To follow up on our most recent phone conversation on December 4, 2003:
HB 515 Section 1. 1 (b): Exceptions. - - The moratorium established by subsection (a) of this section does
not prohibit: (6) Construction or expansion, if the person undertaking the construction or expansion of
the swine farm, lagoon, or animal waste management system has, prior to I March 1997, either:
a. Laid a foundation for a component of the swine farm, lagoon, or animal waste management
system. (please see attachment)
b. Entered into a bona fide written contract for the construction or expansion of the swine farm,
lagoon, or animal waste management system.
c. Been approved for a loan or line of credit to finance the construction or expansion of the
swine farm, lagoon, or animal waste management system and has obligated or expended
funds derived from the loan or line of credit.

Please note that all WUP revisions must be signed and dated by both the owner and the technical
specialist. Please reference the subject permit application number when providing the requested
information. All information should be signed, sealed, and submitted in duplicate to my attention at the

or the Division will return your application as incomplete in accordance with .15A N.C.A.C. 2H.0200
and your facility will be considered to be operating without a permit.

To ensure staff are using consistent definitions for new and expanding swine
farms during the moratorium. enacted by 1113 515, 1 would like to set a general definition
for "laid -a foundation." A definition for " new" and "expanding" as used in the Swine
Farm Siting Act for all swine farms is also needed.
"Laid a foundation" as used in Section 1.1(b)(6)a. shall mean for a swine house
that concrete has been poured for the foundation; and for a lagoon that the excavation was
completed by March 1, 1997. Embankments, liners, etc.. will not be considered part of
the foundation for a lagoon.
" NeV' and " expanding" as used in the Swine Farm Siting Act shall mean a new
swine farm or an' expansion of the waste management system that requires permitting.
The expansion of a waste management system means above the current certified or
permitted capacity. It will not mean new construction of any component of the swine
farm — i.e. a new house or lagoon to replace an existing one. This would not restrict a
farm from building additional houses to increase the population to that contained in a
Certified Animal Waste Management Plan, provided this increase would not require a
permit.
Using the same definition for "new" and "expanding" for the Swine Farm Siting
Act and for permitting will keep the definitions consistent — if it requires a permit because
it is new or expanding, the facility will be required to meet the new siting criteria. Since
the Swine Farm Siting Act stands on its own merits, these definitions will be used as
policy for our staff only with respect to permitting. Swine operations may use these
definitions as guidance; howeveri- it should be.- with the understanding that it may not
influence court decisions resulting from suits brought about by affected parties.

I have observed the site and discussed the proposed operation with Mr. Westbrook on September 16, 2003.
The site appears suitable for location of a swine operation of the size and type indicated in the permit
application. There are no site limitations apparent based on the area indicated by Mr. Westbrook for the
new operation. The facility appears to have adequate land for the hog structures with apparent easy access
to suitable crop land available in proximity to the proposed building site for adequate wastewater disposal.
It appears per my brief review that Mr. Westbrook has meet the conditions stipulated in SB 1217 that will
exempt him from the moratorium for new operations. Thus the Raleigh Regional Office is not aware of
any restrictions that would inhibit the construction of this facility as is proposed.

Additional information is required before we can continue our review. Please address the following by
September 27, 2003:
The irrigation parameters are not listed in your Waste Utilization Plan (WUP). Please list
the parameters and resubmit. Irrigation events are to be listed in the WUP as the maximum
application allowable for that soil type from the time the pumps are turned on until the time
they are shut off, It is currently recommended that total application amounts not exceed one
inch in any application event for any soil type. If the rates exceed the recommended one
inch, please have your Technical Sp�cialist justify the increased application rate in the
narrative of your WUP. 0
2. Your WUP lists yields higher than information available to the Division of Water Quality
suggests. Please contact your technical specialist to review the Waste Utilization Plan and
provide documentation that supports the yield as shown in the current WUP or revise the
WUP. Please note that all WUP revisions must be signed and dated by both the owner and
the technical specialist.
3. Best Management Practices (BMPs) that are to be implemented at this facility should be
identified (check the appropriate BMPs) on the Insect Control Checklist, the Odor Control
Checklist and the Mortality Management Checklist. Please submit these when completed.
4. Please provide a clear map that identifies (outlines or highlights) and shows the amount of
acreage for each field to be used for waste application. Please label the Tracts and Fields to
match the listed Tracts and Fields in the Waste Utilization Plan.
5. Please include in your Waste Utilization Plan (WUP) a copy of the required NRCS
Standard specifications.
6. Please submit an Emergency Action Plan to include emergency contact phone numbers.
7. If any land is being leased for waste application, please submit a lease agreement. VNX

