1)

with the community boat ramp located on Garbacon Drive, including the construction of the associated
gravel road, parking lot, and turn-around area, all as expressly and specifically set forth in the pennit
applications and depicted on the attached workplan drawings. Any additional land disturbing activities
and/or construction shall require a modification of this pennit.
This pemut action may be appealed by the pcmuttee or
othcr qualified pcrsons within twenty (20) days of the issuing
date. An appcal rcquires rcsolution prior to work initiation or

ADDITIONAL CONDITIONS
Boat Ramp facilitv
In order to protect juvenile shrimp and finfish populations, the construction of the boat ramp shall not be
conducted from April I through September 30 of any year without the prior approval of the Division of
Coastal Management, in consultation with the Division of Marine Fisheries.
Unless specifically altered herein, this permit authorizes only the 15 ft. x 40 ft. boat ramp, the 6 ft. x 60
ft. courtesy pier, and the 6 ft. x 35 ft. finger pier, all as expressly and specifically set forth in the permit
application and attached workplan drawings. No other structure, whether floating or stationary, shall'
become a permanent part of this boat ramp and pier facility without permit modification. No non-water
dependent uses of structures shall be conducted on, in or over public trust waters without permit
modification.
The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's riparian access corridor, which is detern1ined by
drawing a line parallel to the channel, or dcep water, thcn drawing a line perpendicular to the channel
line that intersects with the shore at the point where thc upland property line meets the water's cdge.
No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable I
waters at or adjaccnt to the authorized work.
The permittee shall maintain the authorized work in good condition and in conforn1ance with the tem1S
and conditions of this pennit. The pern1ittee is not relieved of this rcquirement if he abandons the
permitted activity without having it transferred to a third party.
The pem1ittcc shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwisc, on the authorized facilities. At a minimum, pennanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
The boat ramp shall either be poured at an upland location and pushed into place once hardened, or
poured entirely within a watertight containment structure. Live concrete shall not be allowed to contact
waters of the State or waters that will enter watcrs of the State.
Excavation and ground disturbing activities above and below the nom1al water line shall be limited to
that absolutely necessary to establish adequate ramp slope and provide a ramp no greater in size than
specified in thc permit application and the work plan drawings.
This pem1it does not authorize the creation of any pem1anent boat slips. The addition of tie-downs,
pilings, or boat slips shall requirc modification of this permit. Contact a DCM representative at (252)

Culvert Placement
II) This permit does not authorize any excavation of the man-made ditch other than that neccssary to set the
culvert.

12) Appropriate bedding material shall be placed beneath the culvert to prevent structural subsidence.
Sedimentation and Erosion Control
NOTE:
The Sedimentation and Erosion Control Plan issued for the development of the subdivision will
need to be updated to include the addition of the community boat ramp facility. The applicant
should submit the revised plan to the Department of Environment and Natural Resources, Land
Quality Section, 127 Cardinal Drive Extension, Wilmington, NC 28405.
13) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion s\vales or berms, etc.).
Stormwater Management
14) The N.C. Division of Water Quality approved this project under stornnvater management rules of the
Environmental Management Commission under Stormwater Permit No. SW8040317 on 12/21/05. Any
violation of the permit approved by the DWQ shall be considered a violation of this CA1\1A pernlit.
General
15) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with
T 15A:07H.0208 of the mles of the Coastal Resourcc Commission, no new dredging or excavation
within the PNA shall be pernlitted except for that which has been approved for the construction ofthc
boat ramp. Dredging of any manner, including "kicking" with boat propellers is not authorized. This
prohibition shall be applied and enforced throughout the entire existence of the permitted stmcture.
16) No vcgetated wetlands or open water areas shall be excavated or filled outside of the area indicated on
the attached workplan drawings.
17) All fill material shall be clean and free of any pollutants except in trace quanti tics.
18) The temporary placcment or double handling of fill materials within waters or vegetated wetlands is not
authorized.
19) The pcmlittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Anny or his authorized representative, said stmcture or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required,
upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or
obstructions caused thereby, without expense to the United States or the state of North Carolina. No
claim shall be made against the United States or the state of North Carolina on account of any such
removal or alteration.
NOTE:
This permit does not eliminate the need to obtain any additional state, federal or local pemlits,
approvals or authorizations that may be required.

such activity for this determination. The permittee is further advised that, in accordance with the
rules of the Environmental Management Commission, many non-water dependent activities are
not authorized within 50 feet of the normal water level or landward edge of any coastal wetlands.

