The project includes construction of an intake structure in the Neuse River to withdraw water from the river for treatment. A Department of the Army Permit was issued by your office on April 7, 2005 for the project (Action ID No. 200510642). As we discussed on the telephone a couple of months ago, we propose to make two minor modifications to the design of the intake structure on the Neuse River. As we discussed, our geotechnical engineer has recommended that we add NCDOT Class 2 rip rap to the river bank above the intake piping to protect the intake pipes and improve stability. We also propose to extend the dredging limits approximately 20 feet toward the bank (along the intake pipelines). The total disturbance to the Neuse River (in stream-length) will not change as a result of these modifications. During our telephone conversation, you did not object to the described changes but requested a revised site plan for your files. The application and supporting documentation provides adequate assurance that the proposed work will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate the applicable portions of Sections 301, 302, 303, 306,307 of PL 92-500 and PL 95-217 if conducted in accordance with the application, the supporting documentation, and conditions hereinafter set forth. This approval is only valid for the purpose and design submitted in the application materials and as described in the Public Notice. If the project is changed, prior to notification a new application for a new Certification is required. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions of this Certification. Any new owner must notify the Division and request the Certification be issued in their name. Should wetland or stream fill be requested in the future, additional compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). If any plan revisions from the approved site plan result in a change in stream or wetland impact or an increase in impervious surfaces, the DWQ shall be notified in writing and a new application for 401 Certification may be required. For this approval to be valid, compliance with the conditions listed below is required. Conditions of Certification: 1. Impacts Approved The following impacts are hereby approved as long as all of the other specific and general conditions of this Certification are met. Application Sediment and Erosion Control: 2. Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to protect surface waters standards: Neuse Regional Water and Sewer Authority (WASA) Page 3 of 4 August 8, 2005 a. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual. b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. d. The reclamation measures and implementation must comply with the reclamation in accordance with the requirements of the Sedimentation Pollution Control Act. 3. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian buffers beyond the footprint of the impacts depicted in the 404/401 Permit Application. All construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur; 4. Sediment and erosion control measures shall not be placed in wetlands, riparian buffers or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within six months of the date that the Division of Land Resources has released the project; Continuing Compliance: 5. Neuse Regional Water and Sewer Authority (WASA) shall conduct construction activities in a manner consistent with State water quality standards (including any requirements resulting from compliance with section 303(d) of the Clean Water Act) and any other appropriate requirements of State law and federal law. If the Division determines that such standards or laws are not being met (including the failure to sustain a designated or achieved use) or that State or federal law is being violated, or that further conditions are necessary to assure compliance, the Division may reevaluate and modify this Certification to include conditions appropriate to assure compliance with such standards and requirements in accordance with 15A NCAC 2H.0507(d). Before modifying the Certification, the Division shall notify and Neuse Regional Water and Sewer Authority (WASA) and the US Army Corps of Engineers, provide public notice in accordance with 15A NCAC 21-1.0503 and provide opportunity for public hearing in accordance with 15A NCAC 2H.0504. Any new or revised conditions shall be provided to and Neuse Regional Water and Sewer Authority (WASA) in writing, shall be provided to the United States Army Corps of Engineers for reference in any Permit issued pursuant to Section 404 of the Clean Water Act, and shall also become conditions of the 404 Permit for the project; Other conditions - Stormwater Management: 6. Diffuse Flow (No Review) Neuse Regional Water and Sewer Authority (WASA) Page 4 of 4 August 8, 2005 All constructed stormwater conveyance outlets from the project site including the water treatment plant shall be directed and maintained as diffuse flow at non-erosive velocities through the protected stream buffers such that it will not re-concentrate before discharging into a stream as identified within 15A NCAC 2B .0233 (5). If this is not possible, it may be necessary to provide stormwater facilities that are considered to remove nitrogen. This may require additional approval from this Office. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within sixty (60) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. If modifications are made to an original Certification, you have the right to an adjudicatory hearing on the modifications upon written request within sixty (60) days following receipt of the Certification. Unless such demands are made, this Certification shall be final and binding. Describe the existing conditions on the site and general land use in the vicinity of the project at the time of this application: The raw water intake/pump station and water treatment plant sites are currently farmland. The site and the land in the vicinity is within Lenoir County's Rural zoning district. 10. Describe the overall project in detail, including the type of equipment to be used: The project includes construction of a 30-million-gallons-per-day (mgd) raw water intake structure and raw water pump station at the Neuse River and a 15-mgd conventional water treatment plant (expandable to 30 mgd in the future) on an upland site. A 42-inch raw water main will be constricted along Kennedy Home Road to convey water from the raw water intake site to the water treatment plant. The raw water pump station will be located on the upland side of the floodway boundary and 50-foot Neuse River buffer. Two parallel 36-inch ductile iron or steel pipes will extend from the raw water pump station approximately 85 feet into the Neuse River. Four sets of wedge-wire screens will be installed at the ends of the pipes. The screen mesh openings will be 1.0 millimeter, and the screen area will be sized for a maximum flow-through velocity of 0.5 feet per second. Equipment to be used during construction will include excavators trackhoes dump tricks, barges, cofferdams, pile-driving equipment and cranes. As recommended by the US Fish and Wildlife Service during the NEPA review, an in-stream silt curtain weighted at the bottom will be used during constriction of the raw water intake structure in the Neuse River. The pipes may be installed by excavation and trenching on the bank or Jack-and=bore or similar technique. Installation of the intake screens on the ends of the pipes will require dredging of the river sediment. 