8. PROJECT SUMMARY: The applicant is proposing a 600 space RV park (White Oak Shores)
adjacent to the White Oak River near Stella. As an amenity to the park the applicant is proposing a
580' pier. The pier would have 10 boat slips, platforms for fishing, and a covered viewing platform.

9 Narrative Description:
The White Oak Shores project is located on Wetherington Landing Road (SRI 101) near Stella in
Carteret County. N.C. Hwy. 58 lies a few miles to the east of the site. The site is identifiable by the
bathhouse for the RV Park located near the road. The White Oak River borders the site to the west.
White Oak Shores is 115.62 acres in its entirety and varies from 0' to 28' in elevation above NHW,
The high ground portion of the site is a previous sod farm and is vegetated with various upland
grasses. The infrastructure for the RV Park is mostly in place. These facilities include the
bathhouse, access roads, electricity service and on-site septic systems. Several RV's have already
been "set-up" in the park. A strip of Section 404 Wetlands crosses the high ground and is
approximately 900' wide. A portion of this wetland has been filled through the use of Nationwide
Permit # 14 to allow for a road to access another highground hammock closer to the shoreline. On
this section of highground there is a swimming pool, paved parking and more R V spaces. All work
completed thus far lies outside of the 75' AEC.
The shoreline has a wide fringe of coastal marsh that is both irregularly and regularly flooded. High
marsh species include Cattail (Typha spp.) and Black Needle Rush (Juncus roemarianus). The
regularly flooded low marsh consists of Smooth Cordgrass (Spartina alterniflora). The low marsh
has a series of mosquito control ditches that have been cut through the marsh. The shoreline on
either side of the proposed project is similar in nature and undeveloped.
This section of the White Oak River has been designated by the Division of Marine Fisheries as a
Primary Nursery Area and the Division of Water Quality classifies it as SA waters. The area in
which the proposed project would take place is closed to the taking of shellfish. Carteret County's
Land Use Plan dated 1996 classifies this area as Rural with Services and Conservation. The Division
of Land Resources approved the sedimentation and erosion control plan (CA-03029) on 11/25/02.
The Stormwater Certification (SW8 020806) was approved 02/06/03. There are no shellfish leases
in the area. The substrate in the area is mainly sand and mud.
10. Proiect Description:
As an amenity to the RV Park, the applicant proposes to construct a 580' pier. The pier would have
10 boat slips, fishing platforms and a covered viewing platform. Also 12 mooring pilings would be
installed.
Extending from high ground, the proposed 6' wide dock would cross a fringe of high marsh before
crossing 285' oflow marsh reaching open water. The 6' wide dock would continue over open water
for 125' before widening to 10'. The 10' wide dock would continue for another 158'. Constructed
on the end of the dock would be a 12' X 40' (480 ft2) covered viewing platform. Two 10' X 100'
(1000 ft2 each) fishing platforms would branch off each side of the 10' wide dock. Inshore of the
fishing platforms would be 10 boat slips. To aid in the docking of boats, 12 mooring pilings would
be placed along the slips. Access to boat slips would be gained by a series of six finger piers that are
23' long each. Four of the finger piers would be 4' wide and two would be 8' wide. The proposed
pier would extend a total of 580' into the White Oak River from the NHW. At this point the water is
-5' at NL W. Riparian property lines would be greater than 500' from the pier. This project is not a

marina and there is not fuel or maintenance service. This is a community project to be used by
White Oak Shores residents and their guests.
The highground development for this project is mostly complete and is outside of the AEC. The 80
acre site was previously graded to allow for RV sites, access roads, utilities under road right of ways,
LPP on-site septic systems and a swimming pool. The 20' wide roads will be paved and RV's will
be connected to utilities at their space.
10. Anticipated Impacts:
The proposed pier would result in a total of 10 slips. The potential exists for a large number of
transient boaters to dock at this structure. Overboard discharge is possible from both permanent
slips and from transient boaters. Temporary turbidity would result from the setting of the pilings.
The proposed pier would shade 1,710 ft2 of vegetated wetlands and 5,296 ft2 of open water. The
pier and boat slips would incorporate 13,160 ft2 of public trust area. A total of 80 acres would be
disturbed during this project of which no impervious area will be within the AEC.

Message for the owners: White Oak Shores Camping and RV Resort
As owners and operators of White Oak Shores Camping and RV Resort, we respectfully
ask for consideration for the project proposed in the application.
We would like to give you a quick overview of the project and why we feel this pier will be
an important addition to our success, When all phases are completed we should have
approximately 600 campsites available for the public to use. Approximately 3%-4% of these
sites will be near or in a CAMA AEC. About 6% will be with 100 ft - 300 ft of a CAMA
AEC. The remaining sites will be approximately 1500 ft to 3500 ft from any AEC. We
have reserved most of our river front areas for leisure recreation, and enjoyment of the
aesthetics and view the White Oak River offers.
Our hope is to have a 50% occupancy thoughout most of the year, with higher percentages
during prime season, which is between Memorial Day and Labor Day. Averaging 3 people
per site this is 900 - 1200 people in the resort at any given time. We feel that 10% - 15% of
these people will use a nice fishing pier at any given time. If you remove the Square footage
of the 6 ft walk that gets you to the covered landing, this leaves about 3800 sq- ft of landing
we are asking for that we feel is reasonable for the amount of traffic we expect. This
averages out to about 30 sq-ft per person. This is approximately a 5 x 5 area to fish in.
At times when fishing is at it's best there will obviously be many more people than average,
and other times will be less people. Weare going to promote the fishing pier as a key
feature to our resort and we feel the amount of space we are asking for is well within reason
given the number of users. We have several thousand feet of river frontage and it is our
hope to keep the remainder as undisturbed as possible; to be enjoyed by all who come.

