As requested in the applicant's letter dated August 7,2005, the proposed bulkhead and associated filling
activity adjacent to the Little River arc hereby deleted from this project. Any references to this bulkhead
and backfill in the application or attached workplan drawings are hereby deleted.
2)
The section of bulkhead located adjacent to the drainage ditch shall adhere expressly and specifically to
the alignment depicted in the attached workplan drawing dated "revised" 7/5/04. The permittee shall
stake the alignment and have the alignment verified by a representative of the Division of Coastal
Management within a maximum of 30 days prior to the start of any construction. Failure to initiate
construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the
alignment to be re-staked and re-verified within a maximum of 30 days prior to the new expected start
of construction.

ADDITIONAL CONDITIONS
The bulkhcad shall be constructed prior to any backfilling activities.
The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through thc
structure.
The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other
suitable materials approved by department personnel. No excavation or other land disturbing activities
is permitted except for that which shall be required for the construction of the bulkhead wall, riprap,
deadmen cables, etc. This permit does not authorize any excavation waterward of the approved
alignment without permit modification.
The backfill material shall be clean and free of any pollutants except in trace quantities.
Docking Facility/ Boathouse
10)
This permit authorizes only the boathouse, docks, piers, and other structures and uses located in or over
the water that are expressly and specifically set forth in the permit application and attached workplan
drawings. No other structure, whether floating or stationary, shall become a permanent part of this
docking facility without permit modification. No non-\vater dependent uses of structures shall be
conducted on, in or over public trust waters without permit modification.

The pier, boathouse and associated structures shall have a minimum setback distance of 15 feet bet\veen
any parts of the structure and the adjacent property owner's riparian access corridor, which is
determined by drawing a line parallel to the channel or deep water, then drawing a line perpendicular to
the channel line that intersects with the shore at the point where the upland property line meets the
water's edge.
12)
The boathouse shall not be completely enclosed or have side coverage more than one half the height of
the side, from the roof waterward. The footprint of the boathouse shall not exceed 400 square feet as
measured from the drip line.
13)
The authorized boathouse shall be single story, and shall not be designed to allow for second story use.

Thc authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct
view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee
walls are permitted. Lattice is specifically excluded from being used under this authorization.
15) The roof of the covered platform shall not be designed for second story usc.
16) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.

This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitlcd to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
This permit authorizes a total of 6-slips (4 boat slips and 2 jet ski lifts).
Because of the close proximity to the western most property owner and to ensure compliance with
condition #11, an as-built survey shall be performed of the docking facilities, and copies of the survey
provided to the Division of Coastal Management, within 60 days of completion of construction of these
portions of the project.

An Erosion and Sedimentation Control Plan may be required for this project. If required, this
plan shall be filed at least thirty (30) days prior to the beginning of any land disturbing activity.
Submit this plan to the Department of Environment and Natural Resources, Land Quality
Section, 943 Washington Square Mall, \Vashington, NC 27889.
Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed immediately
landward of the bulkead cap and retaining wall cap immediately following completion of backfilling
activities.

ADDITIONAL CONDITIONS
General
The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required,
upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or .
obstructions caused thereby, without expense to the United States or the state of North Carolina. No'
claim shall be made against the United States or the state of North Carolina on account of any such
removal or alteration.

Approval of 401 Water Quality Certification (GC3400) with Additional Conditions
Dear Drs. Jordan:
You have our approval, in accordance with the attached conditions, to place fill material within or
otherwise impact 0.052 acres of waters to construct a bulkhead landward of existing rip-rap, along with a
pier and boathouse, slips, catwalks, platforms and lifts as described in your revised application received
by the Division of Water Quality (DWQ) 401 OversightlExpress Review Permitting Unit on July 25,
2005. After reviewing your application, we have determined that the Division of Water Quality (DWQ)
General Water Quality Certification Number 3400 covers these water impacts. This Certification allows
you to General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). In
addition, you should get or otherwise comply with any other federal, state and local requirements before
you go ahead with your project including (but not limited to) erosion and sediment control regulations
and CAMA. Also, this approval to proceed with your proposed impacts or to conduct impacts to
waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions. If total fills for this project (now or in the future) exceed one acre of
wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A
NCAC 2H .0506 (h). This approval requires you to follow the conditions listed in the attached
certification and any additional conditions listed below.
The Additional Conditions of the Certification are:

