PROJECT SUNEVIARY: The applicant is proposing to construct a road (Kingfisher Lane) and install utilities (including water and sewer) for the development of Live Oak Village. Mr. Beatty Page Two 9. PROJECT DESCRIPTION McKim and Creed, P.A., on behalf of Live Oak Village, LLC, has requested that the attached application be processed under the Express Permit Review Pilot Program. The physical address of the project site is 810, 823, 824 and 827 Ft. Fisher Blvd., adjacent to the Atlantic Ocean, in Kure Beach, New Hanover Co. To find the property, take NC Hwy 421 south from Wilmington to Kure Beach. The project site will be located on the eastern and western sides of Ft. Fisher Blvd., approximately 0.5 miles south of the Carolina Beach/Kure Beach town line. The subject property is approximately 2.71 acres in size and is located along the western side of Ft. Fisher Blvd. The entire property consists of four parcels/properties that are separately owned, however, the applicant has provided deeds for the parcels as well as a "Contract to Purchase Agreement" indicating a transfer upon permit issuance. Once purchased, the parcels will be combined and broken down into 16 individual lots forming Live Oak Village. The property elevation ranges from approximately 11 to 14 feet above Mean High Water (MHW). The site currently contains a Bed and Breakfast (Inn) as well as one single-family duplex building. A portion of the project site lies within the right-of-way of Ft. Fisher Blvd. The area within the right-of-way is generally flat but rises slightly in elevation as you move to the west. Vegetation at the site consists primarily of Live oaks, lawn grasses and ornamental landscaping. The waters of the Atlantic Ocean are classified "SB" by the Division of Water Quality. The area is NOT designated as a Primary Nursery Area by the Division of Marine Fisheries. The long term average annual erosion rate for this area of Kure Beach is 2 feet/year. The 100 year storm recession line for this area is 300', creating a total Ocean Erodible Area AEC of 420'. PROPOSED PROJECT The applicant is proposing to construct a road (Kingfisher Lane) and install sub-surface utilities including water and sewer. Kingfisher Lane would enter the property from Ft. Fisher Blvd. The road would run through the proposed subdivision and exit the property at the intersection of Davis Road. Kingfisher Lane would consists of a 24' x 830' asphalt driveway with 2' valley gutters. The applicant has proposed a 12' right-of-way along Kingfisher Lane (6' on each side of the road and measured from the outside edge of the proposed valley gutters). A small section of Kingfisher Lane, located at the intersection of Davis Road and within the right-of-way, would be dedicated to the Town of Kure Beach. A total of 16 Lots would be located within the subdivision, Lots 1-8 would be located on the southern side of Kingfisher Lane and Lots 9-16 would belocated along the northern side. The Lots would range in size from 5,022 sq. ft. to 6,676 sq. ft. The proposed utilities would run within the right-of-way of Kingfisher Blvd. According to the application, water would be provided by the Town of Kure Beach and sewer would be provided by the Town of Carolina Beach. The eastern portion of Kingfisher Lane, as well as Lots 1, 2, 3, 4, 13, 14, 15 and 16, would be located within the 420' Ocean Erodable Area of Environmental Concern (AEC). Kingfisher Lane would begin at a point approximately 185' from the first line of natural, stable vegetation. 10. ANTICIPATED IMPACTS The initial construction of the road and utilities would result in the disturbance of approximately 0.75 acres (32, 670 sq. ft.) of high ground. According to the Division of Water Quality, the applicant has not yet submitted a State Stormwater Application.