Reference the application of First and Last Child, LLC for a Department of the Army
pe~t request to construct White Oak Shores RV Park and boat/fishing pier adjacent to the
White Oak River, on Wetherington Landing Roaa;near Stella, Carteret County, North Carolina:
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
workishall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE
Chietl Source Data Unit N CS261, 1315 E West HWY - RM 7316, Silver Spring, MD 20910-
3282 at least two weeks prior to beginning work and upon completion of work.

3 . Except as specified in the plans attached to this permit, no excavation, fill or mechanized
land-clearing activities shall take place at any time in the construction or maintenance of this project,
in such a manner as to impair normal flows and circulation patterns within waters or wetlands or to
reduce the reach of waters or wetlands.
4. Except as authorized by this permit or any USACE approved modification to this permit,
no excavation, fill or mechanized land-clearing activities shall take place at any time in'the
constructipn or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
5. All mechanized equipment will be regularly inspected and maintained to prevent
<fO~~tion of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic
materials.. In the event of a spill of petroleum products or any other hazardous waste, the permittee
shall imm~diately report it to the N.C. Division of Water Quality at (919) 733-5083, Ext. 526 or
(800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous Substances
Control Act will be followed.
6. The authorized structure and associated activity must not interfere with the public's right to
free navigation on all navigable waters of the United States. No attempt will be made by the
neqnittee to prevent the full and free use by the public of all navigable waters at or adjacent to the
authorized work for reasoB other than safety.
7. The permittee must install and maintain, at his expense, any signal lights and signals
prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. For
further information, the permittee should contact the U.S. Coast Guard Marine Safety Office at (910)
772,.2191.
8. If the permittee discovers any previously unknown historic or archeological remains while
accomplis~ing the authorized work, he will immediately notify the Wilmington District Engineer
who will initiate the required coordination procedures.
9. Approval of the structure was based on determinations that there would be no obstruction to
navigation. Issuance of this permit should not be construed, as relieving the permittee of taking
proper steps to insure the structure and moored boats will not be damaged by wave wash.
10. The permittee shall advise the Corps in writing at least two weeks prior to beginning the
work auth(j)rized by this permit and again upon completion of the work authorized by this permit.
11. The permittee shall require its contractors and/or agents to comply with the terms and
conditions.ofthis permit in the construction and maintenance of this project, and shall provide each
of its contrflctors and/or agents associated with the construction or maintenance of this project with a
cppy ofthm permit. A copy of this permit, including all conditions, shall be available at the project
s~te during: construction and maintenance of this project.

12. The permittee shall employ all sedimentation and erosion control measures necessary to
prev~nt an increase in sedimentation or turbidity within waters and wetlands outside the permit area.
This shall include, but is not limited to, the immediate installation of silt fencing or similar
appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and
the immediate stabilization of all disturbed areas. Additionally, the project must remain in full
compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina
Genetal Statutes Chapter 113A Article 4).
13. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction-related discharge. Increases such that the
turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North
Carolina Division of Environmental Management (NCDEM), 25 NTUs or less in all saltwater classes
and in. all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant.
14. The permittee, upon receipt of a notice of revocation of this permit or upon its expiration
befor~ completion of the work will, without expense to the United States and in such time and
mann~r as the Secretary of the Army or his authorized representative may direct, restore the water or
wetland to its pre-project condition.
15. Violations of these conditions or violations of Section 404 of the Clean Water Act or Section
10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District U.S. Army
Corpsl of Engineers within 24 hours of the permittee's discovery of the violation.

! 16. The West Indian manatee (Trichechus manatus), which is listed as a federally endangered
speciqs, has been reported in the waters in Carteret County. In order to protect the West Indian
manatee all work should be done during the period from November 1 to May 31. Ifwork must be
done during the period from June through October the enclosed guidelines, entitled "Precautions for
GeneIial Construction in Areas Which May Be Used by the West Indian Manatee in North Carolina"
must ~e followed.

i 17. The Permittee will maintain the authorized work in good condition and in conformance
with ~e terms and conditions of this permit. The Permittee is not relieved of this requirement ifhe
abandbns the permitted activity without having it transferred to a third party.
18. No sewage, whether treated or untreated, shall be discharged at any time from any boats
using the docking facility. Any sewage discharge at the docking facility shall be considered a
violat~n of this permit for which the permittee is responsible. This prohibition shall be applied and
,enfor,*d throughout the entire existence of the permitted structure.