In the winter of 1994 1 began the process of trying to build a pig nursery o eratio
on my farm. I consulted with the Johnston Soil and Water Conservation Service in order
for them to develop a plan for the lagoon and the hog house site. Mr. Chris Smith was
the agent who came to my farm and designed the plan for the operation.
I purchased part of my family's farm in 1994 in order to begin the process of
construction. I had to clear a portion of the land to make the hog lagoon and houses. I
contracted with Dick Baker Construction Company to do the work. He bulldozed the
area in the month of May and came to complete the job in the month of July. The hog
lagoon would then be able to be built according to the Johnston County Soil and Water
Conservation specifications. At this time I had spent $2400 for Mr. Baker to clear the
land.
In the winter and spring of 1994, 1 consulted with several integrators to decide
which company I could build with. Cargill, a business which has now left the area, was
the one which I was seriously considering. However, with the demands of the farming in
the spring of 1994, along with my father's recent illnesses at that time, I felt that I could
not complete the hog operation, Now years later, I have come to a point in my career that
I would like to pursue these earlier plans. I am a small tobacco farmer who would needs
to diversify my operation of farming. In these hard economic times and uncertain future
for tobacco, I would like to pursue seriously the hog operation plans that I began in 1994.
After talking to DWQ (Division of Water Quality) in Raleigh, I learned that I still
may be permitted for a pig nursery site, After talking with Sue Homewood fi7om DWQ, I
then re -consulted with Chris Smith who is working with Natural Resource Conservation
Service in Goldsboro. He remembered doing the work on this site and felt that it could
be pursued to see if the operation could be built now. After reading the new requirements
for a hog operation site, I then talked to my neighbors who have signed written
permission to continue with the building at this time. Mr. and Mrs. Paul Lee's property
line is closer than 500 feet, yet they readily have signed their agreement for me to build a
hog operation if I am given permission from DWQ, Mr, Lee's sister, Lois Lee, has a
residence within approximately 1700 feet from the site, She also has signed permission
for me to build as well. My mother and heirs, on the other side of the property, have
signed for permission for me to build also.
Enclosed are copies of the signed permission forms as well as the bank deposits
and the bill from Dick Baker's Construction Co for the clewing of the land. I want to
build a pig nursery operation as I had planned in 1994. Please keep in mind that I am a
small farmer of around 15 acres of tobacco and would appreciate your favorable
consideration in this situation. Thank you for your prompt attention to this matter.

not have a CAWNT, it must be completed prior to submittal of a general pemiit application for

3.3.2 A hazard classification of the proposed lagoons, if required.
3.3.3 Documentation showing that proposed swine facilities meet the requirements of the Swine Farm Siting Act
including a site map prepared by a Registered Land Surveyor. The scale of this map shall not exceed I inch
400 feet. At a minimum, the site map shall show the distance from the proposed houses and lagoons to
occupied residences within 1500 feet, schools, hospitals, churches, outdoor recreational facilities, national
parks, state parks, historic properties, or child care centers within 2500 feet, property boundaries within 500
feet, water supply wells within 500 feet. The map shall also show the location of any property boundaries, and
perennial streams or rivers located within 75 feet of waste application areas.
3.3.4 Documentation showing that all adjoining property owners, all property owners who own property located
across a public road, street, or highway from the facility, the local health department, and the county manager
or chair of the county board of commissioners if there is no county manager, have been notified by certified
mail of your intent to construct or expand a swine farm at this location.
3.3.5 A wetlands determination.
3.3.5 A map showing the topography of the proposed facility location showing features that affect facility design, the
dimensions and elevations of any existing facilities, the fields used for waste application, and areas where
surface runoff is to be controlled.
3.3.6 The lagoon/storage facility deiign.
3.3.7 Proposed runoff control measures, if required
3.3.8 Irrigation or other land application method design.
3.3.9 The Waste Utilization Plan (W'UP) must include the amount of Plant Available Nitrogen (PAN) produced and

