In response to youdetter dated May 12, 1997, i have performed the following actions.
1. Lagoon was agitated and pumped, lowered approximately 6 feet.
2. Have discussed with Shelton Baker, local agent, about amending waste
closure plan. We have already planted approximately 30 acres of Sorgum
Sudan, and are waiting approval from Mr. Baker to continue with closure
plan.
Please advise if necessary.

This is to acknowledge receipt of your request that your facility no longer be registered as an animal waste
management system per the terms of 15A NCAC 2H .0217. The information you provided us indicated that your operation's
animal population does not exceed the number set forth by 15A NCAC 2H.0217, and therefore hoes not require registration
for a certified animal waste management plan.
Under,15A NCAC 2H.0217, your facility is deemed permitted if waste is properly managed and does not reach the
surface waters of the state. Any system determined to have an adverse impact on water quality may be required to obtain a
waste management plan or an individual permit. You are reminded that a discharge of wastes to the surface waters of the state
will subject you to a civil penalty up to $10,000 per day.
. Should you decide to increase the number of animals housed at your facility beyond the threshold limits listed below,
you will be required to obtain a certified animal waste management plan prior to stocking animals to that level. Threshold
numbers of animals which require certified animal waste management plans are as follows:
Swine 250
Confined Cattle 100
Horses 75
Sheep 1,000
if Poultry with a liquid wastes stem 30,000

Dear Mr. Edwards:
On May 9, 1997, Mr. Buster Towell from the Raleigh Regional Office
conducted a compliance inspection of the subject animal operation.
This inspection is a part of the Division's effort to determine
compliance with the State's Animal Waste Management Regulations.
Mr. Towell's site visit determined that wastewater from your
facility was not actively discharging to the surface waters of the
State, nor were any manmade pipes, ditches, or other prohibited
conveyances (for the purpose of willfully discharging wastewater)
observed. However, as a result of the inspection, the following
deficiency was observed:
Your'waste lagoon had only 6 inches of freeboard which is less
than the amount required. Animal waste lagoons are required to
maintain enough freeboard so that no discharge of wastewater will
occur to waters of the State during any rainfall event less severe
than a 25 year\24 hour storm.
Your waste utilization plan states that waste will be applied to
wheat. The typical months of application for wheat are from
November to April. Your plan should be ammended so that the crop to
receive the waste will be able to take up the necessary amount of
nitrogen and also insure that no discharge will occur from over
application.
The above matters should be addressed to prevent the possibility of
an illegal discharge. Please respond to this Notice within 30 days
of receipt. You should include in your response the actions that
you will take to address these deficiencies.

This office would like to remind you that you are required to
submit an approved animal waste management plan by December 31,
1997, or you may choose to submit a closure plan for this facility.
These plans must be Certified by a Designated Technical Specialist
or a licensed Professional Engineer. For a listing of certified
technical specialists or assistance with your waste management plan
you should contact your local Soil and Water Conservation District
Office.
The Raleigh Regional Office appreciates your cooperation in this
matter. If you have any questions regarding this inspection please
call Buster Towell at (919) 571-4700.

Subject: Compliance Inspection
Abandoned Swine Operation
SR 1919

Dear Mr. Barham:
On October 10, 1995, Mr. Eric Fleek and Mr. Danny Smith from
this office conducted a compliance inspection of the subject
facility. This inspection is a part of the Division's efforts to
determine potential problems associated with waste disposal
systems.
On November 2, 1995, Mr. Eric Fleek spoke to Ms Peggy Greene
in regards to who was in possession of the land. Ms. Greene
informed Mr. Fleek that the land had until very recently been
deeded to you. However, Ms. Greene also stated that at the time of
deed exchange, she would pay you $100.00 to execute the transfer of
ownership. At the time of this letter, the $100.00 has not been
paid and therefore, since the ownership of this facility is
currently less than clear, you and Ms. Greene are both receiving
copies of this letter.
During the inspection, the following items were noted that require
action to prevent possible environmental impacts:
1. We recommend that the lagoon be satisfactorily closed out
to prevent potential environmental impacts, and to protect you
from liabilities associated with the lagoon. We recommend
that the lagoon be pumped out and sprayed on areas to take up
the nutrients. Spraying may continue as long as dry
conditions permit (no spraying when raining or when fields are
saturated). The wastewater must not be allowed to reach
surface waters (i. e. creeks, streams, canals, etc.). After
all liquid and sludge has been pumped out, the lagoon may be
left intact to serve as a pond, or the dam may be broken to
prevent accumulation of stormwater.