2. Certificate of Completion
Upon completion of all work approved within the 40 1 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401 Oversight/Express Review Permitting Unit, North Carolina
Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
3. Water Quality Certification
The proposed project must comply with all of the conditions of General Water Quality
Certification (GC) 3490.
Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon
expiration of the 404 or CAMA Permit.
If you do not accept any of the conditions of this Certification (associated with the approved water
impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you
receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B ofthe
North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a

8. PROJECT SUMMARY: The applicant proposes to construct a bulkhead with backfill in Section 404
Wetlands along a ditch, to construct a shoreline bulkhead and a pier with a boathouse, three slips,
catwalks, platforms and 2 pwc lifts, and to perform landscaping on 1.3 acres.
Proiect Settinq
The site of the development proposal is a lot for a single-family dwelling located at 511 Dances Bay Road (SR
1220), Dances Bay Subdivision, pasquotank County and on the Little River and a ditch tributary of the Little
River. The property is flat with an elevation of approximately 3 feet above normal water level (NWL). The lot is
approximately 1.6 acres in size and has sandy loam Lenoir type soils. The property is vegetated with
indigenous grasses and a few cypress trees along the river shoreline. The river shoreline is irregular and is
approximately 355 feet long and approximately 300 feet of the shoreline has existing unconsolidated riprap. On
the east side of the property is an existing drainage ditch which has a wetland fringe vegetated with common
reed and indigenous grasses and approximately .4 acres in size. The wetland fringe follows the drainage ditch
to the Little River. This area was delineated on December 29, 2004 by a representative of the USACOE. The
shoreline along the drainage ditch is approximately 370 feet long. The ditch does not appear to be navigable
and no traditional use has been established.
The applicant is constructing a single-family dwelling which was authorized by CAMA Minor Permit #0221 05A.
The adjacent property to the west is an undeveloped subdivision lot that has riprap along the shoreline and the
adjacent property to the east is an undeveloped subdivision lot.
The waters of the Little River in this area are classified as SC and are closed to shellfish taking.
Development Proposal
In order to provide shoreline protection, the applicant proposes to construct 275 feet of wooden or vinyl
bulkhead. The bulkhead alignment will be waterward of the existing riprap and have a maximum distance of 9
feet waterward of NWL and an average distance of 3 feet. Approximately 30 cubic yards of backfill will be
placed below NWL for the proposed bulkhead alignment.
The applicant proposes to construct a 325-foot long wooden or vinyl bulkhead along the existing ditch wetland
fringe and backfill .10 acres of Section 404 Wetlands. The proposed bulkhead will connect at the Little River
shoreline with the proposed shoreline bulkhead. The proposed wetland fill area averages approximately 13 feet
wide along the wetland fringe. The purpose of the bulkhead is to prevent erosion and flooding in the yard.
In order to access the water, the applicant proposes to construct a 6-foot wide and 184-foot long pier with a 30-
foot by 16-foot deck (24-foot by 16-foot covered), a 16-foot by 24-foot boathouse, a 20-foot by 4-foot and a 24-
foot by 4-foot catwalk around the boathouse, a 4-foot by 12-foot finger pier, 6 mooring pilings creating 3 slips
and 2 jet ski lifts attached to the proposed pier. The proposed pier location will be approximately 50 feet from
the west side property line. The water depth at the end of the proposed pier is approximately -3 feet below
NWL. After all work has been completed, the applicant proposes to grade the existing upland area and
landscape the lot involving approximately 1.3 acres.

Anticipated Impacts
The proposed shoreline bulkhead will result in approximately 825 square feet of Public Trust Area, Estuarine
Waters Areas of Environmental Concern (AEC) being filled and approximately 7,500 square feet of Estuarine
Shoreline being filled and disturbed by the backfill and grading.
The proposed bulkhead along the ditch and Section 404 Wetland fill will result in approximately 4,356 square
feet of reeds and indigenous grass being filled. This area is located within the Estuarine Shoreline AEC.
The proposed pier structures, including all decks and the boathouse, will result in a total of four new boat slips
and two jet ski slips being authorized and 1,064 square feet of PT A, EW AECs being shaded by the structure.
Three uncovered boat slips will occupy 1,104 square feet of PT A and EW AECs. The proposed landscaping
will result in land disturbance of approximately 1.3 acres of which approximately 36,000 square feet are located
within the ES AEC.
Temporary turbidity will occur during construction.