11. Explain the purpose of the proposed work:. The project is needed to provide a regional drinking water supply to Lenoir County. Currently the five water supply systems serving Lenoir County and several systems in Pitt County use groundwater as their source of drinking water. The State of NC has adopted regulations (Central Coastal Plan Capacity Use Area, or CCPCUA, rules) to limit future withdrawals from the Black Creek and Upper Cape Fear aquifers. Therefore, the Lenoir County and some Pitt County water supply systems formed the Neuse River Water and Sewer Authority to develop a regional water supply solution. The new Neuse Regional Water Treatment Plant will treat water withdrawn from the Neuse River through the new raw water intake structure. IV. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Include the USACE Action ID Number, DWQ Project Number, application date, and date permits and certifications were issued or withdrawn. Proposed Impacts to Waters of the United States/Waters of the State It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to wetlands, open water, and stream channels associated with the project. The applicant must also provide justification for these impacts in Section VII below. All proposed impacts, permanent and temporary, must be listed herein, and must be clearly identifiable on an accompanying site plan. All wetlands and waters, and all streams (intermittent and perennial) must be shown on a delineation map, whether or not impacts are proposed to these systems. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. The construction of a new raw water intake (RWI) on the Neuse River upstream of Kinston in western Lenoir County, a new 22 million gallons per day regional water treatment plant (WTP), and approximately 93 miles of new water transmis- sion lines throughout Lenoir County, Greene County, and western Pitt County. The project will link 16 existing public water systems in the three county areas all of which presently rely on groundwater from the Cretaceous aquifers. Because these aquifers are becoming depleted, the N.C. Environmental Management Commission.adopted the Central Coastal Plain Capacity Use Area (CCPCUA) plan which requires major users to. gradually reduce their purpping rates by 75 percent over the next 15 years. The proposed project will allow these communities to comply with the CCPCUA plan by providing an alternative public water supply, and will, support a reasonable level of economic growth. • The proposed (RWI) structure and pump station site is on the north bank of the Neuse River at Pot Neck, 7.6 miles southwest of downtown Kinston. It is being designed in consultation.with the N. C. Wildlife Resources Commission ,and U.S. Fish R Wildlife Service to minimize entrainment and impingement of fish, including anadromous fish eggs and larvae. Anew transmission main will convey raw water to theriew WTP, to be built on a 100 acre tract 1.5 miles .north of the RWI, locally known as West Parrott Farm. A40 million gallon upland reservoir-adjacent to the WTP will provide two days of raw water storage for the initial WTP capacity, and space will be reserved for a second 40 million gallon reservoir to be built when needed. • Two new potable water transmission mains will connect the WTP to existing local water distribution systems; one.run- ningenorth and eastward along roadsides from the WTP to serve. Kinston, Global TransPark (GTP), and other:commu- nities in northem Lenoir County, Greene County and Pitt County, .and the second line will run southeastward along a power, line right-of=way to serve Pink Hill, Deep Run, and other communities in southern Lenoir County. • Assuring reliable flows, pressure, and water quality throughout the three-county water systems will require seven new -elevated water tanks and ten booster pump stations. All 93 miles of new transmission lines within and between the . participating communities are intended to connect existing systems only. The majority of new waterlines (87 miles) will be installed along roadsides, generally within the maintained road right-of-way, and the remaining 6 miles Will be off-road in new right-of-way. All off-road transmission lines were designed to parallel existing utility rights-of-way or private roads, minimizing the need for new land disturbance. The elevated tanks and booster pump stations are also sited on previously disturbed land along roadside whereverpossible. Rural Development has assessed the environmental impacts of this proposed project and determined that if imple- mented, the proposed project will permanently convert approximately 100 acres of important farmlands to public utility industrial use. The EA does mention that Falls Reservoir might have to operate differently in the future to accommodate downstream withdrawals and discharges. The EA should indicate that this change in operating policy would likely require a Section 216 study by the U.S. Army Corps of Engineers and approval by the United States Congress. c. Scoping comment 94 - We had asked that the EA describe how the portion of water withdrawn from the Neuse that would be returned as treated wastewater would change over time. This is only briefly mentioned on page 37 and no quantities over time are given. d. Scoping comment #5 - We had requested that the EA itemize how much of the new surface water withdrawal would be to offset mandated reductions in groundwater withdrawals and how much would be to accommodate new demands. This is discussed in general terms on pages 10 and 11. (5) The EA needs to identify that portion of the project needed to offset required reductions in ground water pumping versus that portion intended to provide for future economic development. Secondary and cumulative impacts will need to be addressed for that portion of the project intended to provide for future growth. Potential effects on unknown resources must be assessed prior to the initiation of construction activities. All undeveloped areas of the projecr should be surveyed. Supply lines within established Department of Transportation right-of-ways may be eliminated from consideration. We wish to note that the CD format of your submission considerably complicated our review process. While this format obviously minirrizes your costs, our computers are not powerful enough to properly handle the data. These tecLical problems delayed our review. Two copies of the resulting archaeological survey report, as well as ene copy of --he appropriate site forms, should be forwarded to us for review and comr_lent as soon as they are available and well in advance of any construction activities.
