In a file review, for the project with the US Army Corps of Engineers (USACE), it was discovcrcd that a Nationwide 18 was issued to James Hobbs on January 29, 2003. The projcct did require a corresponding 401 Watcr Quality Certification from the Division of Water Quality (DWQ) PRIOR to the work conm1encing. Since the work has already been completed and the USACE Permit has expired, we are sending you the General Certification as an after-the-fact notification. If you did not comply with ALL these conditions, we request that you notify this Officc immediately to let us rcsolve the outstanding issues. PROJECT DESCIUPTION: The Royal Palms subdivision is located adjacent to Turkey Creek, along Tar Landing Road, near Holly Ridge and Sneads Ferry, Onslow County, To get to the proposed site from Wilmington, head north on US Hwy 17. Turn right on Old Folkstone Road in Holly Ridge. Continue along Old Folkstone Road and turn right onto Tar Landing Road. The property will be located at the terminal end of Tar Landing Road, on the left hand side of the street (dead end). The property is approximately 78.71 acres in size with approximately 2,000 linear feet of water frontage. Elevation at the property varies from 2' -35' above Mean Sea Level. Both residential and agricultural properties surround the property to the north, west and south and Turkey Creek borders the property to the cast. The highground portion of the tract has vegetation that consists of Live Oaks (Quercus virginiana), Catbriar (Smilax sp.), Red Cedars (Jllllipents virginian a), Wax myrtles (Myrica cerifera), Long-leaf Pines (Pinus palustris), Hickory (Cal)'a sp.) and Maples (Acer ntbnlln). The eastern portion of the property consists of "404 type" wetlands and coastal marsh. The wetland area is separated by a mosquito ditch, which runs parallel to Turkey Creek. The mosquito ditch runs the entire length of the property from north to south along the far eastern side, adjacent to Turkey Creek. Coastal wetlands vegetation consists primarily of Smooth Cordgrass Marsh (Spartina altemiflora) and Black Needle Rush (Juncus roemarianus). Upper coastal wetlands species such as Salt Grass (Distich/is spicata), interspersed with Sea Lavender (Limoium carolinanum), Salt Mcadow Hay (Spartina patens) and Sea Ox-eye (Borriclliafnttescens) complete the transitional area to the high ground. There are no other piers/docking systems in the immediate vicinity of the proposed dock. Proposed density of the subdivision, once fully developed, would be 39-units at 0.5 units per acre. Prior to submittal of this CAMA Major permit application for dock construction, the applicant contacted the Division of Coastal Management and inquired about obtaining a CAMA permit for the proposed subdivision development. The proposed development was determined to be outside of any Area of Environmental Concern (AEe), and therefore, no permit authorization was required. As such, the applicant developed the high ground portion of the property by installing roads, utilities and wetlands crossings, which were approved under the Corp of Engineers Nationwide 18 permit (Action ID#20020 1168). No further subdivisionihigh-ground work is being proposed as part of this permit application submittal. The waters of Turkey Creek, adjacent to the proposed project area, are classified "SA-ORW" by the Division of Water Quality. This section of the Turkey Creek is designated as a Primary Nursery Area by the Division of Marine Fisheries. According to maps provided by Shellfish Sanitation, the area to the south is OPEN to the harvesting of shellfish and the area to the north (headwaters) is CLOSED. PROPOSED PROJECT: The applicant is proposing to construct a nine-slip community pier and docking system to accommodate the residents of the subdivision. The proposed pier would begin from a 6' x 148' concrete walkway located along the eastern side of Royal Palms Way (entrance drive into the Subdivision) within the boundaries of the common area, between Lots 6 and 7. The concrete walkway would terminate just before the landward edge of the "404 type" wetlands line and would give way to a 6' x 1266' elevated wooden pier. The pier would extend towards the east, crossing a vast area of "404 type" and coastal wetlands before terminating at a 14' x 14' gazebo. A 6' x 140' elevated dock spine/platform would be located on the waterward side of the proposed gazebo. The spine would run parallel to Turkey Creek, or north to south, and would be within the community area riparian corridor. Five 4' x 24' elevated finger piers would connect to the spine and would run perpendicular to the channel, or west to east. As proposed, water depths at the terminal end of the finger piers would range from -1.0' to -1.4' at Mean Low Water and 2.8' to 3.2' at Mean High Water. Coastal Colorado Development, LLC Page Three 10. ANTICIPATED IMPACTS The proposcd pier and docking system would incorporate approximately 1,516 sq ft of cstuarine waters and public trust area. Slight increases in turbidity should be expected during construction, howevcr no long tcrm impacts arc anticipated. According to the application package, the proposcd picr and docking systcm would be locatcd within 'l4 of the width of the water body and would not extend beyond the near shore edge of the navigation/crcek channel. Water depths in the vicinity of the docking system are relatively shallow and boat dockage within the proposed slips may impacts shallow bottom areas.
