Any violation of these terms may be subject to fines,' imprisonment or civil action; or may cause the permit to be null and void. Shoreline Stabilization 1) As indicated on the attached workplan drawings, the bulkhead alignment shall connect at the applicant's property line on the northwest side and across the mouth of the boat ramp area to the existing bulkhead corner on the applicant's property. 2) The alignment of the permitted bulkhead shall be staked by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of any construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of construction. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. No excavation or other land disturbing activities is permitted except for that which may be required for the construction of the bulkhead wall, riprap, deadmen cables, etc. This.permit does. not authorize any excavation waterward of the approved alignment. 6) The backfill material shall be clean and free of any pollutants except in trace quantities. 7) All fill material to be placed below normal water level shall be confined behind the permitted bulkhead. General NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal water level. NOTE: The N.C. PROJECT SUMMARY: The applicant proposes to close off an existing boat ramp with a new bulkhead and backfill. FIELD INVESTIGATION REPORT Mary L. Perschy Page 2 PROJECT SETTING The project site is located at 165 Walnut Island Blvd., Walnut Island Subdivision, Grandy, Currituck County and adjacent to the Currituck Sound. The property consists of three contiguous lots-1, 2 and 19 that have a combined area of 12,937 square feet. The property is flat, has an elevation of approximately 3 feet above normal water level (NWL) and has sandy soils. The property is vegetated with lawn grasses and shrubs. Man-made features on the property consist of a mobile home set on a permanent foundation, a swimming pool, a small single-family dwelling, a concrete boat ramp and a shoreline bulkhead. The property has approximately 160 feet of bulkhead of which, approximately 35 feet front the Currituck Sound. The property has a small triangular shaped bay-like area where the boat ramp is located. Bulkhead walls on each side of the boat ramp have been constructed along the shoreline. The bulkhead wall connecting to the adjacent property to the northwest is approximately 60 feet long and the bulkhead wall connecting to the applicant's bulkhead on the Currituck Sound is approximately 65 feet long. The mouth of the bay-like area is approximately 56 feet wide and the water depths range from 0 to 1-1/2 feet deep. The adjacent property to the east is an undeveloped subdivision lot that has a shoreline bulkhead and the adjacent property to the northwest is an undeveloped subdivision lot with a partial bulkhead and relic riprap. The waters of the Currituck Sound in this area are classified SC and are closed to shellfish taking. DEVELOPMENT PROPOSAL The applicant has experienced shoaling and trash deposition in the boat ramp area and she no longer uses the boat ramp. The applicant proposed to construct a bulkhead to connect at the corner of her property line on the northwest side and across to the mouth of the bay to the existing bulkhead corner on the Currituck Sound. The proposed bulkhead will be approximately 56 feet long and will require approximately 116 cubic yards of fill material below NWL for backfill. The maximum distance waterward of NWL for the proposed bulkhead is 52 feet. FIELD INVESTIGATION REPORT Mary L. Perschy Page 3 ANTICIPATED IMPACTS The development proposal will result in approximately 2,400 square feet of Public Trust Area, Estuarine Water Areas of Environmental Concern and 400 square feet of Estuarine Shoreline AEC being filled. While no submerged aquatic vegetation (SAV) was observed at the site, the Currituck Sound has several large areas of SAV beds sound wide.
