Box 595 Selma, NC 27576 Subj ect Property: The Knolls At The Neuse UT to Neuse River, 27-38.5, WSIV, NSW APPROVAL of Neuse River Buffer Rule (15A NCAC 02B .0233) Authorization Certificate And Waiver of 401 Water Quality Certification Dear Mr. Mallard: You have our approval, in accordance with 15A NCAC 02B .0233 and any conditions listed below, to impact approximately 8,312 fe of Zone 1 and 4,050 ft2 of Zone 2 of the protected riparian buffers for the purpose of constructing The Knolls At The Neuse at the subject property as described within your application dated April 8, 2005 and in additional correspondence (a fee check for $200.00) rcceived April 20, 2005. In addition, you should obtain or otherwise comply with any other required federal, state or local pennits before you go ahead with your project including (but not limited to) Erosion and Sediment Control, Non-discharge other regulations. Your application materials for a 40 1 Water Quality Certification to impact up to 144 feet of perennial streams at the subject property was received in the Division of Water Quality's Central Office on April 13, 2005. According to our rules [15A NCAC 2H .0507 (A)], if final action is not taken within 60 days, the Certification is waived unless DWQ has objected in writing to your application. Therefore, DWQ has waived the requirement for a 401 Water Quality Certification for your plans to impact waters as described in your April 8, 2005 application materials, including the stormwater management plan. However, if additional impact occurs or your development plans change, this waiver is no longer valid and a 401 Water Quality Certification will be required. This Neuse River Buffer Rule approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this authorization and approval letter and is thereby responsible for complying with all conditions. This approval requires you to follow the conditions listed below. Impacts Approved The following impacts are hereby approved as long as all of the other specific and general conditions of this Authorization are met. No other impacts are approved including incidental impacts: Amount Approved Plan Location or Reference (Units) Buffers 12,363 (square ft.) PCN form 2. Diffuse Flow All constructed stormwater conveyance outlets shall be directed and maintained as diffuse flow at non-erosive velocities through the protected stream buffers such that it will not re-concentrate before discharging into a stream as identified within 15A NCAC 2B .0233 (5). If this is not possible, it may be necessary to provide stormwater facilities that are considered to remove nitrogen. This may require ad9itional approval from this Office. 3. Buffer Impacts The approved buffer impacts associated with the road crossing equal 12,363. The Neuse Buffer Rule requires buffer mitigation for road crossings that exceed 150 linear feet or 1/3 acres of buffer impacts. The impact area includes the area of the footprint of the use and any clearing and grading activities within the riparian buffer necessary to accommodate the use. The length of buffer impact is measured parallel to the stream and includes the length of the footprint of the use and any clearing and grading activities within the riparian buffer necessary to accommodate the use. If the DWQ detennines that the impacts exceed 150 feet or 1/3 acre to the buffer, then buffer mitigation pursuant to 15A NCAC 02B .0233 will be required for the entire impact area. 4. Deed Notifications Deed notifications or similar mechanisms shall be placed on all retained protective buffers in order to assure compliance for future buffer impact. These mechanisms shall be put in place prior to impacting any buffers approved for impact under this Certification Approval and Authorization Certificate. A sample deed notification can be downloaded from the 401/Wetlands Unit web site at http://h2o.enr.state.nc.us/ncwetlands. The text of the sample deed notification may be modified as appropriate to suit to this project. 5. Certificate of Completion Upon completion of all work approved within this authorization, and any subsequent modifications, the applicant is required to return the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. Any disputes over detenninations regarding this Authorization Certificate (associated with the approved buffer impacts) shall be referred in writing to the Director for a decision. The Director's decision is subject to review as provided in Articles 3 and 4 of G.S. 1508. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. Describe the overall project in detail, including the type of equipment to be used: The overall proiect consists of approximately 14.240 linear feet of roadway with waterline and sewerline. The equipment that will be used includes excavators. motor graders. pans. and dump trucks. Phase I of the proiect has approximately 7.200 linear feet of roadway with waterline and sewerline and a proposed buffered stream roadway crossing. 11. Explain the purpose of the proposed work: The purpose of the proposed work is to construct roadways and utilities for a residential subdivision. IV. Prior Project History If jurisdictional detenninations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Include the USACE Action ill Number, DWQ Project Number, application date, and date pennits and certifications were issued or withdrawn. Provide photocopies of previously issued permits, certifications or other useful information. Describe previously approved wetland, stream and buffer impacts, along with associated mitigation (where applicable). Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. The overall subdivision layout was designed to impact the buffer and wetlands only once at the proposed crossing. The roadway crossing was designed to allow a perpendicular impact. Sediment traps will be placed outside of the wetlands and buffer and the wetlands will be clearly flagged and marked to avoid unnecessary impact. VllI. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to Page 9 of 12 freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for US ACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h20,enr,state,ne,us/newetlands/strmgide.htm!. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. LEVEL SPREADER OPERATION AND MAINTENANCE AGREEMENT (SPREADERS 1 & 2) The Knolls at the Neuse, Johnston County The level spreader is defined as an elongated, level threshold, designed to diffuse stormwater runoff. Maintenance activities shall be performed as follows: 1. After construction and until vegetation has been established, level spreader(s) shall be inspected after every rainfall. Thereafter, level spreader(s) shall be inspected at least every month and more frequently during the fall season and after heavy rainfall events. a. Accumulated sediment, leaves, and trash shall be removed, and repairs made if required. b. Inspect level spreader(s) for evidence of scour, undercutting, settlement of the structure, and concentrated flows downhill from the level spreader(s). c. A level elevation shall be maintained across the entire flow-spreading structure at all times. Repair or replace the level spreader if it is damaged. d. Repair eroded areas and replace/replant dead or damaged vegetation. 2. The contractor should avoid the placement of any material on and prevent construction traffic across the structure. If the measure is damaged by construction traffic, it shall be repaired immediately. 3. Mow vegetative cover to a height of six (6) inches. 4. Remove plants when they cover half of the level spreader surface to prevent obstruction. 5. Inspect and repair the collection system (e.g., catch basins, pipes, swales, riprap) four (4) times a year to maintain proper functioning. The application is for a residential subdivision roadway crossing with 144 If of riparian buffered stream impact with 0.0 I acres of wetlands impact. TIlis submittal is for the roadway crossing in Phase I of the project. TIlere are also two utility crossings proposed in this phase that we wish to be considered as "exempt." Both the proposed 4" waterline and the 8" sewerline will impact less than 40 feet of buffer when installed and will have a maintenance corridor of less than 10 feet each. TIle sewerline would have to be installed at depths of approximately 40 feet or more in some areas to avoid the crossings. The waterline crossing is required by the Johnston County Department of Public Utilities to provide a "looped" waterline to improve water service through the subdivision. To minimize impact, both crossings are proposed as perpendicular and the buffered areas will be protected with appropriate erosion control measures, including silt fence and rip rap stream crossing protection as required by Land Quality. TIle layout of the streets in future phases will not impact the remaining buffer on site (no proposed roadway crossings), so there are no anticipated future permits required for this site.