4. Surface Water Classification. This form must be completed by the appropriate DWQ regional office
and included as a part of the project submittal information.
INSTRUCTIONS TO NC PROFESSIONALS:
The classification of the downslope surface waters (the surface waters that any overflow from the facility would flow
toward) in which this animal waste management system will be constructed must be determined by the appropriate DWQ
regional office. Therefore, you are required, prior to submittal of the application package, to submit this form, with
items I through 7 completed, to the appropriate Division of Water quality Regional Water Quality Supervisor (see page 5 of
5). At a minimum, you must include an 8.5" by I V copy of the portion of a 7.5 minute USGS Topographic Map which
shows the location of this animal waste application system and the downslope surface waters in which they will be located.
Identify the closest downslope surface waters on the attached map copy. Once the regional office has completed the
classification, reincorporate this completed page and the topographic map into the complete application form and
submit the application package.

OPERATION AND MAINTENANCE PLAN
------------------------------
This lagoon is designed for waste treatment with minimum odor
control. The time required for the planned fluid level to be
reached may vary due to soil condi tions,f lush ing operations, and
the amount of fresh water added to the system.
Land application of waste water is recognized as an acceptable
method of disposal. Methods of application include solid set,
center pivot, guns, and traveling gun irrigation. Care should be
taken when applying waste to prevent runoff from the field or damage
to crops.
The following items are to be carried out:
1. It is strongly recommended that the treatment lagoon be pre -
charged to 1/2 its capacity to prevent excessive odors during
start-up. Pre -charging reduces the concentration of the initial
waste entering the lagoon thereby reducing odors. Solids should be
covered with effluent at all times.
2. The attached waste utilization plan shall be followed. This
plan recommends sampling and testing of waste (see Attachment 8)
before land application.
3. B g n pump -out of the lagoon when fluid level reaches eleva-
t ion ��' )CI L as marked by permanent markers. Stop pump -out when
the f luid level reaches elevat ion Pr before f luid depth is
less than 6 feet deep (this prevents the loss of favorable
bacteria)
4. The recommended maximum amount to apply per irrigation is
one (1) inch and the recommended maximum application rate is 0.4
inch per hour.
5. Keep vegetation on the embankment and areas adjacent to the
lagoon mowed annually. Vegetation should be fertilized as needed
to maintain a vigorous stand.
6. Repair any eroded areas or areas damaged by rodents and
establish in vegetation.
7. All surface runoff is to be diverted from the lagoon to stable
outlets.
8. The Clean Water Act of 1977 prohibits the discharge of
pollutants into waters of the United States. The Department of
Environment, Health, and Natural Resources, Division of Environ-
mental Management, has the responsibility for enforcing this law.

Your animal waste management facility has bee n designed for a
given stcrage capacity- When the�waste reaches the designed
level, it must be land applied at a specified rate to prevent
pollution of surface and/or ground water. The plant nutrients
in the animal waste should be used to reduce the amount of
commercial fertilizer required for the crops on the fields
where the waste is to be applied. This waste utilization plan
uses nitrogen as the limiting nutrient. Waste should be
analyzed before each application cycle.and annual soil tests
are encouraged so that all plant nutrients can be balanced for
real.istic yields of the crop to be grown.
Several factors are important in implementing your waste
utilization plan in order to maximize the fertilizer value of
the waste and to ensure that it is applied in an
environmentally safe manner. Always apply waste based an the
needs of the crop to be grown and the nutrient content of the
waste. Do not apply more nitrogen than the crop can utilize.
Soil types are important as they have different infiltration
rates and leaching potential. Waste shall not be applied to
land eroding at greater than 5 tons per acre per year. Do not
apply waste on saturated soils or an land when the surface is
frozen. Either of these conditions may result in runoff to
surface waters. Wind conditions should also be considered to
avoid drift and downwind odor problems. To maximize -the value
of nutrients for'cr . op production and to reduce the potential
for pollution, -.the waste should be applied to a growing crop or
not more than -30'.days prior to planting. Injecting the waste
or disking will conserve nutrients and reduce odor problems.
The acres needed to apply the animal waste is based on typical
nutrient content for this type of facility. Acreage
requirements may be more or less based on the waste analysis
report from your waste management facility.
