OmMarch 21, 2005, you requested a 401 Water Quality Certification from the Division of Water
~ty (DWQ) for your project. We wrote to you on April 22, 2005 discussing concerns that we
ha'fe regarding the design of the project and staling that it would be placed on hold for.three weeks
giving you time to address DWQ's concerns. As of today, DWQ has not received a response to this
request. Therefore, your file is hereby considered withdrawn and will not be reviewed until DWQ's
earlier concerns are addressed. Once you have.collected sufficient infonnation to have. a complete
application (please see our April 22, 2005 letter for the missing infonnation), you will need to reapply
for DWQ approval. This includes submittiIig a complete application package with the appropriate
feer.
Please be aware that you have no authorization under Section 401 of the Clear Water Act for this
ac1livity and any work done within waters of the state would be a violation of North Carolina General

. received! your voice mail re this project. The 401 review was put on hold on April 22nd, 2005. Their
ljlpplicatiop indicated an impact to perennial waters to exceed 150 feet (380 feet of impacts), thus
compens3ftory mitigation will be required. Their original plan included three lakes, that they were calling
stormwater control lakes, to be constructed in perennial waters and that is something the Corps will not
allow. That may be part of the reason we have not heard back from them. Their delay may be related to
responding to the Corps.
The "hold" letter sent to them on April 22nd asked them to provide, to the Division, the information as
to h-ow they were planning to fulfill the mitigation obligation for the project. No response was ever

re~ived. I They did get the letter from us as they did sign the green card.

DWQ - In accordance with 15A NCAC 2H ;0500, mitigation may be required by the NC
Divi~ion of Water Quality for projects involving greater than or equal to one acre of impacts to
fresijwatet wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation win be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
inch~ding size and type of proposed impact and function and relative value of the impacted
aqU4tic resource will be considered in determining acceptability of appropriate and practicable
miti~ation as proposed. Examples of mitigation that 'may be appropriate and practicable include,
but~e not limited to: reducing the size of the project; establishing and maintaining wetland
andlbr upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mjitigation is required for this project, a copy of the mitigation plan must be attached in order
forUSACE or DWQ to consider the application complete for processing. Any application
lacIqng a required mitigation plan or NCWRP concurrence shall be placed on hold as
inc9mplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Techirical Guide for Stream Work in North Carolina, available at
http!llh2o.enr.state.nc.us/ncwetlands/stnngide.html.
