This permit, issued on May 25, 2005 , is subject to coniplianc~ with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facilitv
1) This permit auth,orizes only the docks, boathouse, and other structures and uses located in or over the
water that are expressly and specifically set forth in the attached permit application and workplan
drawings. No ~ther structure, whether floating or stationary, shall become a permanent part of this
docking facility ,without permit'modification. No non-water dependent uses of structures shall be
conducted on, in or over public trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility.', Any sewage discharge at the docking facility shall be considered a violation of this
permit for whichl ~e permittee is responsible. This prohibition shall be app1i~d and enforced throughout
the entire existenRe of the permitted structure.

This permit action shall. be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case shalL be.

permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
that may be caused from existing or future operations undertaken by the United States in the public
interest.
9) This permit authorizes a maximum of ten boat slips.
General
10) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required,
upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or
obstructions caused thereby, without expense to the United States or the state of North Carolina. No
claim shall be made against the United States or the state of North Carolina on account of any such
removal or alteration.
11) No vegetated wetlands or open water areas shall be excavated or filled, even temporarily.
This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.

Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 946-6481 prior to the commencement of any
such activity for this determination. The permittee is further advised that, in accordance with the
Rules of the Environmental Management Commission, many non-water dependent activities are
not authorized within 50 feet of the normal water level.
NOTE:
The N.C. Division of Water Quality has authorized the proposed project under General Water
Quality Certification No. 3490 (DWQ Project No. 05-0522), which was issued on 4/12/05.

Dear Mr. Huggett:
Reference the application of the Pamptecough Shores Company for a. Department of the
Army permit to construct a lO-slip boathouse inside an existing man-made basin, on property
located off State Road 1336, adjacent to the Pamlico River, near Bath, in Beaufort County, North
Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All wor~ authorized by this permit must be performed in strict c~mpliance with the
attached plansj ;which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (US ACE) prior to implementation.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States. ~o claim shall be made against the United States on account of any such removal,
relocation, or ~teration. The permittee shall notify NOAAINATIONAL OCEAN SERVICE

3. Except as a,uthorized by this permit or any USACE approved modification to this permit,
no excavation', fill or meqhanized land-clearing activities shall take place at any time in the
con~truction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities

4. The authorized structure and associated activity must not interfere with the public's right
to free navigation on all navigable waters of the United States. No attempt will be made by the
permittee to prevent the full and free use by the public of all navigable waters at or adjacent to
the authorized work for reason other than safety.
5. The permittee shall advise the Corps in writing at least two weeks prior to beginning the
work authorized by this permit and again upon completion of the work authorized by this permit.
6. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
7. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps ofEnginC?ers within 24 hours of the permittee's discovery of the violation.

Dear Mr. Linton:
You have our approval, in accordance with the attached conditions, to place fill material within or
otherwise impact by shadingO.019 acres of waters to build a 10 slip boat house as described in your
application received by the Division of Water Quality (DWQ) Wetlands/401 Unit on March 28,2005.
After reviewing your application, we have determined that the Division of Water Quality (DWQ) General
Water Quality Certification NUmber 3490 covers these water impacts. This Certification allows you to
General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition,
you should get or otherwise comply with any other federal, state and local requirements before you go
ahead with your project including (but not limited to) erosion and sediment control regulations and
CAMA. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters
as depicted bl your application shall expire upon expiration of the 404 or CAMA Permit.
This approval is for the purpose and design th.at you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions. If total fills for this project (now or in the future) exceed one acre of
wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A
NCAC 2H .0506 (h). This approval requires you to follow the conditions listed in the attached
certification apd any additional conditions listed below.

Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality,
1650 Mail Service Center, Raleigh, NC, 27699~1650.
3. Water Quality Certification
The proposed project must comply with all of the conditions of General Water Quality
Certification (GC) 3490.
Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon
expiration of the 404 or CAMA Permit. .
If you do not accept any of the conditions of this Certification (associated with the approved water
impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you
receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B ofthe
North Carolina General Statutes to the Office of Administrative ,Hearings, 6714 Mail Service Center,
Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a
hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

Project Setting
The project site is a man-made basin located at lot 374 Kuglercamp Road beside
the Pamlico River in the Hawkin's Beach Community near the Town of Bath in Beaufort
County North Carolina. The man-made basin connects with the Pamlico River, an
estuarine water body that is classified SC/NSW by the North Carolina Environmental
Management Committee. A boathouse similar to the one proposed by the applicant has
stood on the site for more than twenty-five years as depicted in aerial photography from
1978. The original boathouse was recently removed to facilitate replacement of the
bulkhead.
Existing structures on the project site include bulkhead that runs along the
entrance canal to the boat basin and around the basin to approximately halfway across
the west side, a boat ramp in the northwestern comer, and a launch pier on the eastern
side of the boat ramp. A portion of the southern side of the basin has been left without
bulkhead.
The property is bordered to the north by Kuglercamp Road and to the south by a
narrow strip of pine trees, with and under-story of woody shrub scrub vegetation that
slopes down to a sand beach. Single-family homes border the site to the east and west.
The surrounding lots are vegetated with a mixture of pines, hardwood trees, lawn grasses
and ornamental shrubs.
Project Description
The applicant proposes to construct a :!:115' X :!:31' (drip line) boathouse within
the man-made basin. The sides of the open-sided boathouse are to begin 7' above the
bulkhead elevation therefore being 7' plus :t2 additional feet to the normal water level.
The side wall will be 5' and less in height as the shed roof slopes to the rear of the
building. The boathouse will contain 10 slips and be serviced by 6 fmger piers :!:3' X
:t2 8' each. A :!:3' X :!: 113' access walkway will run along the inside back wall of the
boathouse.
Anticipated Impacts
The project as proposed will result in the shading of :!:843 square feet of
boat basin bottom. The project as proposed will result in localized turbidity as a result of
the construction activities.

To whom it may concern,
We propose to build a 10 stall boathouse .It will be 115' long by 31' wide. It will be built on the tract
. presented in this proposal.The boat house will be shared by 10 different owners ,it is a community
boat house located at the Hawkins Beach boat basin. There has been a boat house of the same
before mentioned deminsions on the property for over 50 years. The old boat house became way
to old ,rotted and dangerous for repairs and needs to be replaced. The owners have no where to
dock and store there boats and a new boathouse is deffinately needed.NCDENR has given us

Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (CoDtact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the