On May 9, 2005, the Division of Water Quality (DWQ) receive4 your application dated February 1,2005,
to impact 4,356 square feet of wetlands and 825 square feet of estuarine waters to construct the proposed
building, bulkhead, pier, platform, boathouse and retaining wall. The DWQ has determined that your
application was incomplete and/or provided inaccurate information as discussed below. The DWQ will
require additional information in order to process your application to impact protected wetlands and/or
streams on the subject property. Therefore, unless we receive the additional information requested below,
we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will
place this project on hold as incomplete until we receive this additional information. Please provide the
following information so that we may continue to review your project.
Additional Information Requested:
1. Impact Justification (Avoidance and Minimization)
Under 3. Shoreline Stabilization, of the Excavation and Fill section you propose to locate the
bulkhead as much as 9 feet waterward of the existing NWL. This design does not exercise
"avoidance and minimization" and it is the opinion of DWQ that this is not needed. Please resubmit
alternative design approaches utilizing the existing shoreline.
Please respond within three weeks of the date of this letter by sending this information to me in writing
and Tom Steffens of the DWQ Washington Regional Office. If we do not hear from you within three
weeks, we will assume that you no longer want to pursue this project and we will consider the project as
withdrawn.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters
or protected buffers. Please be awarc that any impacts requested within your application are not
authorized (at this time) by the DWQ. Please call Ms. Cyndi Karoly or Mr. John Dorney at 919-733-1786

authorization and a State Water Quality Certification to place fill material within freshwater
wetlands and construct a bulkhead, pier, and boathouse, on property located at 511 Dances Bay
Road, in the Dances Bay Subdivision, adjacent to the Little River, in Pasquotank County, North
Carolina. Your receipt of this letter verifics your acceptance of a valid request for certification in
accordance with Section 325.2(b)(ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section 404 of the Clean
Water Act, and we have determined that a water quality certification is required under the
provisions of Section 401 of the samc law. A Department of the Army permit will not be granted
until the certification has been obtained or waived.
In accordance with our administrative regulations, in most cases, 60 days after receipt of a
request for certification is a rcasonable time for State action. Therefore, if you have not acted on
the request, or asked for an extension of time, by July 18,2005, the District Engineer will deem
that waiver has occurred.

On January 1,2005, we renewed Standard Permit No. 198000291 (copy enclosed), which
provides Federal authorization for construction activities that receive authorization from the Statc
of North Carolina.
A review of your application received May 9, 2005, for Department of the Army (DA)
authorization to place fill material within freshwater wetlands and construct a bulkhead, a pier,
and a boathouse, on property located ~ 1 Dances Bay Road, adjacent to the Little River, in the
Dances Bay Subdivision, in Pasquotank County, North Carolina, indicates it to be a candidate for
Federal authorization under this permit. Accordingly, the administrative processing of your
application will be accomplished by the North Carolina Division of Coastal Management.
Comments from Federal review agencies will be furnished to the State.
If your application must be withdrawn from this permit process for any reason, you will be
informed regarding its further management. If there arc no unresolved differences in Stat~-
Federal positions or policies, thc final action taken on your application by the State will result in
your receiving written notice from us that your application is consistent with the Federal permit
and you may commence your activity. Onlv after receiving such confirmation should vou begin
work.
On February 6, 1990, thc DA and the U.S. Environmcntal Protection Agency (EPA) signcd
a mcmorandum of agreement (MOA) establishing procedures to determine the type and level of
mitigation necessary to comply with the Clean Water Act Section 404(b)(l) Guidelines. This
MOA provides for first, avoiding impacts to waters and wetlands through the selection of the
least damaging, practical altcrnative; second, taking appropriate and practical steps to minimizc
impacts on waters and wetlands; and finally, compensating for any remaining unavoidable
impacts to the extent appropriatc and practical. To enable us to process your application in full
compliance with this MOA, we request that you provide the following additional information:

a. Permits for work within wetlands or other special aquatic sites are available only if the
proposed work is thc least environmentally damaging, practicable alternative. Please furnish
information regarding any other alternatives, including upland alternatives, to the work for which
you have applied and provide justification that your selected plan is the least damaging to water
or wetland areas.
b. It is necessary for you to have taken all appropriate and practical steps to minimize
wetland losses. Please indicate all that you have done, especially regarding development and
modification of plans and proposed construction techniques, to minimize adversc impacts.
c. The MOA requires that appropriate and practical mitigation will be required for all
unavoidable adverse impacts remaining after all appropriate and practical minimization has been
employed. Please indicate your plan to mitigate for the projected, unavoidable loss of waters or
wetlands or provide information as to the absence of any such appropriate and practical
measures.
This information is essential to our expeditious processing of your application and it should
be forwarded to us by May 31,2005. Also, a copy of this information must be sent to the North
Carolina Division of Environmental Management to enable them to adequately evaluate your
application for a Water Quality Certification pursuant to Section 401 of the Clean Water Act.
