Dogwood Tr., in Southern Shores, as requested in the permittee's letter dated 2/27/19, incl the art. workplan drawings (5) (3) dated "Received DCM-EC 4/4/19" and (2) dated "Received DCM-EC 3/8/19" This permit, issued on May 15, 2019 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. May �""DV UIV r.,==.._. _- Docking Facilitv Reconfiguration 1) This permit authorizes only the removal of the platform over the breakwater and the extension of the boardwalk/dock located along the bulkhead, and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. (See attached sheet for additional conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2021 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Mark and Anita Frena ADDITIONAL CONDITIONS Permit No. 104-18 Page 2 of 2 2) This permit modification does not authorize any additional formalized boat slips, but does relocate one formalized boat slip to the dock portion of the boardwalk. 3) The boardwalk and the dock portion of the boardwalk over the water, and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's areas of riparian access. Upland Development 4) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property associated with the pile supported rope fence, all as expressly and specifically set forth in the attached permit application and workplan drawings. General 5) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 6) This Minor Modification shall be attached to the original Permit No. 104-18, which was issued on 10/21/18, as well as all subsequent refinements, and copies of all documents must be readily available on site when Division personnel inspect the project for compliance. 7) All conditions and stipulations of the active permit remain in force unless specifically altered herein. NOTE: The U.S. Army Corps of Engineers assigned the proposed project COE Action Id. No. SAW - 2018 -00902. NOTE: The Division of Water Resources assigned the proposed project DWR Project No. 18-0623. NOTE: A minor modification application processing fee of $100 was received by DCM for this project.