Dear Mr. Smith:
You have our approval, in accordance with the attached conditions (WQC # 3400) to conduct the
following activity located at your property located at Lot #147 near the intersection of Garbacon Drive
and Pin Oak Court, Merrimon Bay Subdivision, Merrimon, in Carteret County. This approval allows you
to:
1. Construct a 15' X 40' boat ramp (filling 450 squarc feet of Shallow bottom habitat, Coastal and
404/40 1 wetlands);
2. Construct an 25' X 760' access road (with culvert in existing ditch) and parking area with
turnaround;
3. Construct a pier and finger pier for tcmporary dockage in conjunction with the on/offloading of
boats.
This approval is only valid for the purpose and design that you described in your CAMA Major
application reccived by the Division of Water Quality (DWQ) Wilmington regional Office (WiRO) on
March 21, 2005 and additional information reccived on October 21,2005. After reviewing your
application, we have determined that General Water Quality Certification Number 3400 covers this
activity. This Certification allows you to usc your CAMA Permit when the NC Division of Coastal
Management issues it. Please keep in mind that there may be additional Federal, Statc or Local
regulations applicablc to your project, such as (but not limited to) Sediment and Erosion Control, Non-
Discharge and Water Supply Watershed regulations, NPDES and Coastal Stormwater. In addition, this
approval will expire when the accompanying CAMA Permit expires unless otherwise specified in
the General Certification.
This approval is only valid for the purposc and design that you described in your completed CAMA
Major Permit application received by the Division of Coastal Management on January 18,2005. If you
change or modify your project, you must notify the Division (DWQ) in writing and you may be required to
send us a new application for a new certification. If thc property is sold, the new owner must be given a
copy of the Certification and approval letter and is thcreby responsible for complying with all conditions. If
total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may bc
required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the
conditions listed in the attached certification and the additional conditions listed on the following
page:

1. Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to this office and a copy to the 40 lIWetlands Unit, North Carolina Division of
Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650;
2. No excavation and no spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian
areas beyond the footprint of the impacts depicted in the CAMA Major Application. All
construction activities, including the design, installation, operation, and maintenance of sediment
and erosion control Best Management Practices, shall be performed so that no violations of state
water quality standards, statutes, or rules occur.
3. No impacts to the Neuse buffer is allowed, outside the proposed impacts outlined in the
application. It is the suggestion of this Office that some type of delineation to identify the Neuse
buffer is established on site to prevent unintentional impacts to the buffer zones. If any questions
arise concerning the Neuse Buffer, call this Office.
Please notify this Office at the number listed below if any problem arises during the construction of
the project that may affect water quality.
Please read General Certification # 3400. If you do not accept any of the conditions of this certification,
you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this
letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina
General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-
6714. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the DWQ Permit #050504 under Section 401 of the Clean Water

This lctter confirms your September 19,2005 telephone conversation with Mr. Mickey Sugg
of my staff, regarding your non-compliance of our December 18, 2003 issued Nationwide Permit
No. 14 permit (copy enclosed) for the construction ofthe main access into the Merrimon Bay
Development near the terminus ofSR 1321 (4-H:Camp Road), adjacent to the Neuse River, in
Merrimon Community, Carteret County, North Carolina.
Through coordination with Ms. Noelle Lutheran of North Carolina Division on,Vater
Quality, our office has learned that the culvert placement, associated with the permitted road
crossing, does not align with the existing stream channel as depicted in the submitted
November 5,2003 permit request. As stated in the permi~, the work is authorized provided that
"it is accomplished in strict accordance with the attached conditions and your submitted plans."
Your current work, as discussed in the September 19th conversation, has violated the terms and
conditions of the issued Department of the ArnlY permit.
In order to bring your authorization into compliance, you are directed to properly reinstall
the culvert following the natural alignment ofthe streambed as to not obstruct normal flows, and

