close as reasonably and practically possible to recommended fertilizer
rates. If the cooperator(s) fails to have waste and soil analyzed within a prescribed amount of
time as specified by the District, the cooperator(s) will be required to repay to the State of North
Carolina a pro -rated amount of the cost share payment(s) as set forth in the rules governing this
program.
(7) Permit access by Soil and Water Conservation District, Division and Commission
representatives at reasonable times to provide technical assistance and to inspect the practices
during and after implementation for proper installation, maintenance and continuation,
(8) Require any person(s) to whom the benefited acres are transferred by sale, lease or other
means to sign a statement to maintain and continue the cost shared BMPs for the remaining life
of the practice as a condition of the transfer of ownership or control. The cooperator shall give a
copy of the agreement to the District. Failure of the cooperator(s) to secure such an agreement
wili require the cooperator(s) to repay the State a pro -rated amount of the cost share payment(s)
as set forth in the rules governing this program.
(9) Repay the State a pro -rated amount of the cost shared portion of equipment purchased under
this agree lent that Is sold or leased within the maintenance period and further agrees not to
use cost shared equipment as collateral,
THE DISTRICT AGREES TO:
;1) Provide technical assistance for the planning. design. implementation. maintenance. and
certification for all best management practices (cost shared and non cost shared) contained in
the attached conservation plan of operation.
(2) Following District certification that best management practices were properly installed and
implemented, provide to the designated cooperators(s) through the North Carolina Division of
Soil and Water Conservation up to 75% of the average cost for each approved best
management practice contained in the attached CPO, 100% for practices receiving incentive
payments. Payments will be contingent on prior approval by the Division's NPS Section of the
CPO, any Revisions or Supplements, and Requests for Payment.

NC-ACSP-WMP
A waste management plan for the operation which benefits by Agriculture Cost Share
Program CPO # 92-02-32-09 has been developed in accordance with N.C. NRCS
Technical Guide specifications. The waste management plan accounts for the
environmentally safe treatment, storage and application of all animal waste generated
by the operation.
2. The waste management plan includes maps and soil losses of the fields to which animal
waste is to be applied.
The Cooperator(s) have signed, agreed to the conditions of the waste management plan
and received a copy of the waste management plan.
4. A copy of the waste management plan with original signatures is a permanent part of
the District's cooperator file.
5. Any changes to the size or type of animal operation will require that the waste

1. No NCACSP financial assistance was received to install the animal waste system.
2. - The abandoned system has a potential for creating a water quality problem, if the dam is
breached and the effluent is allowed to discharge directly into a water course of the state.
The applicant has requested both technical and financial assistance from the District to
ensure water quality protection.
3. The effluent will be applied in an environmentally safe manner and a waste analysis will be
taken to determine the application rate. A waste management plan will be developed and

During the 1999 session, the North Carolina General Assembly passed a law directing the North
Carolina Department of Environment of Natural Resources (DENR) to develop an inventory and
ranking of all inactive lagoons and storage ponds in the State. In order to meet this directive, a
representative of DENR has recently evaluated the inactive lagoon(s) and/or storage pond(s) on your
property. Inactive lagoons and storage ponds were defined by the Statute as structures which were
previously used to store animal waste but have not received waste for at least one year.
The information collected on your property is contained in the attached field data sheets. Using
this field data, staff ranked your inactive waste structures as high, medium or low according to its
potential risk for polluting surface and/or groundwater. Your waste structure(s) was ranked as

Regardless of their ranking, owners of all waste lagoons and storage ponds have certain
management responsibilities. These include taking appropriate actions to eliminate current
discharges, prevent future discharges and to insure the stability of their structures. Staff of the
Division of Water Quality will be in contact with owners of all inactive structures that have been
determined to pose a serious environmental risk, based on its ranking and/or additional field data
collected by the Department.
All liquids and waste removed from these structures must be land applied at a rate not to exceed
the agronomic needs of the receiving crops. Any major modifications made to the dike walls or
structure must be done in accordance with current standards and under the direction of a technical
specialist designated for structural design. Your local Soil and Water Conservation District is an
excellent source for information and guidance related to proper waste application practices, structure
operation and maintenance, and other related animal waste management standards and/or
requirements.
Nothing in this Ietter should be taken as removing from you the responsibility and liability for
any past or future discharges from your lagoon(s) and/or storage pond(s) or for any violations of
surface water or groundwater quality standards.
