Box 3136 Greensboro, NC 27402-3136 APPROVAL of 401 Water Quality Certification with Additional Conditions Dear Mr. Wyatt: The City of Greensboro has our approval, in accordance with the attached conditions, to place permanent fill in 17 linear feet of perennial stream for the purpose of replacing an existing culvert, and to place temporary fill in 30 linear feet of perennial stream for the purpose of installing gravity sewer lines, in the Westminster Gardens Cemetery in Greensboro, Guilford County, as described in your application received by the Division of Water Quality (DWQ) on April 25, 2005. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Numbers 3374 and 3494, which can be viewed on our web site at http://h2o.enr.state.nc.us/ncwetlands. These Certifications allow you to use Nationwide Permit Numbers 12 and 3 respectively when they are issued by the U.S. Army Corps of Engineers. In addition, you should secure any other applicable federal, state or local permits before you proceed with your project, including (but not limited to) those required by Sediment and Erosion Control, Non-Discharge, and Water Supply Watershed regulations. Also, this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is valid only for the purpose and design that you have described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certifications and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). The stream channel crossing depicted in Figures 3 and 6, attached to the application, shall be at an angle of not less than 75 degrees or more than 105 degrees (900 +/- 150) to the stream bank. 3. Soft bank stabilization methods, such as the use of erosion control matting and the planting of appropriate ground cover, shall be utilized to the maximum extent practicable. Riprap may only be used below the normal high water level. The original grade and elevation of the stream's cross-section must be maintained. Riprap placed in the stream bottom must be inserted into the bottom matrix to a depth sufficient to provide the thickness of riprap required for scour protection. The elevation of the stream bottom must not be increased by the placement of riprap. Placement of riprap must not result in destabilization of the streambed or banks upstream or downstream of any crossing. 4. In those areas where the construction corridor must be installed parallel to and closer than 10 feet to a stream channel, appropriate sediment and erosion control measures which equal or exceed those outlined in the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual or the North Carolina Surface Mining Manual (available from the Division of Land Resources at NCDENR regional offices or the central office), whichever is more appropriate, shall be designed, installed and maintained properly to assure compliance at all times with the North Carolina water quality standards that are applicable to Class C waters as described in 15A NCAC 02B .0211 Fresh Swface Water Quality Standards For Class WS-IV Waters. Such measures must equal or exceed the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. These measures must be maintained on all construction sites, borrow sites, and waste pile (spoil) sites, including contractor owned and leased borrow pits, which are associated with this project. 5. Permanent, maintained access corridors shall be restricted to a maximum width of 20 feet, including manhole locations and vehicle turnaround areas. 6. Where joints must be placed in sewer lines within the foot print of the stream channel at crossings having topographic and bedrock constraints, the jointed section shall either be completely enclosed in a steel encasement pipe sealed at both ends, for aerial crossings, or encased in concrete from bank to bank, for buried crossings. 7. If concrete is used with any fill material, it shall not be allowed to come in contact with surface waters until it has cured. 8. Upon completion of the project, the Applicant shall complete and return the enclosed "Certificate of Completion" form to notify NCDWQ when all work included in the S401 Certification has been completed. The responsible party shall complete the attached form and return it to the 401/Wetlands Unit of the NC Division of Water Quality upon completion of the project. Along with the Certificate of Completion foml, please send photographs upstream and downstream of each stream-crossing site to document correct installation. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N,C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. (RW A) is submitting the attached Pre-Construction Notification (PCN) form with supplemental information (Attachment A), and accompanying figures and supporting information, to request the issuance of Department of the Army Section 404 Nationwide Permit (NWP) No. 12 and NWP No.3. for the installation of a sanitary sewer outfall, and a culvert replacement, respectively. The COG has retained RW A to act as its agent in matters related to wetlands permitting for this project. Reference Attachment A for an Agent Certification of Authorization. Figures referenced in the ensuing discussion are included in Attachment B. , The project involves the installation of a 2,125 linear foot (If), a-inch diameter sanitary sewer line and a 240 If, 4-inch diameter sanitary sewer lateral through Westminster Gardens Cemetery. The 8-inch line will extend northwest from a proposed manhole on Tennyson Drive to an existing manhole west of the cemetery (Figure 1). The 4-inch lateral will extend from the cemetery office building south to the a-inch line. The proposed manhole on Tennyson Drive is currently a lift station, which is to be converted to a manhole. The sanitary sewer outfall is proposed pursuant to NWP No. 12, In addition, the COG plans to replace a 40 If, 36-inch diameter corrugated metal pipe (CMP) culvert at Cemetery Driveway with a 54-inch reinforced concrete pipe (RCP) culvert of equal length, with the addition of flared end sections. The culvert replacement is proposed pursuant to NWP No.3. This project will also involve the installation of manholes, and clearing of wooded areas. J Ms. Andrea Wade April 15, 2005 Page 2 of 4 As described below, permanent losses of waters of the U.S. proposed as part of this project would be de minimus. However, open cutting of the channel may be required for installation of the 4" lateral sanitary sewer. In addition, a general condition of the Section 401 Water Quality Certification (WQC) cannot be adhered to. Namely, due to steep topography and limited space available, the edge of the construction corridor will be within 10 feet of the stream top-of-bank between stations 16+00 and 17+50. Therefore, the COG is also submitting this PCN for authorization pursuant to WQC No. 3374 and WQC No. 3376. Purpose and Need The purpose of the sanitary sewer installation is to remove a lift station between two residential lots on Tennyson Drive. The purpose of the culvert replacement is to alleviate flooding of residential property on Tennyson Drive due to the inadequate size of the existing culvert beneath Cemetery Driveway. Jurisdictional Waters of the U.S, Jurisdictional waters of the U.S. in the project corridor included one stream channel (Stream 1) (Photographs 1 and 2, Attachment C). Stream 1 is an unnamed, perennial tributary of Horsepen Creek. In the project area, Stream 1 ranges in width from 4 to 8 feet, measured at the top-of-bank. Stream 1 has bank heights of between 2 and 4 feet. Stream 1 had flowing water at the time of the July 14, 2004 site visit. Riparian vegetation includes tulip poplar (Liriodendron tu/ipifera), slippery elm (Ulmus rubra), multiflora rose (Rosa multiflora), poison ivy (Toxicodendron radicans), sensitive fern (Onoe/ea sensibilis), greenbriar (Smilax ro tun difo/ia) , Virginia creeper (Parthenocissus quiquefo/ia), and spicebush (Lindera benzoin). No wetlands are present in the project area. Reference Attachment D for a Routine Wetland Determination data form. Impacts to Waters of the U.S, This project will involve two primary impact areas, as follows (Figures 3, 4, 5, and 6): 1. Station 18+00 - The COG proposes to replace a 40 If, 36" CMP with a 40lf, 54" RCP with flared-end sections beneath Cemetery Driveway. On the east side of Cemetery Driveway, the flared-end section will result in approximately 17 If of impact to Stream 1 (Photograph 1). The culvert will be buried one-foot below the bottom elevation of the streambed. The existing downstream riprap pad and matting will be repaired as needed (Photograph 2). Replacement of the culvert will also involve minor tailditching to remove accumulated sediment at the culvert openings. It is anticipated that these maintenance activities would be authorized by the requested NWP No.3. In addition, the COG proposes to install the 8" sanitary sewer line beneath the culvert via boring and jacking methods. Reference Figure 5. 2. Near Station 13+25 - The COG plans to bore under Stream 1 in order to install the 4" lateral sewer line. However, shallow rock observed in this vicinity may dictate that the installation be conducted by open cutting the channel. The 30 If of stream channel impacts associated with open cutting would be temporary. It is anticipated that these ~ Ms. Andrea Wade April 15, 2005 Page 3 of 4 potential impacts associated with utility line activities would be authorized pursuant to the requested NWP No. 12. Permanent impacts, totaling 17 If, would result from the installation of the flared end section associated with the culvert replacement and minor tailditching. In order to minimize impacts to waters of the U.S., the COG plans to install the 8" sanitary sewer line beneath the Cemetery Driveway replacement culvert by boring and jacking methods, thereby avoiding potential impacts to the stream channel. The COG also intends to bore beneath the stream for installation of the 4" lateral line, if practicable. As indicated on Figure 6, the ductile iron lateral line will be installed to avoid having a joint within the footprint and/or within two feet of the banks of the stream channel. In addition, an anti-seep collar shall be placed along this lateral sewer line. In the event that the lateral line cannot be bored beneath the stream and an open cut method is employed, the crossing has been designed to be close to perpendicular to the channel, and the stream berm would be reestablished to pre- construction contours and stabilized. The proposed temporary construction corridor width has been limited to 40 feet. The construction corridor is narrower (15 feet) on the north side (Le., stream side) of the proposed sewer than the south side (25'), providing an additional undisturbed buffer for much of the stream length. The edge of the construction corridor is at least 10 feet from the top-of-bank of Stream 1, except between Stations 16+00 and 17+50, where steep topography dictates that the edge of the construction corridor be within 10 feet Due to the de minimus project impacts to waters of the U.S" it is anticipated that the incorporation of the numerous impact avoidance and minimization design elements described above will serve as adequate mitigation. Activities on the project site involving impacts to waters of the U.S. will be required to follow the General Conditions of the Nationwide Permits (Federal Register Vol. 67, No. 10; Tuesday, January 15, 2002), applicable Wilmington District Regional Conditions, and applicable State consistency conditions. Possible sedimentation of the stream during and immediately following the construction phase of this project will be minimized by strict implementation of, and compliance with, State- approved sediment and erosion control plans. Cultural Resources and Protected Species Based on the limited permit area, potential impacts to cultural resources are considered remote. A search of the North Carolina Natural Heritage Program (NCNHP) database provided existing information concerning the potential occurrence of threatened or endangered species within Guilford County, North Carolina. This database indicates that the Bald Eagle (Haliaeetus Ms, Andrea Wade April 15, 2005 Page 4 of 4 /eucocepha/us) is the only federal and/or state threatened or endangered species known to occur in Guilford County, An assessment of potential Bald Eagle habitat (see description below) in the study area was conducted during the field review on July 14, 2004. Appropriate habitat for the bald eagle was not identified. Bald Eaqle (Ha/iaeetus leucocephalus) The bald eagle is associated with coasts, rivers, and lakes, usually nesting near large bodies of water where it feeds. Nesting habitat in the southeast usually occurs in large pine or cypress trees. The bald eagle is listed as a current record for Guilford County. The proposed project is not expected to impact large bodies of water and no areas resembling the habitat requirements for this species were observed in the project area.