at the proper grade elevations as instructed in the Regional Condition (2)( e) on page 21. This '
remedial action must be completed within 30 days of the receipt of this letter. Failure to comply
with these directives may result in immcdiate referral to the U.S. Attorney for appropriate action.
Please be aware that our office is currcntly evaluating your permit non-compliance for an
administrativc pcnalty.

RE: Riparian Buffer Violations at Merrimon Bay Subdivision DWQ
Project #: 03-140
Dear Ms. Steenhuis:
I have received a copy of your letter dated April 15, 2005 regarding riparian buffer violations at
the above referencc project. I have also been informed by my project manager, Mr. Bill Atkins,
that he met on site with Ms. Nocl Luthern to discuss her concerns of the alignment of the new
storm drainage pipe located where thc road crosses thc riparian buffer.
I have made two visits to the site to observe the conditions at the crossing and I offer thc
following comments:
1. There appears to be non-diffusc flow in one area of the crossing area which is located
northeast ofthc eastern end ofthc storm drainage pipe where the road crosscs the buffer.
This non-diffuse flow is caused by the contractor connccting a logging road drainage ditch to
thc new roadside ditch, which creates concentrated flow into the riparian buffer. This area is
highlighted in green on the attached map. The areas highlighted in orange have diffuse flow
in the buffer by means of the roadside ditch daylighting out before it meets the buffer.
Proposcd Rcmedy:
a. Block off the drainage from the existing logging road ditch where it intersects with the
roadside ditch along Garbacon Drive.
b. Regrade the ditch and fill section in thc lighted green area in accordancc with the typical
street cross section. This will cause the ditch to daylight out before the riparian buffer
which will then provide diffuse flow through the buffer.
c. Remove all sediment on the upstream end of the storm drainage pipe.
d. Reseed all exposed areas.
2. I observed that the western end of the storm drainage pipe falls in the centerline of the
distinct existing stream while the eastern end of the pipe docs not line up with the apparent
low area east of the end of the pipe. This situation was caused by the entire area east of the
old logging road that ran approximately whcre Garbacon Drivc is located bcing floodcd with
2' of water at the time of our initial field survey and rcmained floodcd at thc time of

construction of the crossing. My project manager instructed the grading contractor to install
the storm drainage pipe at a location that directed the east end of the pipe towards the
apparent location of the stream. Once the pipe was installed and the floodcd arca east ofthe
road crossing finally drained, it became noticeable that there was remnants of an old stream
bed that did not line up with the east end ofthe pipe. The storm pipe was, however, installed
at an elevation which provided positive drainage flow from the old stream bed to the east end
of the pipe.
Proposed Remedy:
a. Due to the nature of the apparent misalignment of the pipe due to flooded conditions and
fact that the stream bed on the east sidc of the road is far lcss detenninable than the west
side, it would be my request to leave the situation as is. No natural drainagc flows are
being obstructed and the site is stabilized. The costs to remove the pipe and realign it
would cost in excess of$lO,OOO.OO and I do not personally fell that the benefit that
relocation offers justifies the costs and restabilization of the entire crossing area.
If this proposal of correction is acceptable to you I can have the work done within 15 working
days from notification of your office. I look forward to hearing from you in regards to your
decision in this matter.

