This permit authorizes a maximum of 14 total boat slips. At no time shall more than 14 vessels be
docked or moored at this facility without permit modification. The restriction of the number of vessels
shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and
personal watercraft.
2)
No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
marina. Any sewage discharge at the marina shall be considered a violation of this permit for which the
permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence
of the permitted structure.

ADDITIONAL CONDITIONS
This permit authorizes only the structure and uses located in or over the water that are expressly and
specifically set forth in the permit application. No other structure, whether floating or stationary, shall
become a permanent part of this marina without pelmit modification. No non-water dependent uses of
structures shall be conducted on, in or over public trust waters without pemlit modification.
No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
6)
The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee shall not be relieved of this requirement if he/she abandons
the permitted activity without having it transferred to a third party.
This permit does not authorize the interference with any existing or proposed Federal project, and the ~
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury ~t
which may be caused from existing or future operations undertaken by the United States in the public 1
~
interest.
The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
NOTE:
It is strongly recommended that the permittee exercise all available precautions in the day-to-day
operation of the facility to prevent facility waste from entering the adjacent waters. Such
discharge, either directly or indirectly, to adjacent waters could contravene state water quality
standards, thereby violating state law.
General
The permittee understands and agrees that, if future operations by the United States' requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be
made against the United States or the state of North Carolina on account of any such removal or
alteration.
No vegetated wetlands or open water areas shall be excavated or filled, even temporarily.

approvals or authorizations that may be required. I
Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 946-6481 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non-water
dependent activities are not authorized within 30 feet of the normal water level.
The permittee and/or his contractor is urged to meet with a representative of the Division prior to
project initiation.

Approval of 401 Water Quality Certification (GC3490) with Additional Conditions
Dear Ms. CoCo:
You have our approval, in accordance with the attached conditions, to place fill material within or
otherwise impact acres 0.0 ISof waters to install ten new boat slips, build a boardwalk and extend the
existing pier as described in your application received by the Division of Water Quality (DWQ)
Wetlands/401 Unit on April 2S, 2005. After reviewing your application, we have determined that the
Division of Water Quality (DWQ) General Water Quality Certification Number 3490 covers these water
impacts. This Certification allows you to General Permit No. 198000291 when issued by the US Army
Corps of Engineers (USACE). In addition, you should get or otherwise comply with any other federal,
state and local requirements before you go ahead with your project including (but not limited to) erosion
and sediment control regulations and CAMA. Also, this approval to proceed with your proposed
impacts or to conduct impacts to waters as depicted in your application shall expire upon
expiration of the 404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions. If total fills for this project (now or in the future) exceed one acre of
wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A
NCAC 2H .0506 (h). This approval requires you to follow the conditions listed in the attached
certification and any additional conditions listed below.
The Additional Conditions of the Certification are:

2. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality,
1650 Mail Service Center, Raleigh, NC, 27699-1650.
3. Water Quality Certification
The proposed project must comply with all of the conditions of General Water Quality
Certification (GC) 3490.
Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon
expiration of the 404 or CAMA Permit.
If you do not accept any of the conditions of this Certification (associated with the approved water
impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you
receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the
North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a
hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

The project site is located off SR 1401 at Tuscarora Beach, on the Chowan River near
Winton in Hertford County, North Carolina. The cun'ent use of the site is a docking facility,
campground, and restaurant, with associated recreational activities. On the same property, CAMA
Major Permit 56-96 was issued on 15 April 1996 to SRF, Inc. for the construction of a boat ramp,
275' of bulkhead and four finger piers. The total number of slips proposed under the aforementioned
CAMA Major Permit was 21. All work under the previous permit had been completed prior to the
fall of2003.
The facility was an active marina prior to Hurricane Isabel. Hurricane Isabel destroyed all but
four boat slips. The property owner received a Storm General Permit (7H .2500) for the replacement
of 1 0 boat slips. The owner was unable to initiate development activities prior to the expiration of the
General Permit, which was 22 September 2004. The project area is bordered on the downstream (east
end) by a developed lot, which includes a bulkhead and pier. The project area is bordered on the
upstream (west side) by a developed lot that contains remnants of a pier. The elevation of the tract
ranges from :1::2' above water level adjacent the Chowan River to an elevation of :1::25' above the water
level approximately 100' landward of the shoreline. A portion of the shoreline (:1::280 linear feet) is
stabilized with a bulldlead. The remaining portion of the shoreline is used as a recreational beach. A
fuel pier, a 4-slip pier structure, 2-boat ramps, a residence, parking lot, campground, and restaurant
are present on the site. The fuel pier is :1::4' wide by :1::60' long and the 4-slip pier is :1::8' wide by :1::80'
long with a :1::20' bY:1:: 10' platform. The adjacent properties are of similar contour, primarily vegetated
with mixed hardwoods, pines, lawn grasses and ornamental shrubs.
The Chowan River is classified as B NSW by the Enviromnental Management Commission
at the project site. The Chowan River is Joint waters and is not open to shell fishing.
Project description
The applicant proposes to extend the existing :1::4' wide by :1::60' fuel pier an additional 20'.
Also, the applicant proposes to construct a :1::6' 10" wide by :1::90' long floating pier with six - 4' 10"
by 19' 6" finger piers for the purpose of creating 1 0 fixed boat slips. Additionally, the applicant
proposes :1::8' wide by :1::280' long boardwalk on the landward side of the bulkhead.

This letter is a request for a major permit as per our discussion on 4 November 2004
Prior to Hurricane Isabel we had 22 slips for boats. After the hurricane we had 4 slips that are
located on the restaurant pier. We are trying to obtain a major permit to install 10 new slips;
this will give us a total of 14. Also in the permit we are applying to build a walkway or boardwalk
inland from the current bulkhead this will extend the entire length of the bulkhead 280 ft. This
will not protrude into the water area as it will be 8 ft from the bulkhead inland. We would also
like to extend the current fuel pier 20 ft. This will allow for safer embarking and disembarking of
boats from the boat ramp. We will be removing the gas pump this year due to poor sales.
