Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Paul ADDITIONAL CONDITIONS Permit #116-05 Page 2 of 3 3) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 4) The authorized structure and associated activity shall not cause an unacceptable interference with navigation. 5) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he/she abandons the : s permitted activity without having it transferred to a third party. 6) This permit shall not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 7) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. Shoreline Stabilization 8) The bulkhead alignment shall be constructed along a straight line form the existing corners on the east and west side of the project property. 9) The bulkhead shall be constructed prior to any backfilling activities. 10) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 11) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by department personnel. No excavation or other land disturbing activities is permitted except for that which may be required for the construction of the bulkhead wall, riprap, deadmen cables, etc. This permit does not authorize any excavation waterward of the approved alignment. 12) The backfill material shall be clean and free of any pollutants except in trace quantities. 13) The riprap shall not extend waterward more than 10 feet from the authorized bulkhead alignment at any point along its alignment at the time of construction. 14) The riprap material shall be free from loose dirt or any pollutant. It shall be of a size sufficient to prevent its movement from the site by wave or current action. 15) The riprap material shall consist of clean rock or masonry materials such as but not limited to granite, marl, or broken concrete. Paul Sedimentation and Erosion Control Permit #116-05 Page 3 of 3 16) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.) 17) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion within thirty days of project completion. General 18) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 19) All highground grading and construction shall be done in accordance with the attached workplan drawings. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity for this determination. The permittee is further advised that the rules of the Environmental Management Commission prohibit many non-water dependent activities within 50 feet of the normal water level. NOTE: The permittee and/or his contractor is urged to meet with a representative of the Division prior to project initiation. NOTE: The N.C. Director Division of Water Quality DWQ Project # 05-0575 Beaufort County Approval of 401 Water Quality Certification (GC3490) with Additional Conditions Dear Ms. Paul: You have our approval, in accordance with the attached conditions, to dredge, place fill material within or otherwise impact by shading 0.10 acres of waters and/or wetlands to construct a bulkhead with riprap, pier and boatlift as described in your application received by the Division of Water Quality (DWQ) Wetlands/401 Unit on April 6, 2005. After reviewing your application, we have determined that the Division of Water Quality (DWQ) General Water Quality Certification Number 3490 covers these water impacts. This Certification allows you to General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition, you should get or otherwise comply with any other federal, state and local requirements before you go ahead with your project including (but not limited to) erosion and sediment control regulations and CAMA. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. Paul Pungo River Beaufort County Project Setting The project site is located off SR 1722 on the west side of the Pungo River below Belhaven at the residential subdivision locally referred to as Ellis Cove in Beaufort County, North Carolina. The project site is a wooded undeveloped 0.39 -acre residential lot with ±120' of natural shoreline with no man made shoreline stabilization i.e. bulkhead or rip rap. The lot is vegetated primarily with various large oaks, loblolly pines and red maple trees. The under story consist of various vines and shrubs. There is a ±5' high erosion escarpment that transitions to a sandy estuarine beach at the normal water level (NWL). Both adjacent waterfront properties are developed with single-family residences. The developed property downstream of the project site has a ±150' long pier. The shorelines on adjacent properties are stabilized with bulkheads. The bulkhead return wall on the downstream side is 30' long while the bulkhead return wall on the upstream side is 20' long. Water depths offshore are shallow with a sandy bottom substrate. Water depths are approximately 2.5' 200' offshore the NWL and 8" to 12" between the bulkheads on adjoining lots. The presence of submerged aquatic vegetation (SAV) was not observed at or near the project area although this observation was made recently during a dormant period for SAVgrowth. The Pungo River at this location is designated as SB NSW by the Environmental Commission, Coastal Waters by the Division of Marine fisheries and is open to shell fishing. Project Description The applicant proposes to construct a bulkhead from the corners of existing bulkheads on neighboring properties, in a straight line, with an average alignment ±25' waterward of the NWL. The maximum distance between the proposed bulkhead and the NWL is ±30'. The proposed bulkhead will be backfilled to the ±5' high erosion escarpment. The proposed riprap will be placed with a 2:1 slope with the waterward toe averaging 10' from the proposed bulkhead. The applicant also proposes to construct a 6' x 200' pier with a 16' x 20' T-head platform, and a 4' x 36' finger pier around a 16' x 16' boat lift. Project Impacts The project as proposed will result in the filling of ±3,000 ft2of shallow water habitat in the Pungo River. The There will be some short-term localized turbidity associated with the construction activities. Blue-line prints or other larger plats are acceptable only if an adequate number of quality copies are provided by applicant. A site or location map is a part of plat requirements and it must be sufficiently detailed to guide agency personnel unfamiliar with the area to the Form DCM-MP-1 site.