9. NARRATIVE DESCRIPTION:
Project Setting
Greenville Timberline, LLC is currently developing Merrimon Bay subdivision, which is a
180-lot subdivision bordering the Neuse River and Adams and Garbacon Creeks. The project
site, Lot 147, has been designated as a recreation area for residents of the development. The
1.77 acre tract of land, which is due east of the intersection of Garbacon Drive and Pin Oak
Court, is adjacent to Garbacon Creek near Merrimon, Carteret County, North Carolina. All
development activity for the subdivision with the exception of the proposed boat ramp is
outside of the Division of Coastal Management 75' Estuarine Shoreline AEC. The roads are
under construction and there are no houses proposed by the developer. Elevations on the
property range from Normal Water Level to approximately 5' above Normal Water Level.
The lot is currently undeveloped and is predominantly vegetated on the high ground with early
successional grasses, and loblolly pine, live oak, and cedar trees. The high ground transitions
to the creek through a section of wetlands approximately 15' to 40' wide and composed of
Spartina cynosuroides, Scirpus ffi12,., Juncus roemerianus, and Spartina alternitlora.
The waters of Garbacon Creek are classified as SA High Quality and Nutrient Sensitive
Waters and are open to shellfish harvesting. Garbacon Creek is classified as a Primary
Nursery Area by thc N.C. Division of Marine Fisheries. There are currently no piers or bo at
ramps in Garbacon Creek. The creek is approximately 300' wide in the vicinity of the project.
The water depths in the project vicinity are typically in the -2' to -3' range below NWL. The
project received a Low Density Stormwater Permit #SW8 040317 from the Division of Water
Quality and a Sediment and Erosion Control Plan has been approved by the Division of Land
Resources.
Project Proposal
The applicant proposes to construct a boat ramp for use by the residents of Merrimon Bay
subdivision. A gravel road for access to the boat ramp is proposed from Garbacon Drive,
with dimensions of approximately 25 feet wide by approximately 760 feet in length. The
access road also includes a turn around area in the vicinity of the boat ramp. The ace ess road
passes over an existing man made ditch. The ditch is vegetated with Cat -tail plants but is
outside of the delineated Section 404 Wetlands. The applicants have requested to cross the
ditch with a 24" culvert 25' in length. The applicants have proposed a gravel parking area
large enough for six vehicles with boat trailers.
The proposed boat ramp measures 15' wide by 40' in total length. The boat ramp would
extend an average of 15' waterward of the NWL and would cross a 15' section of Coasta I and
Section 404 Wetlands as described above. The boat ramp is proposed to cross the Coastal and
Section 404 Wetlands in the area where the wetlands are the narrowest on the property. The
.water depth at the end of the proposed boat ramp is -3.6' below NWL.
A 60' long by 6' wide pier with a 6'long by 35'wide finger pier is proposed adjacent to the
boat ramp for temporary dockage in conjunction with the on/off loading of boats. The pier
would extend 35' into Garbacon Creek. The pier is approximately 30' from the adjacent
riparian areas at its closest point. Water depth averages -3.8' below NWL at the end of the
proposed pier.
Anticipated Impacts
The installation of the hoat ramp will result in the filling and grading of 225 square fe et of

Coastal and Section 404 Wetlands adjacent to Garbacon Creek. It will also result in the filling of
225 square feet of shallow water bottom habitat in Garbacon Creek, which is a designated PNA
and is open to shellfish harvesting. An increase in boat traffic on Garbacon Creek is anticipated
with the addition of the boat ramp as there are currently no piers or accesses directly to Garbacon
Creek. The road and boat ramp will produce approximately 2,125 square feet of
impervious surface in the 75' Estuarine Shoreline AEC inc1udingl,200 square feet of new
impervious surface in the Neuse River Basin Riparian Buffer Area. The road and boat ramp
will also produce an additional 27,730 square feet of disturbance and impervious surface on
the high ground of the lot. The proposed development results in a 28 % impervious su rface in .
the 75' AEC and a total impervious surface for the lot of36%. A temporary increase in
turbidity can be expected during the construction of the boat ramp and pier.
The construction of the pier will result in the usurpation and shading of 57 0 square feet of
Estuarine Waters and Public Trust Area. The pier would extend approximately 35' across the
300' width of the creek. The pier as proposed would extend into and beyond the deepest
section of the creek and as such can be expected to impair navigation. The pier is not intended
as a permanent mooring for any vessels and therefore would not result in any additional slips
in the creek. A temporary increase in turbidity can be expected during the construction of the
pier.
