Within the approval letter, there is a condition that reads: Notification of Construction The applicant and/or authorized agent shall contact the DWQ Express Review Program in writing at the letterhead address within 10 days of the commencement of construction. This is a part of the Express Review Program that is required to ensure compliance during construction and post construction. Therefore, if you have begun construction on your property, you are required to notify this office in writing by July 24, 2006. If you do not notify this office in writing and construction has started, you are in violation of the Water Quality Certification Rules as required by 15A NCAC 21-1.0507(c). This letter is to notify you and make you aware of this new condition that has been written into the Water Quality Regulations for projects issued within the Express Review Program. This Plansatisfies Condition 2 of the §401 Water Quality Certification issued to the Park South Development Project (DWQ 04-0798). The structural storm water practices as approved by this Office as well as drainage patterns must be maintained in perpetuity. No changes to the structural storm water practices shall be made without written authorization from the Division of Water Quality. The storm water easements shall allow for the ability to maintain the structures, perform corrective actions as described above and shall provide protection of the structures from potential alternations by future property owners. The applicant and/or authorized agent shall contact the DWQ Express Review Program in writing at the letterhead address within 10 days of the commencement of construction. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. DEED RESTRICTIONS AND PROTECTIVE COVENANTS The following italicized deed restrictions and protective covenants are required to be recorded for all subdivisions, outparcels and future development prior to the sale of any lot. If lot sizes vary significantly, a table listing each lot number, size and the allowable built-upon area for each lot must be provided as an attachment. 1. The following covenants are intended to ensure ongoing compliance with state riparian buffer authorization or General Certification munbers as issued by the Division of JYater Quality. These covenants may not be changed or deleted without the consent of the State. 2. No more than square feet of any lot shall be covered by structures or impervious materials. Impervious materials include asphalt, gravel, concrete, brick, stone, slate or similar material but do not include wood decking or the water surface of swimming pools. 3. Swales shall not be filled in, piped, or altered except as necessary to provide driveway crossings. 4. Built-upon area in excess of the permitted amount requires a modified water quality certification prior to construction. 5. All permitted nmofffrom outparcels or future development shall be directed into the permitted stornnvater control system. These connections to the stormwater control system shall be performed in a manner that maintains the integrity and performance of the system as permitted. (ESP) has prepared the following storm water management plan for The Conservatory, a single family subdivision of 30 lots on 11.25 acres. Total proposed impervious area on the site is 3.37 acres - 30% of the total site area. Stormwater runoff leaves the site on the west side, and is gathered into an existing urban pipe and ditch system, which comprises an unnamed tributary to Little Sugar Creek. The site is divided into three drainage area/outfalls described below: Drainage Area 1 - 4.75 acres, 1.95 acres impervious This is the most intensely developed area on the site at 41% impervious, and its runoff is directed to a proposed bioretention area (rain garden #1). The rain garden has a surface area of 3,901 square feet, and is located in an amenity area in the site interior. Enclosed plans illustrate the location and the proposed landscaping. Because this site is located in the Piedmont region of North Carolina, the rain garden is designed with an underdrain system to convey runoff to the receiving system. The fact that the soil survey indicates a Cecil Urban Land mix - a highly variable soil in terms of composition and permeability - an underdrain system is a prudent choice. The source of runoff directed to the rain garden is made up of on-site developed single- family lots, as well as a landscaped area interior to Conservatory Lane. No off-site runoff is directed into this area. Drainage Area 2 - 2.68 acres, 1.16 acres impervious, and Drainage Area 3 -1.66 acres, 0.28 acres impervious Runoff from these areas is combined and directed to a proposed bioretention area (rain garden #2). The composite impervious area is just over 33%. Drainage Area 2 and Drainage Area 3 are comprised of only on-site runoff sources. Off-site runoff flowing toward the site is collected in a pipe system and bypassed to the existing system downstream of the project site. (ESP) has prepared the following storm water management plan for The Conservatory, a single family subdivision of 30 lots on 11.25 acres. Total proposed impervious area on the site is 3.37 acres - 30% of the total site area. Stormwater runoff leaves the site on the west side, and is gathered into an existing urban pipe and ditch system, which comprises an unnamed tributary to Little Sugar Creek. The site is divided into three drainage area/outfalls described below: Drainage Area 1 - 4.75 acres, 1.95 acres impervious This is the most intensely developed area on the site at 41% impervious, and its runoff is directed to a proposed bioretention area (rain garden). The rain garden has a surface area of 3,901 square feet, and is located in an amenity area in the site interior. Enclosed plans illustrate the location and the proposed landscaping. Because this site is located in the Piedmont region of North Carolina, the rain garden is designed with an underdrain system to convey runoff to the receiving system. The fact that the soil survey indicates a Cecil Urban Land mix - a highly variable soil in terms of composition and permeability - an underdrain system is a prudent choice. The source of runoff directed to the rain garden is made up of on-site developed single- family lots, as well as a landscaped area interior to Conservatory Lane. No off-site runoff is directed into this area. Drainage Area 2 - 6.36 acres, 1.08 acres impervious, and Drainage Area 3 - 2.08 acres, 0.35 acres impervious Each of these areas includes relatively low total impervious at just under 17%. Drainage Area 2 is comprised of both on-site and off-site runoff sources. Drainage Area 3 is completely on-site. In each area, runoff is collected in a pipe system and discharged to a vegetated buffer area upstream of the receiving urban pipe and ditch system. Operation and Maintenance Agreement We were unable to locate a model Operation and Maintenance Agreement specific to rain gardens. The Agreement presented is adapted from existing model agreements for other BMPs and from rain garden maintenance recommendations discovered in our research.
