This permit, issued on May 19.2005 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Dockine Facility
1) This permit authorizes only the 6 ft. x 423 ft. access pier, the finger piers, and the 42 ft. x 16 ft.
platform, and other structures and uses located in or over the water that are expressly and specifically set
forth in the attached permit application and workplan drawings. No other structure, whether floating or
stationary, shall become a permanent part of this docking facility without permit modification. No non-
water dependent uses of structures shall be conducted on, in or over public trust waters without permit
modification.
2) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
Signed by the authority of the Secretary of DENR and the
Chairman of the Coastal Resources Commission.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.

The authorized structure and associated activity shall not cause an unacceptable interference with
navigation.
The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury,
which may be caused from existing or future operations undertaken by the United States in the public
interest.
The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
This permit authorizes a maximum of 8 boat slips. At no time shall more than 8 vessels be moored or
docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types,
including but not limited to motorboats, sailing vessels and personal watercraft. '

All material resulting from the removal of the existing pier shall be placed on an approved upland
disposal site.
NOTE:
Any future proposal to add 3 or more additional boat slips to the authorized 8-slip facility shall
require that the docking facility be classified as a marina, and shall therefore require a review
under the N.C. Environmental Policy Act (NCEP A).

This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE:
Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 946-6481 prior to the commencement of any
such activity for this determination. The permittee is further advised that, in accordance with the
Rules of the Environmental Management Commission, many non-water dependent activities are
not authorized within 50 feet of the normal water level.
NOTE:
The N.C. Division of Water Quality has authorized the proposed project under General Water
Quality Certification No. 3490 (DWQ Project No. 05-0457), which was issued on 4/12/05.

Dear Mr. Huggett:
Reference the application of Bayview Town Homes for a Department of the Army permit
to construct a pier with eight boat slips, on property located off State Road 1744, adjacent to the
Pamlico.River, near the Town of Bath, in Beaufort County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative,. said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United Sfates. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE
Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910-
3282 at least two weeks prior to beginning work and upon completion of work.

3. The authorized structure and associated activity must not interfere with the public's right
to free navigation on all navigable waters of the United States. No attempt will be made by the
permittee to prevent the full and free use by the public of all navigable waters at or adjacent to
the authorized work for reason other than safety.
4. The permittee must install and maintain, at his expense, any signal lights and signals
prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities.

Dear Mr. Linton:
You have our approval, in accordance with the attached conditions, to place fill material within or
otherwise impact by shading 0.095 acres of waters to build a pier and 8 boat slips as described in your
application received by the Division of Water Quality (DWQ) Wetlands/401 Unit on March 10,2005.
After reviewing your application, we have determined that the Division of Water Quality (DWQ) General
Water Quality Certification Number 3490 covers these water impacts. This Certification allows you to
General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition,
you should get or otherwise comply with any other federal, state and local requirements before you go
ahead with your project including (but not limited to) erosion and sediment control regulations and
CAMA. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters
as depicted in your application shall expire upon expiration of the 404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions. Iftotal fills for this project (now or in the future) exceed one acre of
wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A
NCAC 2H .0506 (h). This approval requires you to follow the conditions listed in the attached
certification and any additional conditions listed below.

2. Certificate of Completion
Upon completion of all work apprpved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 40 l/W etlands Unit, North Carolina Division of Water Quality,

3 . Water Quality Certification
The proposed proj ect must comply with all of the conditions of General Water Quality
Certification (GC) 3490.
Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon
expiration of the 404 or CAMA Permit.
If you do not accept any of the conditions of this Certification (associated with the approved water

Project Setting
The project area is located at the end of SR1744 Bayview Rd. adjacent to the
Pamlico River near the Town of Bath in Beaufort County North Carolina. Bayview Town
Homes is an established town home complex that consists of two buildings with four
units in each building. The project site is the existing common area situated between the
buildings and the Pamlico River.
Existing structures on the project site consist of a small boat ramp adjacent to the
western end of the bulkhead, and the remains of a pier. Approximately 379' of the :t400'
shoreline is currently in bulkhead. The pier is centered approximately on the bulkhead
and extends water-ward approximately 400' terminating in a T. The T is bordered by a
series of dolphin clusters. Derelict pilings dot the water east and west of the pier.
The property is bordered to the west by a vacant lot with a riprap shoreline and
rock jetty that leads into a small canal. East of the property is a single family home that
has a small section of riprap along the shoreline and a pier. The established pier lines east
and west of the project site range from :t120' to :t350'. Seasonal conditions limit the
evaluation of submerged aquatic vegetation on the project site at this time. However,
historical knowledge provided by staff and evidence seen on the 1995 aerial photograph
of the area indicates that significant beds of Va/isenaria sp. are present at the project site
during the growing season. The project site is vegetated with lawn grasses, loblolly pines
and a few ornamental shrubs near the buildings.
Project Description
The applicant proposes to construct :t 6' X :t423' of pier on the same alignment as
the existing structure. A :tIS' X :t42' T will be constructed at the end of the pier. The
applicant proposes to utilize six ofthe existing dolphin clusters in construction ofthe T.
Eight boat slips are proposed for the west side of the pier. Each slip will be :t13'
X :1:20' with a :t3' X :1:20' catwalk. Each slip will be constructed with six pilings to allow
for future installation ofboatlifts as desired by the homeowners.
Anticipated Impacts
The project as proposed will result in the shading of:t4,128 square feet of
river bottom. The project as proposed will result in localized, short term, turbidity as a
result ofthe construction activities.

To whom it may concern,
We propose to build a brand new pier for the Bayview Townes
Homeowners Association Inc. There is a existing pier structure on the tract, it is
423' from the bulkhead out ,25 ' from the bulkhead back. It has a 42'x16' tee
platform,and a 10'x6' stepdown.There are 9 existing piling clusters at the end of the
pier(see drawings 1a or 1b),there are 3-1' wide pilings in each cluster. We plan to
leave 6 of these existing clusters and removing 3, the 3 on the right side of the tee
closest to the shore. We will also be removing all existing pier structures.
The pier we are proposing to build will be 6' wide and go all the way back
to the existing piling structures 423' from the shore, then 25' from the shore/bulkhead
back up onto land. There will be a 421x15' tee built inside the existing piling clusters
formation. There will be 8 boatslips on the right side of the pier, they will be 13'x20' in
side with a 3lx20'catwalk on each one 8 in all.There will be 6 pilings inside each one
so the owners will have the future option of installin boatlifts. There are 8 different
slips for 8 different people who live in the townhouse community.
NCDENR has overseen the proposed project and this cama major
application , they have given us the go ahead with the square footage of the
proposed pier structures. They have also given us the ok with water depth
requirements ,the water depths are listed on drawing 1 b.
Bayview Townes is a towne house community with at least 8 tenants
. There existing pier is unstable, unusable and they are in extreme need of a new pier
to access and store there boats and watercraft.

and cross-sectional drawings) drawn to scale in black
ink on an 8 112- by 11- white paper. (Refer to
Coastal Resources Cl'mmission Rule 7J .0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently' detailed to
