This is to acknowledge receipt of your request that your facility no longer be registered as an animal waste
management system per the terms of 15A NCAC 2H .0217. The information you provided us indicated that your
operation's aniriial population does not exceed the number set forth by 15A NCAC 2H .0217, and therefore does not
require registration for a certified animal waste management plan.
Under 15A NCAC 2H .0217, your facility is deemed permitted if waste is properly managed and does not
reach the surface waters of the state. Any system determined to have an adverse impact on water quality may be
required to obtain a waste management plan or an individual permit. You are reminded that a discharge of wastes to the
surface waters of the state will subject you to a civil penalty up to S10,000 per day.
Should you decide to increase the number of animals housed at your facility beyond the threshold limits listed
below, you will be required to obtain a certified animal waste management plan prior to stocking animals to that level.
Threshold numbers of animals which require certified animal waste management plans are as follows:

SUBJECT: Operation Review Summary and Corrective Action Recommendation
Double B Dairy Facility No. 39-7 Granville County
Dear Mr. Blackwell,
On June 3, an Operation Review was conducted of Double B Dairy, facility no. 39-7." This Review,
undertaken in accordance with G.S. 143-215.1OD, is one of two visits scheduled for all registered livestock
operations during the 1997 calendar year. The Division of Water Quality will conduct a second site
inspection.
During the Review, it was determined that waste was not being discharged to the waters of the State,
and the animal waste collection, treatment, storage and disposal systems were properly maintained and
operated under the responsible charge of a certified operator. A copy of the completed review form is
enclosed for your information. The following observances and management deficiencies were discovered
and noted for corrective action or response:
1. The milking parlor liquid waste is currently running over a field. To ensure proper treatment of
waste, the use of a field as a buffer/filter strip needs to be designated by a technical specialist.
Please contact your local district office for assistance in this matter.
2, The current waste management system needs improvement. There are many options available
and a technical specialist could give you specifics for your farm.

As we discussed, I have enclosed a removal request form for you. Be aware that if you remove the
farm from the list and wish to increase to above threshold numbers you will have to meet requirements for a
new farm. `This c6u-fd-affect the leasing of your farm to another farmer who has greater than threshold
number of cows. The farm will still need to operate in a manner that does not compromise water quality and
help is available from technical specialists in your district office. The Division of Water Quality is required to
continue to inspect facilities that pose a potential threat to water quality.

Double B Farm Dairy Operation

Dear Mr. Blackwell:
On August 22, 1996, Ms. Vanessa Manuel of the Raleigh Regional
Office conducted a Compliance Inspection of the subject animal
facility accompanied by your son and yourself. Both your on -site
assistance and cooperation was very helpful and appreciated. The
inspection is a part of the Division's efforts to annually inspect
registered animal operations. As a result of the inspection, the
following comments and/or recommendations were developed:
1. The subject facility, does not have a waste storage
facility to collect, treat, or store its animal waste.
Instead, the animal waste is temporarily stored on a
concrete pad until transferred to a honey wagon for land
.application. Furthermore, animal waste in the barn area
was not well maintained at the time of the inspection.
Said waste has the potential of leaving the concreted
area and flowing onto denuded areas outside of the barn.
The general guidelines for cattle/dairy operations state
that all solids from paved areas must be collected in a
waste storage facility.
2. As you stated during the inspection, your facility is
currently land applying waste on a daily basis, even
during the winter months and during wet conditions.
However, as specified in the standards for the Natural
Resources Conservation Service (NRCS), "animal waste
shall not be applied to saturated soils during rainfall
events, or when the surface is frozen." As a result, it
is strongly recommended that your facility consider
installing a holding pond to store your animal waste
during inclement weather.
3. Waste from the milking parlor discharges from a pipe to
surface waters of the State. Evidence of possible animal
waste was observed in the flowing stream. However, no

discharge was observed at the time of the inspection.
The general guidelines for cattle/dairy operations state
that all liquids from paved and milking areas must be
collected in a waste storage facility or in some other
way treated to insure only a "de minimus" discharge of
pollutants in a storm event less severe than a 25 year,
24 hour storm event. The presence of the pipe from the
milking parlor for the purpose of discharging animal
waste to surface waters of the State is a violation of
North Carolina General Statute 143-215(e). In addition,
North Carolina General Statute 143-215.1 requires that a
permit must be secured from this Division prior to
discharges to surface waters of the State. Both of these
violations are subject to enforcement action by the
Division.
Effective wastewater treatment and facility stewardship are a
responsibility of all animal facility operators. The Division of
Water Quality is required to enforce water quality regulations in
order to protect the natural resources of the State.
This office would like to take this opportunity to inform you that
all dairy operations with 100 head of cattle or more are required
to have a certified operator in charge of their animal waste
management systems by January 1, 1997. After said date, only a
certified operator, or someone under his/her supervision, may apply
animal waste to the land.
The Raleigh Regional Office would also like to take this
opportunity to remind you that all registered animal facilities are
required to have an approved Animal Waste Management Plan by
December 31, 1997. This plan must be certified by a designated
technical specialist or a professional engineer. For a listing of
certified technical specialists or assistance with your waste
management plan, you should contact your local Soil and Water
Conservation District.
In addition to continued waste facility management, the
deficiencies and violations noted in items 1, 2, and 3 above must
be immediately addressed to help prevent the possibility of an
illegal discharge. Please respond to the Raleigh Regional office
with a written response to the aforementioned issues by October 14,
1996. You should specifically address how you plan to. correct the
problems and submit a schedule (with dates) stating when these
deficiencies and violations will be corrected.
