Director Colleen H. Sullins, Deputy Director Division of Water Quality On April 28, 2004, Mr. Buster Towell of the Raleigh Regional Office conducted an inspection at the subject swine operation due to a citizen's complaint. The complaint stated that swine had direct access to a stream and that waste material was getting into waters of the State. The inspection revealed the following: Mr. Towell noted that a pen had been constructed all the way across a small stream and that there were 3 large hogs confined in the pen. The pen allowed for any waste material along with sediments to enter into the small creek. Mr. Jeff Dillard of the Halifax County Health Department was on site and witnessed the discharge occurring. Samples revealed that the upstream fecal coliform count was 130 colonies per 100 milliliter of sample and the downstream sample showed that the fecal coliform count was 750 colonies per 100 milliliter of sample. The State coliform standard is 200 colonies per 100 ml of sample. The discharge of animal waste into waters of the State is a violation of North Carolina General Statute 143-215.1, which can be subject to civil penalties of up to $ 25,000.00 per day, per violation. You should be reminded that Mr. Towell found a very similar situation last August at you home site located on Thelma Road in Roanoke Rapids. The Raleigh Regional Office has been in contact with Mr. Garland Wells with the NCDA State Vets Office. He has been to the site and has confirmed that the hogs have been moved up hill approximately 50 feet from the former location. Please respond to this Notice in writing within ten days of your receipt. Your response will be reviewed by the Regional Office and may be forwarded to the Director for his review. If the Director determines that an enforcement action is warranted the Division will proceed with the appropriate action in this matter. Please note that these discharges of animal waste into waters of the State are illegal and are considered violations of North Carolina General Statue 143-215.1 which states: No person shall do any of the following things or carry out any of the following activities until or unless such person shall have applied for and received from the Commission a permit and shall have complied with such conditions, if any as are prescribed by such permit ---------lake any outlets to waters of the State. You should also note that your facility was Designated as a Concentrated Animal Feeding Operation on September 8, 1992. This Designation stated that if discharges were not permanently eliminated within 60 days of receipt of that Designation that you would be required to aorniy for and National Pollutant Discharge Elimination System ('NPDES ) Permit. The discharge of animal waste into waters of the State are also subject to civil penalties of up to S 10.000.00 per day, per violation. and in some cases up to S 25.000.00 per day. Please respond to this Notice in writing within 10 days of •-our receipt. Your response should include a summary of anv actions you have taken or plan to take in order to eliminate the discharge of animal waste from vour facility. Director Divisicn of Water Quality On August 14, 2003, Mr. Buster Towell of the Raleii7ii Regional Office conducted an inspection at the subject facility due to a citizens complaint. The complaint stated that swine and cattle had direct access to a stream and that waste material was getting into these .� aters. causing t:nsanitary conditions to occur in the neighborhood. The inspection revealed the fOliowinu: vlr. Towell noted that there were approximately 15 cows and 1 hogs kept on an open lot. lowing stream runs througil the middle section of the property. and the cows did :;aye Direct access to the stream. Fecal material was observed both in and around the water and there was very little vegetation observed in close proximity to the stream to act as a buffer for -.%-aste and sedimentation. The 15 swine were fenced in near the top of the hill and did not have direct access to the stream. However, a large wallow area was observed at the fence line and within 30 feet of the stream. A dead hog that had partially eaten was lying in the wallow alongside of -a large live hog. It was obvious that this area would run off during even the smallest amount of rainfall. Another unburied hog was located outside of the swine enclosure in close proximity to the stream. Stream samples were collected from 2 locations within the feedlot area. Both indicated fecal coliform levels above the water quality standard. DESCRIPTION OF COMPLAINT: Dead disposal- There was a dead hog deterorating partially buried next to a running sream of water that flowed from one side of his property to the other,onto other people's property. Mr. Morris said the stream never dried up. Part of the dead hog was not fully covered with dirt. There were a few bones from dead hogs laying in the pasture. Mr. Morris said some wild dogs were loose in his hog pen once and they killed a few hogs.This was a bad situation. He had 18 fat sows and boars mixed in the hog pen. Mr. Morris had 10 cows in a pen ajoining the hog pen. These cattle were watering from this streann,rnaking things look worst for DWQ. There were no dead cattle in the pent. This inspection is part of the Division's efforts to determine potential problems associated with liquid waste collection/disposal systems. Mr. Towell's site visit determined that wastewater from your facility was not discharging to the surface waters of the state, nor were any manmade conveyances (for the purpose of willfully discharging wastewater) observed. As a result, your facility was found to be in compliance during this visit. Effective wastewater treatment and facility stewardship are a responsibility of all animal facilities. The Division of Environmental Management is required to enforce water quality regulations in order to protect the natural resources of the State. Accordingly, illegal discharges of wastewater to the surface waters of the State are subject to the assessment of civil penalties and may also result in the loss of deemed permitted status, requiring immediate submission of a waste management plan. This inspection is part of the Division's efforts to determine potential problems associated with liquid waste collection/disposal systems. Mr. Towell's site visit determined that wastewater from your facility was not discharging to the surface waters of the state, nor were any manmade conveyances (for the purpose of willfully discharging wastewater) observed. As a result, your facility was found to be in compliance during this visit. Effective wastewater treatment and facility stewardship are a responsibility of all animal facilities. The Division of Environmental Management is required to enforce water quality regulations in order to protect the natural resources of the State. Accordingly, illegal discharges of wastewater to the surface waters of the State are subject to the assessment of civil penalties and may also result in the loss of deemed permitted status, requiring immediate submission of a waste management plan. Mr. 'Morris said some wild dogs were loose in his hog pen once and they killed a few hogs.This was a bad situation. He had 18 fat sows and boars mixed in the hog pen. Morris said he realizes that the violation were his fault. Mr. Morris said he was in process of selling all his hogs and cattle. He said he was old and did not have any help moving the livestock. Mr. Morris asked if the dead line date could be 08-25-2003. He said he pronused he would have all the cows and hogs sold and gone by the dead line date.
